i� A N O R D I N A N C E Entitled an ordinance ordering an election to be held in the City of Beaumont on the 16th day of September, 1513, to determine existing if sections 428t121024130 36 37,0 5,51,4 68, 75 ,and 9# - of they Charter of the city of Beaumont s be amended and an additional section added to said charter, naming the time and places of holding said election and appointing officers for same and providing fhr the manner of holding said election and the giving of notice thereof. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: SECTION I. Thal'an election be held in the city of Beaumont on the 16th d.ay of September A.D. 1513, at whlo b election the following amendments^to the existing City Chax-'Vt;r shall be submitted, aRA-an SECTION II. FIRST: Amend. section 4 of the Charter of the City of Beaumont so that it shall hereafter read as follows: iQSection 4" " That the administratio(h of the business affairs of the said corporation shall be conducted by a Mayor and Board of Alderman, to be elected by the qualified voters of the city at large, and to be designated as the n Council" who shall hold their.respective offices for two years from the time of their election, and until their sueeessors shall qualify, . or in the event of their election or appointment at a time other than a regular election, then they shall hold their office until the nej(t regular city election, and until their successors shjll 4ualify, and no person shall be qualified to fill the office of Magor, unless aC- Uhe date of his election and .for the two years next proceeding -he be a qualified voter and bona fide resident of the city ^an owner of - real proper tytherein, and the said city council may divide the city into a convenient- number of -dards„ not more than tea,, and shall define and appointing officers for same and providing fbr the manner of holding said election and the giving of notice thereof. BE IT ORDAINED BY THE CITY COUNCIL'OF THE CITY OF BEAUMONT: SECTION I. Amend section 4 of the Charter of the City of Beaumont so that it shall hereafter read as follows: "Section 474 " That 'the administratio'h of the business affairs of the said corporation shall be conducted by a Mayor and Board of Alderman, to be elected by the qualified voters of the city at large, and to be designated as the " Council" who shall hold their.respective offices for two years from the time of their election, and until their sueoessors shall qualify, . or in the event of their election or appointment at a time other than a regular election, then they shall hold their office until the nej(t regular city election, and until their successors shill -qualify; and no person shall be qualified to fill the office of Magor, ,.,'unless a)C- the date of his election and .for the two years next proceeding ,he, be a qualified voter and bona fide resident of the city ^an \owner - of � , real properth-\therein,- and the said city council may divide the city into a convenient. number of -Wards, not more than ten, and shall define and establish the boundaries thereof, and may change_ the said boundaries from time to time, as may be deemed expedident, having regard for the number of inhabitants, so that each ward shall contain as nearly as may be the same number of qualified electors. And the Before mentioned Board of Aldermen .shall consist of two aldermen elected from among the qualified voters of each ward; and provided further, that the city council, may by ordinance, provide, in the event of said city being div- ided into six or more wards, that said Board of Aldermen shall consist of one #l.dermen selected from among' the qualified voters of each ward, who shall hold office for two years and until their successors are elected, "Lok qualified; c no person being competent to fill the office of alder- , man unless at the date of -his election and for two years. preceeding he be a qualified voter of the city, and for sig months prior to such election a bona fide resident of his ward and an owner of real property in said city. Should any aldermen remove from his ward during the term for which he was elected, die, become insane, or for any other reason become die - qualified to discharge the duties of his office, then his office shall become vacant and the city Council shall by ballot elect a proper and duly qualified person, by majority vote of all the aldermen elected and qualified, to fill such vacano. The aldermen shall receive such com- pensation as may be fixed by the city council by ordinance not to exceed .___._..__010.00 per session. " SECOND: SECTION III? Amend section 8 of the Charter of the City of Beaumont, so that it shall hereafter read as follows; "Section 8". " The mayor shall, not later than the second meeting of the city council after the next city election or at any time a vacancy exists, nominate to the Council, candidates for the city Secretary, Assistant City Secretary, Health Officer, City Recorder., Street Commission- er, City Engineer, City Electrician, Chief of Fire Department, Building Inspector, Water and Gas meter Inspector, Fire Marshall, Superintendent of Garbage Department, Sewer and Plumber Inspector, City Bacteriologist, who shall hold office for two years and until their successors are elected, -,qualified; aml no person being competent to fill the office of alder- maL unless at the date of his election and for two years proceeding he be a qualified voter of the city, and for sig months prior to such election a bona fide resident of his ward and an owner of real property in said city. " SECOND: SECTIOY III'.- SECOND: II': 9mend section 8 of the Charter of the City of Beaumont, so that it shall hereafter read as follows; "Section 8", " The mayor shall, not later than they second meeting of the city council after the next city election or at any time a vacancy r exists, nominate to the Council, candidates for the city Secretary, Assistant City Secretary, Health Officer, City Recorder, Street Coi:mission- er, City Engineer, City Electrician, Chief of Fire Department, Building Inspector, Water and Gas Meter Inspector, Fire Marshall, Superintendent of Garbage Department, Sewer and Plumber Inspector, City Bactexiologist, Superintendent of Ab&ttoir and such other officers as the City Council may from time to time create, who shall be confirmed by the Council and all such officers shall hold their respective offices until dismissed or discharged by the City Council or until their successors are appointad. /00A Should the City -Council by a majority vote, reject any.appointment by the Mayor of any officor, provided for herein, or refuse to confirm such appointment, the.name of such nominee shall not be again presented to by the Council the Mayor unlass the Council shall, by a two-thirds vote of all the aldermen elected, reconsider their action thereon.,'.° 14 SECTION IV. THIRD: Amend aection 12 of the Charter of the City of Beaumont so that it shall hereafter read as follows; " Section 12" " The regular meeting of the Council shall be held in the City Council Chamber as often as may be determined by the.City Council, not. to exceed three regular meetings per month, beginning at such an hour as may be fixed by said Council, and the Mayor, of his own motion,mgp call special meetings for the transaction of special business, by causing the city secretary to serve a written notice on such aldermen, or leaving the same at the residence or usual place of business of each Any three members of the Council may in like manner call special meetings of the Council, but no special meeting shall be called except in cases of urgent necessity and the notice, served on the aldermen, shall state the purpose for which the meeting was called. The Council .may adjourn from day to day until the business properly coming before it is disposed of. A majority of the whole number of aldermen elected and qualified, or the mayor and one- half of the aldermen elected and -qualified, shall be required to constitute a quorum; but any three aldermen may convene and compel the attendance of members on any day of regular or special meeting, requiring the chief of police or any police officer to bring.in the absent members; and the. 7 Council shall adop roper rules and regulations for the government of its proceedings. The meetings of the city council shall be held with open doors, except when by a,vote of a majority of the members present, it may p© deemed expedient, upon a special question, to deliberate with closed doors, The vote on all questions shall be in open seesion of the City Council. He shall keep a register of births and deaths in*the cit', and shall report the same to the council at the first meeting off that body in each month; and shall do and perform such other #5) aR/�, /0-6 A S_ /-e7)3 acts -and shall be guided by such regulations as may be prescribed by the city council or under its authority and, shall' receive such compensation as may be fixed by the city council. The City Council shall also have -the power and authority to create by ordinance a board of health of not less than 5 members mor more than nine members, three of whom shall be practicing physicians in good standing in the city of Beaumont, the other members may be selected from the qualified property tag paying voters of the city and to prescribe in said ordinance the qualifications other than those here- tofore mentionedt the dompensation and method of appointment of the member -6 of said board, and the powers, duties, and jurisdictions of said board and the respective authority of said board and of the city Health Officer, and to adopt rules governing same." FIFTH; SECTION VI. .Amend section 30 of the Charter of the City of Beaumont 6o that it shall hereafter read as follows: "Section 3010 -- -- - " The_ City --Council shall have the power to appropriate private property for public purposes whenever it shall deem it necessary; and to take by condemnation any property within or without the city limits for any -of the following purposes, which are hereby declared to be public purposes, to -wit: City Halls, Police -Stations, Jails:, Calabooses, Fire Stations, Public Libraries, Public School Houses and Grounds, High School Buildings and-gr.ounds, Academies, Hospitals, Saifitariums, Auditoaiums, Market Houses, Refornatbries, Abattoirs, Railroad tracks and terminals, Docks, Wharves, Warehouse, Ferries, Ferry Landings, Elevators, Loading and unloading devices, Shipping facilities, Piers, streets, alleys, bridges.. viaducts, parks, highways, boulevards, natatoriums, bridge approaches, playgound.s, sewer systems, storm sewers, sewerage disposal plants, drains, physicians in good standing in the city of Beaumont, the other members may be selected from the qualified property tag paying voters of the city and to proscribe in said ordinance the qualifications other than those here- . tofore mentioned, the dompensation and method of appointment of the memberiL of said board, and the powers, duties, and jurisdictions of said board and the respective authority of said' board and of the city Health Officer, and to adopt rules.governing sane." FIFTH: SEC T I OIC VI. Amend section 30 of the Charter of the City of Beaumont to that it shall hereafter read as follows: "Section 30" " The City.Council shall have the power to appropriate private property for public purposes whenever it shall deem it necessary; and to take by condemnation any property within or without the city limits for any•of the following purposes, which are hereby declared to be public Purposes, to -wit: City Halls, Police -Stations, Jails., Calabooses, Fire Stations, Public Libraries, Public School Houses and Grounds, High School Buildings and -gr.ounds, Academies, Hospitals, Sanitariums, Auditoviums, Market Houses, Refornatdri.es, Abattoirs, Railroad. tracks and terminals, Docks, Wharves, Warehouse, Ferries, Ferry Landings, Elevators, Loading and unloading devices, Shipping facilities, Piers, streets, alloys, bridges, viaducts, parks, highways, boulevards, natatoriums, bridge approaches, playgounds, sower systems, storm sewers, sewerage disposal plants, drains, 'filtering beds and emptying grounds for sewer systems, reservoirs, watersheds water supply sources, wells, pound pens, stables, public baths, water and electric lfg;ht systems, gas plants, cemeteries, crematoties, prison farms, and to acquire lands or other property within and without the . city for any other municipal purposes that -may be deemed advisable , or the '�) �60.A improvement and -enlargement of the water works, including water supply, riparian rights, stand pipes, watersheds, the construction -of: -supply re- servoirs, parks, squares and pleasure gaounds, public wharves and landing places for steamers and other crafts, and for the purpose of straightening of improving the channel of any stream, branch or drain, or the strengthen- ing or widening or extension of any street, alley, avenue or boulevard. The power herein granted shall include the right to acquire by condemnation any real estate, improvements, franchises, or property of any description, real or personal, corporeal or incorporeal, or any part thereof, which may in the hands of any person, association or corporation or the lessees, agents or receivers thereof be held, owned, or used for or devoted to any of the purposes aforesaid, or to any other public purpose, the right of the city to so acquire or appropriate the same being hereby declared to be a superior public right and use to that of any such person, association or corporation, or the lessees, agents or receivers thereof . For the condemnation of any such property, the following proceedings shall be had: The City Council shall pass a res-alution describing tha.__property to be condemned, stating for what public purpose it is intended to be used, and thereupon the provisior;s contained in the Revised Civil Statutes of the .State of Texas of 1911, relating to the condemnation of property by railway companies shall regulate and control and be pursued in the proceedings had and taken by the city for condemnation pil.rposes so far as.applicable, the city taking the position of the railroad corporation in any such proceed.ingst provided that no property shall be taken damaged or destroyed for the purposes above named., except upon adequate compensation being paid or secured by a deposit of money in the manner provided by lave for the condemnation of property by railroads, and such compensation shall include the value of and damages, if any, to all franchises, privileges, rights, easements and incorporeal properties,. if any, which may be taken, damaged, or destroyed hereunder as well as the vaule of or damages to any The power herein granted shall include the right to acquire by condemnation 7 any real estate, improvements, franchises, or property of any description, real or personal, corporeal or incorporeal, or any part thereof, which may in the hands of any person, association or corporation or the lessees, agents or receivers thereof be held, owned, or used for or devoted to any 17 of the purposes aforesaid, or to any other public purpose , the right of the city to so acquire or appropriate the same being hereby declared to be a superior public right and use to that of any such person, association or corporation, or the lessees, agents or receivers thereof • Far the condemnation of any such property, the following proceedings shall be had: The City Council shall pass a resolution describing the.proparty to be condemned, stating for what public purpose it is intended to be used, and thereupon the provisions contained in the Revised Vivil Statutes of the.State of Texas of 1911, relating to the condemnation of property by railway companies shall regulate and control and be pursued in the proceedings had and taken by the city for condemnation pr.rposes so M . far as .applicable, the city taking the position of the railroad corporation in any such procee'dingst provided that no property shall be taken damaged or destroyed for the purposes above named, except upon adequate compensation being paid or secured include by a deposit of money in the manner provided: by law for the condemnation of property by railroads, and'i�uch compensation shall- hall include the valud of and damages, if any, to all franchises, privileges, rights, easemonts and incorporeal properties, -if any, which may be taken, damaged, or destroyed hereunder as well as the vaule of or damagesto any - physical properties which may be taken, damaged or destroyed, and, the rules for ascertaining damages prescribed by Article 6518 to 6521 of said Revised Statutes shall be followed in connection with any property which may be -condemned by the city hereunder. The power of eminent domain hereby con. ferred shall include the right of the city when so expressed in the PIE resolution.of the City council to take the fee simple or absolute title to the'lands or other -property so condemned. The City Shall not be authorized to issue bonds for any of the purposes named in this section without a majority vote of the resident property tax paying votersitheredn at an election called for that purpose." SIXTH: SECTION VII Amend section 36 of the Chartet of theCity of Beaumont so that it shall hereafter read as follows; "Se.etion 36" ""The City bhall: have the power to ovm, purchase, lease or otherwise acquire and construct, maintain and operate wharves, wharf, terminals, including docks, warehouses, elevators, loading and unloading devices, terminal railways, and such other improvements and appurtenances as may be necessary or proper for the operation and maintenance thereof, and for such purposes to purchase, lease or otherwise acquire land and -other property within the limits of the city of Beaumont, and outside of said city not exceeding the distance limited by law; and the city is authorized and empowered to make such othrr improvements as may be necessary or proper 'for the better navigation of the Neches River and -Brake's Bayou and for thgconvenience of landing vessels and their cargoes and the city shall have the right to issue bonds for any or. all of the purposes mentioned in this section; provided, the same'are voted at an election called for that purpose .and as provided by lave provided, further , the proceeds of any bonds so issued shall not be expended for any such purposes outisde of the County of Jefferson, or at a distance of more than five miles, beyond the city limits of Beaumont, unless at an electiontalled for that purpose, the majority of the resident property tax paying voters voting - thereon shall ,favor such 'expenditure." resident property tax paying votersithere&n at�-an election called for that purpose •" SIXTH: SECTION VII Amend section 36 of the Charteb of theCity of Beaumont so that it shall hereafter read as follows; 1°Section 36" r• ""The 'City 'shall have the power to ovm, purchase, lease or otherwise acquire and construct, maintain and operate wharves, wharf terminals, including docks, warehouses, elevators, loading and. unloading devices, terminal railways, and such 'other improvexients and appurtenances as may be necessary or proper for the operation and maintenance thereof, and for such purposes to purchase, lease or otherwise acquire land and other property within the limits of the city of Beaumont, and outside of said city not exceeding the distance limited by law; and the city is authorized and empowered to make such othmr improvements as may be necessary or proper for the better navigation of the Neches River and Brake's Bayou and for the)convenience of landing vessels and their cargoes and the city shall have the right to issue bonds for any or.all of the purposes mentioned in this section; provided, the same -are voted at an election called for that purpose -and as provided by law; provided, further , the proceeds of any bonds so issued shall not be expended. for any such purposes outisde of the County of Jefferson, or at a distance of more than five miles. beyond the city limits of Beaumont, unless at an electiontalled for that purpose„ the majority of the resident property tag paying voters voting thereon shall favor such expenditure." SEVENTH: SECTION VIII. , Shall an additional section to the Charter of the City of Beaumont be added to be known as Section 36--A, and to read as follows: #8 "Section 36--A" 0 "If the City Council shall take advantage of the pro- visions of Section 36 hereof, the Mayor shall appoint not less than five gValified voters of the city of Beaumont subject to .confirmation by the City Council, who shall constitute the Board. of Dock and Wharf Commission - arse Said Board of Dock and Wharf Commissioners shall have the exclusive jurisdiction in the control, management and maintenance of all thid wharves and wharf terminals of the City of Beaumont, provided that said Board, of.Dock and Wharf Commissioners shall be under direction of the City Council. The qualifications, duties, authority, compensation and tenure of office of. said Board of Dock and Wharf Commissioners shall be prescribed by ordinance duly passed by the City Council." SECTION IX. EIGHTH; Amend 'Section 37 of the Charter of the City of 'Beaumont so that it shall hereafter read as follows: "Section .37'1 " The City Council' shall have the power by ordinance to control, regulate and fix the. fees and wharfage to be charged on�.11 private wharves within the city limits of the city of Beaumont, whether the same be owned or operated by individuals or corpprations, or the lessees of receivers thereof, where said wharves are used by the public and charges are made for such use by the owners thereof; and the city council shall also have the power by ordinance to control, 'regulate and fix the fees, wharfage and charges to be charged vessels or cargoes, which shall load or unload at the public wharves .of the'city o-2- Besumont, or in the harbor or port of Beaumont, whether within or without the city limits , and the city council shall be authorized to fix and establish the limits of the harbor or port of Beaumont for such purposes and to control, regulate and I7 gVc%L .Lxau vozers or the city of Beaumont subject to .confirmation by the City Council, who shall constitute the Board of Dock and Wharf Co=issionw ers. Said Board of Dock and Wharf Commissioners shall have the exclusive jurisdiction in the control, management and maintenance of all the wharves and, wharf terminals of the City of Beaumont, provided that said Boated. of.Dock and Wharf Commissioners shall be under direction of the City Council. r -The qualifications, duties, authority, compensation and tenure of office of. said Board of Dock and Wharf Commissioners shall be prescribed by a dinance duly passed by the City Council." SECTION, M. EIGHTH: Amend Section 37 of the Charter of the City o f ' Beaumont so that it shall hereafter read as follows: "Section 37 " The.City Council- shall have the power by ordinance to control, regulate and fix the. fees and wharfage to be charged on'll private wharves within the city limits of the city of Beaumont, whether the same be owned or operated by individuals or eorpprations, or the lessees or receivers thereof, where said wharves are used by the public and charges are made for such use by the owners thereof; and the city council shall also have the power by ordinance to control,'regulate and fix the fees, wharfage and charges to be charged vessels or cargoes, which shall load or unload at the public wharves of the city ol- Be aumont', or in the harbor or port of Beaumont, whether within or without the city limits , and the city council shall be authorized to fig and establish the limits of the harbor or port of Beaumont for such purposes and two c control, regulate and fix all warehouse, elevator, loading and A loadin*gJand terminal railway rates and charges for all services and facilities of this character fur- nished to the publicy the city. '� #9 NINTH: SECTION X. 16o .Amend Section 45 of the Charter of the City of Beaumont so that it shall hereafter read as follows: " Section 45 " " The city council shall have the power by ordinaace to annually levy and collect for all purposes including taxes levied for the support of public free schools, a tax of not exceeding one -dollar and eighty- cents($1.80) on each one -hundred -'dollars ($100000) valuation of all property within the city, subject to taxation, and such taxes shall be levied at such time in each and every year as may be prescribed by the city council by ordinance; the taxes above provided for when levied to be apportioned by the city council for any of the following purposes in such sums as the city council may deem necessary for the proper dministration of the affairs of the City: 1. For the general isn of the city or its propeY-'ty and. to pay current expenses. -2• Improvement of the streets and buildings aild the. building and repairing of bridges within the city. 3. Maintenance' -Of the public free schools and the erection of school buildings in the city and the City of Beaumont is hereby constituted a separate and independent school district.' 4 -Payment of interest and to provide the required sink- ing fund upon all bonds heretofore issued by the city of Beaumont or that may be hereafter issued for the purpose of peaamanent improvements of any kind, or other public purposes authorized by law of the City Charter and said city is hereby authorized to issue bonds for said pugoses when voted in compliance with the constitution and laws of the State of Texas, and Amendments thereof, such bods to bear a rate of interest not to exceed six per cent per annum, and to be sold at not less than par. The City Qt:Vl+lV!1 1*V " The city council shall have the power by ordinance to annually levy and collect for all purposes including taxes levied for the support of public free schools, a tax of not exceeding one -dollar and eighty- cents($1.80) on each one -hundred -dollars ($100.00) valuation of all property within the city, subject to taxation, and such taxes shall be levied at such time in each and every year as may be prescribed by the city council by ordinance; the taxes above provided for when levied to be apportioned by the city council for any of the following purposes in such sums as the city council may deem necessary for the proper dministr ation of the affairs of the City: 1. For the general is1provement of the city or its pxopeY.'ty and to pay current expenses. -2• Improvement of the streets and buildings and the building and repairing of bridges within the city. 3. Maintenance 'of the pnblio free schools and the erection of school buildings in the city and the City of Beaumont is hereby constituted a separate and independent school district. 4 -Payment of interest and to provide the required sink- ing fund upon all bonds heretofore issued by the city of Beaumont or that may be hereafter issued for the purpose of permanent improvements of any kind, or other public purposes authorized by law of the City Charter and said city is hereby authorised to issue bonds for said pugoses when voted in compliance with the constitution and laws of the State of Texas, and .Amendments thereof, such bods to bear a rate o.f interest not to exceed six per cent per annum, and to be sold at not less than par. The City Treasurer shall keep the interest and sinking fund separately avid shall honor no drafts on said sinking fund except to'rdddem such bonds or to purchase interest bearing bonds of the United States, the State of Texas, any county bonds or bonds of the City of Beaumont or any navigation, drainage irrigation, road or school district bonds of any district in Jefferson County, Texas,. #10- __-- - - ()R/D, /DJ 5.' For the purpose of.purchasing or otherwise acquir- ing constructing, maintaining, operating and owning.a water works system or electric lgght sysbeam or gas s em or ubl c parks or wharves, docks' warehouses, elevators ta� d er nal railways and su .n other 'improvements e, and appurtenances as may be needed or necessary for the operation and maintenance thereof either inside or oul,side of the city limits, to be owned and controlled by the City of Beaumont, or any one or more of such purposes. 6. The City of Beaumont may also levy, assess and collect from each male citizen of the city, subject to such by the State Law, over the age of twanty-one(21) and under the age of sixty(60) years, an annual poll tag -not to exceed one dollar (.1.00) 7. Amend Section bl of the Charter of the City of Beaumont, ,qo that it shall hereafter read as follows: "Section 51." z " There shall be a board of eq.Valization,. composed of three resident frd6-holders of the city of Beaumont, who shall be appointed by the mayor and confirmed by the city council after --*=b election in the said city, eaoh' of whom shell take the oath of office prescribed by the Constitution of the State of Texas, who shall hold their office for the term of two years from their appointment and qual- ification. They shall receive such compensation as may allowed by the ,city council. Said board shall have the power and it shall be the duty of said board to ascertain the fair merket value of all property, reel and personal subject to taxation within the'c}ty of Beaumont, and shall have the power, with the sanction of the city council, to employ the necessary help an aid to carry out said purpose. When the said board of egyalization shall have ascertained the fair market valuta of all property, real and personal, subject to taxation within the city of Beaumont, it shall report samAt o the city council and.the city council shall then instruct the board. of egnaliSation the per cent of said values to be used in arriving at the taxable values. The Board of equalilation shall then place a taxable value on all property, subject -to taxation with- in the city of Beaumont, and in the exercise of this power it may raise or lower the valuations at which property has�een assessed and rendered for taxes. The City Council shall by ordinance fix the time of meeting and prescribe the rules to govern the said board of.egm alization and -the, trial of all'appeals there:f'rom."', SECTION XII. ELEVER TH Amend Section 54 of the Charter of the City df Beaumont so that it shall hereafter.read as follows: " Section 54 " "'All taxes due the city of Beaumont shall be payable at the office of the city assessor and collector and may be paid at any time after the tag rolls of.the year have been completed and approved and no demand shall be required to be made upon any tax payer whose duty shall be to attend at'the collector's office and to pay the same as adoresaid• All taxes levied and not collected , and all taxes hereinafter to be levied, shall be paid by the 31st day of January of the X ar ;succeeding thelevy, and when not paid by.March lst, shall thereafter bear interest at the rate of six per cent per annum from March let, and in addition the city council may provide by ordinance that there shall be collected an additioial ten per centum upon the amount of such taxes as a' penalty against the person, firm or coriporation failing, neglecting or refusing to pay such taxes by January 31st, which penalty shall be collected by seizure and sale of the property of the delinquent, or by suit, the same as herein provided for the collection of taxes." The City Council shall by ordinance fig the time of meeting and prescribe the rules to govern the said board of equalization and the. trial of all appeals therefrom -"`4 SECTION XII. Amend section 68 of the Charter of the City of Beaumont so that it shall hereafter read as follows: " Section 6811 " Suits for the collection of taxes due the city shall 7 instituted within 6 years from the time same become due and payable, other- wise, same shall be barred, provided this defense must be specially plead. This applies only to taxes due aftQr the anactment of this amendment. No irregularity in the time or manner of making the annual levy of taxes, heretofore levied by the city council of said city, and which are unpaid, shall invd-idate the taxes, but they are hereby continued in force qnd maybe collected by seizure and sale of property of the person owning the same, or by suit, as herein provided." THU.TEENTH : SECTION XIV. Amend Section 75 of the Charter of the City of Beaamont, so that it shall hereafter read as follows: " Section 75" " Any appointive officer of the city, may be dismissed or discharged from his office or position at any time by the city council for any reason that said council may dean sufficient; provided that a majority of the members of the city council shall vote for said dismissal or discharge. FOURT- ENTH : SECT' ON XYo Amend Section 94 of the Charter of the City of Beaumont so'that it shall hereafter read as follows: " Section 94 " " The City Council shall between the 1st and 31st days of December of the year preceeding the regular election of officers of the city, heretofore enumerated, pass an ordinance fixing the salaries and fees of all elective officers of the city to be 7' elected at said election and said salaries and fees of Via' officers k shall not be lowered, during the period^said officers are elected- heretofore levied by the city council of said city, and which arra unpaid, shall invalidate the taxes, but they are hereby continued in force 4nd maybe collected by seizure and sale of property of the person owning the same, or by suit, as herein provided®" THIRTEENTH- THIRTEENTH SECTION XIV- IV. Amend Amend Section 75 of the.
