ENTITLED AN ORDINANCE AUTHORIZING THE laYOR
OF THE CITY OF BEAUMONT TO LEASE CERTAIN PROPERTY
LOCATED IN JEFFERSON COUNTY, TEXAS', 121D NEAR THE
MUNICIPAL ABATTOIR, TO F .. J. ZUMMO, DOING BUSI-
NESS AS ZUMMO.MEAT COMPANY, TO BE USED.FOR STOCK
PENS, SAID PROPERTY BEING MORE FULLY DESCRIBED AS
FOLLOWS-, TO -WIT:
BEGINNING'at the most southerly corner of the
Abattoir tract; thence North along the East line
of said Abattoir tract five hundred forty-two ( 542)
feet to the beginning corner of this description;
thence North along said East line of Abattoir tract
one hundred (100) feet to stake for corner; thence
West along a line perpendicular to said East.line
sixty (60) feet to stake for corner; thence South
along a line parallel with and sixty (60) feet dis-
tant from said East line one hundred (100) feet to
stake for corner; thence East along a line per-
pendicular with said East line sixty (60) feet to
place of beginning.
BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF BEAUMONT:
That the Mayor be, and he hereby is authorized to
enter into a lease contract in behalf of the City of Beau-
mont with F. J. Zummo, doing business as the Zummo Meat Com-
pany., upon the above described property belonging to the City
of Beaumont, for . a term of one year beginning January 1, 1940
and ending December 31, 1940, for an annual consideration of
One Hundred (100,00) Dollars payable cash in advance, a copy
of said lease contract being attached hereto and by reference
made a part hereof, the purpose of said lease contract being
°to reduce to writing an oral agreement between the parties
whereby the said F. J. Zummo has been permitted to occupy. the
said above described premises since the 1st day of January,
1940, with the understanding that he could so occupy said
property until the 31st day of December, 1940.
PASSED by an affirmative vote of the City Commission

hereby agrees to pay as rental to Lessor, the sum of One Hun-
dred (S1QO.OQ) Dollars cash in advance during the term of this
lease; and it is further understood and agreed that since Les-
seo has heretofore fail'cd to pay Lessor any styli uhatevor for
the privilege herein_ granted, Lessee shall immediately pay the
sum of One HunCrod G,' Dollars cash in advance upon the
execution and delivery of this. lease, to cover the rental on
said preraiscs .fron January 1st, 1940, to ?december 31st, 1940.
Lessee hereby covenants and agrees with Lessor that
he will conduct and raaintain a cattle pen on said premises dur-

premises for othcr purposes,

less the City of Beaunont ibr any and all claims for injuries
or cl.7aaves.to any peroon occasioned by or arising out of the

Lessee agrees that he will keep said.premisos and
pens in a sanitary condition and will comply with all of the
laws, rules and regulations of the Federal and State Livestock
Commission_ and grill comply with all- of the ordinances of the
City of Beaumont, at no cost to Lessor..
Lessee further covenants and agrees that he will
not assign or sub -let the whole or any part of the said
leased premises.
It is further mutually agreed and understood by end
between the
parties
hereto that
Lessor shall have
the privilege
to use the
land and
premises or
any part thereof,
when same are
not being used by Lessee.
It is -expressly agreed and understc.od by and between
the parties hereto that. Lessor shall have, and by this contract
has, a valid first lien upon any and all of the goods, furni-.
Lure, chattels or property of any description belonging .to Les-
see, to secure the prompt payment of the rent herein stipulated .
to be paid for the use of the premises.'
