Granting to the Texarkana & Fort Smith Railway Company,
a corporation, its successors or assigns, the right and priv-
ilege to construct, lay and maintain a standard gauge rail-
road track over and across Milam Street, said track to -break
out on a westerly side of the main track of the Texarkana &
Fort Smith Railway Company thirty-two (32) feet more or less
southerly, as measured along the center line of said main
track, from the southwesterly line of Milam Street, and ex-
tending northwesterly across Milam Street; and a standard
gauge railroad track to break out on the westerly side of
the proposed track hereinabove described, ten (10) feet more
or less, southerly from as measured along the center line of
said proposed track hereinabove described, the northwesterly
line of Milam Street and extending in a northwesterly direct-
ion across Milam Street in the City of Beaumont, Jefferson.
County, Texas, and to construct and maintain its tracks and
to operate cars over and across said tracks and street for a
eriod of ten (10) years, providing for a consideration of
25.00 to be paid -annually, and prescribing the conditions
to be fulfilled before said ordinance shall go into effect
and the time limit for the construction of said track.
BE.IT ORDAINED BY THE CITY COMMISSION
OF THE CITY OF BEAUMONT:
Section 1.
The Texarkana & Fort Smith Railway Company, its successors
and assigns, is hereby granted the right and privilege to con-
struct, lay and maintain, at its own expense, a standard gauge
railroad track on and across Milam Street in the City of Beaumobt,
Jefferson County, Texas, and to maintain the same and to operate
cars. thereon for a period ten (10) years, said standard gauge
railroad track to be laid upon and across Milam Street in Beaumont,
Jefferson County, Texas, as follows;
Said track breaking out on the westerly
side of the main track of the Texarkana &
Fort Smith Railway Company thirty-two (32)
feet more -or less southerly as measured a-
long the center line of said main track,
from the southwesterly line of Milam Street,
and extending northwesterly across Milam
Street; and a standard gauge railroad track
breaking out on the westerly side of the a-
bove proposed track, ten (10) feet more or
less, southerly from as measured along the
center line of said proposed track as herein-
above described, the northwesterly line of
Milam Street and extending in a northwester-
ly direction across Milam Street, the portions
of said track lying within the limits of Milam
Street being shown in solid yellow on the attach-
ed print of drawing Ao.13-11, dated November 7,
1930.
Section 2.
The standard gauge railroad track to be constructed,
laid and maintained under -the terms and conditions of this
ordinance, shall be used as an industry track, it being
understood that the construction of said track is for the
purpose of reaching commercial and industrial enterprises.
Section 3.
The foregoing rights and privileges are granted upon
the expressed condition that said grantee shall within
thirty (30) days after the final passage of this ordinance
file with the City rClerk`, J.:c:.,r of the City of Beaumont its
written acceptance of this ordinance.
Section 4.
Unless the grantee, its successors or assigns shall
construct, lay and have completed, the track herein comtem-
plated within twelve (12) months after the final passage,
acceptance and publication of this ordinance, the same shall
be null and void and of no force and effect.
Section 5.
This ordinance is passed subect to all the terms and
provisions of the charter of the City of Beaumont.
Section 6.
This ordinance shall go into effect thirty (30) days
after its adoption on its third and final reading and fil-
ing of acceptance and shall continue in full force and
effect for a period of ten (10) years thereafter.
Section 7.
The compensation to be paid to the City of Beaumont by
grantee herein is the sum of.Twenty-five ($25.00) per.annum

at the time this ordinance takes effect and annually in
advance thereafter on the lst day of July of each and
every year.
PASSED by an affirmative vote of the City Commission
