AN ORDINANCE.
ENTITLED AN ORDINANCE AUTHORIZING THE
MAYOR AND THE CITY CLERK TO EXECUTE AND DELIVER
TO J. AUSTIN BARNES OF BEA.UMONT, JEFFERSON COUNTY,
TEXAS, AN ASSIGNMENT AND TRANSFER OF A CERTAIN
JUDGMENT FORECLOSING A TAX LIEN AGAINST CERTAIN
LAND OWNED BY DAVE CLARK, WHICH LAND IS LOCATED
IN THE D. BROWN SURVEY, UPON THE PAYMENT BY THE
SAID J. AUSTIN BARNES TO THE CITY OF BEAUMONT OF
THE SUM OF THREE HUNDRED SEVENTY-THREE, AND 41/100
($373.41) DOLLARS.
WHEREAS, on October 12, 1939, a judgment was obtained by
the City of Beaumont against Dave Clark foreclosing a tax lien
on certain property therein described, said judgment having
been entered in Cause No.26,640 styled City of Beaumont vs.
Dave Clark on the Docket of the 58Th District Court of Jeffer-
son County, Texas, and said judgment was recorded in Volume
Five at Page 103 of the Tax Judgment Minutes of said Court; and
WHEREAS, said judgment forecloses a tax lien against the
land and premises therein described for the payment of the taxes,
interest and penalties therein mentioned to which judgment refer-
ence is here made for the purpose of obtaining a description of
the land as well as the amount of the indebtedness; and
WHEREAS, there isstill due and unpaid on said judgment
the sum of Three Hundred Seventy-three and 411000 (373.41)
Dollars, and the tax lien established and ordered foreclosed in
said judgment is still a valid and subsisting lien against the
said land and premises; and
WHEREAS, J. Austin Barnes of Beaumont, Texas, desires to
pur6,hase the said indebtedness in the sum of Three Hundred Seven-
ty-three and 41100 (373.41) Dollars, as well as the said lien
and all other rights accruing to the City of Beaumont under the
said judgment and the City of Beaumont desires to sell, assign,
and transfer the same to the said J. Austin Barnes upon the

payment to the City of Beaumont of the sum of Three Hundred
Seventy-three and 41/100 (373.41) Dollars.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION
OF THE CITY OF BEATJMONT :
That the Mayor and the City Clerk be and they are hereby
in all things authorized and directed to execute and deliver to
J: Austin Barnes of the City of Beaumont, Jefferson County, Texas,
an assignment, transfer and conveyance of the said tax judgment
and all rights accruing to the City of Beaumont thereunder upon
the payment to the City of Beaumont by the said J. Austin Barnes
of the said sum of Three Hundred Seventy-three and 41/100 (0373.41)
Dollars.

to purchase the said indebtedness in the sum of Three Hundred
Seventy-three and 41/100 ($373.41) Dollars, as well as the said
lien and all other;.:rights accruing to, the City of Beaumont under
the said judgment and the City of Beaumont desires to sell, assign,
and transfer the same to the said J. Austin Barnes upon.the_pay-
ment to the City of Beaumont of the sm of Three hundred Seventy-
three and 41/1.00 ($373.41) Doll.arsl and

authorizing the Mayor and City Clerk to execute and deliver to
J. Austin Barnes of the City of Beaumont, Jefferson County,
Texas, an assignment, transfer and conveyance of the said.Tax
Judgment and all rights accruing to the City of Beaumont there-
under upon the payment to the City of Beaumont by the said J.
Austin Barnes of the $XM of Three Hundred Seventy-three and
41/100 ($3733.411.
NOW THERI;FORE, KNOW ALL MRI BY `IEESE ,PRZSUITS that
The City of Beaumont acting herein by Geo. W. Morgan, Mayor of
the City of Beaumont, and attested by Hugh Blevins, City Clerk,
for and in consideration of the sun of Three Hundred Seventy-
three and 41/100 ($373441) Dollars paid to the City of Beaumont
by J. Austin Barnes,, the receipt of which is hereby acknowledged,
do hereby transfer and assign to the said J. Austir? Barnes that
certain judgment recovered by the City of Bea -11on,t, in Cause No,
2696400 styled -City of Beamiont vs. Dave Clark on the Docket of
the 38th District Court of Jefferson County, Texas, against
Dave Clark, there still remaining due and unpaid on said judgment
the sum of Three Hundred Seventy-three and 41/100 ($373.41)
Dollars, with full authority to demand and receive the same
to his ovrn use, and upon payment thereof, or of any part, to
give discharge ,for the same. And the said J. Austin Barnes is
hereby authorized, in the name of the City of Beaumont, but at
his ovm cost and charge to sue out execution and all other
legal process that may be necessary for the enforcement of said
judgment.
And the City of Beaumont does hereby covenant that
there is now due on -said judgment the sum of Three Hundred
Seventy-three and 41/100 ($375.41) Dollars, and that it will
not collect or receive the same or any part thereof, nor release
or discharge the said jud.gimento
