ALIT ORDINANCE
ENTITIZD AN ORDINANCE PROVIDING COMPARTMENTS ON MOTOR
-BUSSES FOR THE ACCOMMODATION OF WHITE AND NEGRO PASSENGERS;
DEFINING CERTAIN TERMS.: PROVIDING THAT COPIES OF CERTAIN
SECTIONS OF THIS ORDINANCE BE POSTED IN•EACH BUS; MAKING IT
A MISDEMEANOR FOR THE VIOLATION HEREOF AND PROVIDING A PEN-
ALTY AND REPEALING ALL * ORDINANCES N CONFLICT HEREWITH AND
DECLARING AN EMERGENCY.
BE IT ORDAJNED BY THE CITY COWISSION OF THE
CITY OF BEAUMONT:
Section 1.
- DEFINITIONS:
(a) The term "negro", as used herein, shall include every
person of African descent as defined by the statutes of this
State."
(b) The term "motor bus"., as used herein, shall include
every motor vehicle operated as a commercial common carrier of
persons over, along and upon any street or public thoroughfare
within the City limits of the City of Beaumont -on a regular
schedule and over a fixed route.
(c) Eash motor bus, as defined herein, having a board or
marker placed in a conspicuous place bearing appropriate words
in plain letters indicating the race for which space is set a-
part, shall be Buff3ciont ' as a separate compartment within the
meaning of this ordinance.
Section 2.
Every motor bus company or any person or the agent of any
person, firm or corporation, or lessee, manager or receiver
thereof; who operates a motor bus or motor busses as herein de-
fined, shall provide separate compartments for the accommodation
of white and negro passengers.
Section 3.
It shall hereafter be unlawful for any passenger on a
motor -,bus,, as defined. here , inoperating" within the City limits.
of the`City of Beaumont and having separate compartments as
herein provided, to ride in any such compartment not designat-
ed for his race.
Section 4.
It shall be unlawful for any pas en er-on -any motor bus,
as herein defined, operating within t e ity limits of -the City
of Beaumont,- and having separate compartments as herein provid-
ed, to remove or change the location of any board or marker
+, placed in said motor bus for'the purpose of indicating the race
,1 ', for which space is set apart.
Section 5.
Every motor bus company or individual operating a motor
bus, as herein defined.. shall keep copies of the sections
hereinafter designated posted in each motor bus; and it shall
hereafter be unlawful for anyone to operate a motor bus, as
defined herein, within the City limits of the City of Beau-
mont, which motor bus does not have posted therein in a con-
spicuous place a printed copy of the following sections of
this Ordinance: Section 3, Section 4 and Section 6.
Section 6.
Any person violating any of the provisions of this or-
dinance shall be deemed guilty of a misdemeanor and upon con-
viction thereof in the Corporation Court shall be fined in
any stun not more than One Hundred (6100.00) Dollars.
Section 7.
This ordinance shall not be construed so as to bring with-
in its terms any commercial motor vehicle employed as a common
carrier of persons engaged in intra- or inter -state commerce.
Section 8.
All ordinances or parts of ordinances in conflict herewith
shall be, and hereby are, expressly repealed.
Section 9.
The fact that numerous difficulties have recently occurred
between white and negro passengers on motor busses, as herein
defined, with respect to the location of seats in said motor
busses, and the fact that the City of Beaumont has at present no
adequate ordinance regulating the segregation of races on motor
buses creates an emergency and an imperative public necessity
requiring the suspension of the rule requiring all ordinances to
be read on three several occasions, whereas, such ruling is here-
by suspended and this Ordinance shall become effective immediate-
ly upon the passage hereof.
PASSED by an affirmative vote of all members of the City
Commission this theday of July, A.D ., 1942.
