AN ORDINANCE
ENTITLED AN ORDINANCE ORDERING AN ELECTION TO
BE HELD IN THE CITY OF BEAUMONT TO DETERMINE WHETHER
OR NOT THE CITY COMMISSION SHALL ABANDON THE PROJECT
OF BUILDING AND EQUIPPING A COMBINED ASSEMBLY HALL
AND RECREATION BUILDING; WHETHER OR NOT THE CITY COM-
MISSION SHALL ABANDON THE PROJECT OF IMPROVING, EX-
TENDING, EQUIPPING AND REPAIRING THE PRESENT AIRPORT
OF THE CITY OF BEAUMONT TO THE EXTENT THAT ONE HUNDRED
TWENTY-FIVE THOUSAND (6125,000.00) DOLLARS OF THE BOND
MONEY -VOTED FOR THAT PURPOSE BE NOT USED FOR SAID PUR-
POSE; AUTHORIZING THE CITY COMMISSION OF THE CITY OF
BEAUMONT TO EXPEND AND USE IN ACQUIRING A SITE, CON-
STRUCTING AND EQUIPPING A MUNICIPALLY OWNED AND OPERA-
TED CHARITY HOSPITAL THE PROCEEDS NOW ON HAND OF THE
SALE OF FORTY THOUSAND (40,000."00) DOLLARS OF MUNICI-
PAL BONDS WHICH WERE ORIGINALLY ISSUED FOR THE PURPOSE
OF BUILDING AND EQUIPPING AN ASSEMBLY HALL AND RECREA-
TION BUILDING; AUTHORIZING THE CITY COMMISSION OF THE
CITY OF BEAUMONT TO EXPEND AND USE IN ACQUIRING A SITE,
CONSTRUCTING AND EQUIPPING A MUNICIPALLY OWNED AND
OPERATED CHARITY HOSPITAL ONE HUNDRED AND TWENTY-FIVE,
THOUSAND (125,000.00). DOLLARS OF THE PROCEEDS OF THE
SALE OF MUNICIPAL BONDS WHICH WERE ORIGINALLY ISSUED
FOR THE PURPOSE OF IMPROVING, EXTENDING, EQUIPPING AND
REPAIRING THE PRESENT AIRPORT; NAMING THE TIME AND PLACE
OF HOLDING SAID ELECTION AND APPOINTING OFFICERS THEREOF;
PROVIDING FOR THE MANNER.OF HOLDING SAID ELECTION AND
GIVING NOTICE THEREOF AND DECLARING AN EMERGENCY.
WHEREAS, at an election held on the 16th day of
September, A. D. 1938, a majority of the qualified property tax
paying voters of the City of Beaumont authorized the City Com-
mission of the City of Beaumont to issue serial bonds in the
amount of 6175,000.00 for the purpose of improving, extending,
equipping and repairing the present airport of the City of
Beaumont; and
WHEREAS, at the same election the said voters of the
City of Beaumont further authorized the City,Commission of the
City of Beaumont to issue serial bonds of the City of Beaumont
in the amount of Forty Thousand ($40,000.00) Dollars for the
purpose of building and equipping a combined assembly hall and
recreation building; and
WHEREAS, pursuant to the authority vested in the City
Commission by the said voters of the City of Beaumont as ex-
pressed in said election, the City Commission of the City of
Beaumont did issue and sell.or cause to be issued and sold said

bonds as authorized at said election; and
WHEREAS, due to the fact that Jefferson County, in
cooperation with the Federal Government or certain agencie&
thereof, is now constructing or is about to construct -an airport
situated about half way between Beaumont and Port Arthur, which
airport will be far superior in every respect to the present air-
port of the City of Beaumont; and
WHEREAS, said airport will be available to the City of
Beaumont and it& inhabitants and the expenditure of all of the
sum realized from the sale of the bonds which were issued for
the purpose of extending, equippl,ng and repairing the present
airport of the City of Beaumont is not now needed due to the
construction of the county airport as aforesaid; and
WHEREAS, it further appears that because of the
changed conditions which have been brought about by'the present
national emergency the proposed plan for building and equipping
a combined -_assembly hall and recreation building should be aban-
doned for the reason that the building as planned.would be in-
adequate and it further now appears that either the Federal.
Government or the State Government, or both said governments
acting together, will.probably construct a building for the same
or a similar purpose in the near futurelat or near Beaumont,
which building will be ample and adequate to cover the needs.
of this community and it is accordingly the consensus of opinion
of the people of this city generally that it would be unwise and
unjudicious,for the City Commission to spend the money novo on
hand derived from the sale of $40,000.00 in bonds aforesaid in
the construction of said building; and
WHEREAS, it appears that the City of Beaumont is in
great need of a municipally owned and operated_Charity Hospital
and that such a hospital would promote and facilitate public
health work in this City and would -aid in the control -and pre-
vention of disease among the inhabitants of the City; and
WHEREAS, there is now on hand and unexpended the sum
of Thirty-nine Thousand Five Hundred Twenty-five 0039,525.00)
Dollars derived from the sale of Forty (040,000.00) Dollars in
bonds voted for the purpose of building and equipping a combined.
assembly hall and recreation building; and
WHEREAS, it is to the best interest of the City of
Beaumont that the construction of the combined assembly hall
and recreation building be abandoned and that the proceeds of
the sale now on hand of the 040,000.00 in bonds voted for that
purpose be applied toward acquiring a site, the building and
equipping of the municipally.owned and operated Charity Hospital
hereinbefore mentioned, said hospital to be operated by the City
of Beaumont or by a board appointed by the City; and -r
WHEREAS, the best interest of the City of Beaumont
requires that the improving, extending, equipping and repairing
of the present airport be abandoned to the extent that 125,000.00
of the money realized from the sale of the airport bonds should
not be expended for said purpose but that as to the said
$125,000.00 of said bond money the same should be used for the
purpose of acquiring a site, constructing and equipping the
municipally owned and operated Charity Hospital.aforesaid, said
hospital to be operated by the City of Beaumont or by a board
appointed by the City.;' and
WHEREAS, there is a dire need of a municipally owned
and operated Charity Hospital in this City in order to more
adequately prevent, control and treat diseases which are pre-
valent among the inhabitants of the City who are unable to
secure treatment for themselves, and proper hospital facilities,
for the use of the health authorities of this City and for the
convenience of the people who are unable to secure hospital treat-
ment elsewhere is greatly needed and the public health is endanger-
ed under existing conditions which has created an imperative -.pub-
lic emergency.

NOVA, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF BEAUMONT:
SECTION 1.
That an election be held in the City of Beaumont on
the l,,( day of July, A. D. 1941, at which election the follow-
ing matters shall be submitted:
SECTION 2.
Shall the City Commission of the City of Beaumont be
authorized and empowered tot
(a.) Abandon the project of building and equipping a
combined assembly hall and recreation building for which build-
ing $40,000.00 in bonds were issued and sold pursuant to an
election held on the 16th day of September, 19382
(b) Abandon the project of improving, extending, equip-
ping and repairing the present airport of the City of Beaumont to
the extent that $125,000.00 of the money realized. from the sale
of 175,000.00 in municipal bonds: which were issued and sold pur-
suant to an election held on September 16, 1938, be not used for
said purpose?
(c) Expend and use in acquiring the site, constructing
and equipping said municipally owned and operated Charity Hospital
the unexpended proceeds of the sale of $40,000.00 in bonds which
were originally issued and sold for the purpose of building and
equipping the combined assembly hall and recreation building afore-
said? -
(d) Expend and use in acquiring the site, constructing
and equipping the municipally owned and operated Charity Hospital
$125,000.00 of the proceeds of the sale of $175,000.00 in bonds
which were originally issued and sold for the purpose of improv-
ing, extending, equipping and repairing the present airport of
the City of Beaumont?

SECTION 3.
Said election shall be held at the following places,
to -wit:
The First Ward:
The Second Ward:
Junker School, Central Fire Station,
and Averill School Building.
Beaumont High School Building and
City Hall.
The Third Viard: Sabine Pass Fire Station, David Crockett
Junior High School, and South Park
Elementary School Building.
SECTION 4.
The following persons are hereby appointed judges of
their respective voting boxes with the authority to select and
appoint their own clerks:

SECTION 5.
The questions to be submitted to the voters at said
election shall be submitted in four propositions and there shall
be printed on the ballots used in said election the following:
FIRST PROPOSITION.
For abandoning the project of building and equip-
ping a combined assembly hall and recreation building.
Against abandoning the project of building and
equipping a combined assembly hall and recreation build-
ing.
SECOND PROPOSITION.
For abandoning the project of improving, extending,
equipping and repairing the present airport of the City
of Beaumont to the extent that $125,000.QO of the bond
money now on hand be not used for said purpose.
Against abandoning the project of improving, ex-
tending, equipping and repairing the present airport -
of the City of Beaumont to the extent that 125,000.00
of the bond money now on hand be not used for said pur-
pose.
THIRD PROPOSITION.
For expending -and using in acquiring the site,
constructing and equipping a municipally owned and
operated Charit Hospital, the proceeds now on hand
of the sale of 1.40.,000.00 of municipal bonds which
were originally issued for the purpose of building
and equipping a combined assembly hall and recreation
building.
Against expendlhg.and using in acquiring the
site, constructing and equipping a municipally owned
and operated Charity Hospital the proceeds now on
hand of the sale of 40,000.00 of municipal bonds
which were originally issued for the purpose of
building and equipping a combined assembly hall and
recreation building.
FOURTH PROPOSITION
For expending and using in acquiring the site,
constructing and equipping a municipally owned and
operated Charit Hospital $125,000.00 of the proceeds,
of the sale of 1175,000.00 of municipal bonds which
were originally issued -for the purpose of improving,
extending, equipping and rep airing the present air-
port of the City of Beaumont.
Against expending and using in acquiring the
site, constructing and equipping a -municipally owned_
and operated Charity Hospital $125,000.00 of the pro-
ceeds of the sale of $175,000.00, of municipal bonds:
which were originally issued for the purpose of im-
proving, extending, equipping -and repairing the pre-
sent airport of the City of Beaumont.
-All of the voters desiring to support the above
stated propositions, or any of them, shall run a line
through or across that -section of each proposition
which he desires to support which begins with the word
"Against"; and all voters desiring to vote against the
above stated propositions, or any of thein, shall run a
line through or across that section of each proposition
which he opposes. printed on the ballot beginning with
the word "For".
SECTION 6.
Said election shall be held under the provisions
of the State law governing elections and only qualified voters
who pay taxes on property in the City of Beaumont shall be al-
lowed to vote at said election.
SECTION 7.
A copy of this ordinance signed by the Mayor of the
City of Beaumont and attested by the City Clerk of the City
of Beaumont shall serve as proper and sufficient notice of the
said election and the Mayor is hereby directed to cause one each
of said notices to be posted in each of the election precincts,
in the City of Beaumont at each of the places designated for
holding said election at least fifteen and not more than thirty
days prior to the date of holding of said election, and the
person posting said notices shall make a return on the copy
thereof showing the time and place of said posting, which return
shall be filed in the office of the City Clerk and shall be con-
clusive evidence of the posting of said notice, and a copy of
this ordinance shall be published on the same day in each of
two successive weeks in a newspaper of general circulation which
has been continuously and regularly published in the City of
Beaumont for a period of one year prior to the date of the pas-
sage of this ordinance, and the date of the first publication
of this ordinance shall be not less than fourteen days prior to
the date set for the holding of said election.
SECTION 8.
The fact that there is a dire need of a municipally
owned and operated Charity Hospital in this City in order to
more adequately prevent, control and treat diseases which are
prevalent among the inhabitants of the City who are unable to
secure treatment for themselves, and this lack of hospital
facilities for the use of the health authorities of this City
and for the treatment of those patients who are unable to secure
hospital treatment elsewhere tend to endanger public health and
has created an imperative public emergency necessitating the
suspension of the rule requiring ordinances to be read on three
separate days before the passage of the ordinance, and said rine
is hereby suspended and this ordinance shall take effect from
and after the date of its passage.
PASSED this the day of June, A. D. 1941s by an
affirmative vote of all of the members of the City Commission
of the City of Beaumont.
