Entitled an Ordinance amending article 336,
Chapter 26 of the Revised Code of Ordinances,
and declaring an emergency.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF I3E.AMMNT
Section One.
That Art -336, Chapter 26, of the Revised Code of
Or d.inance s of the City of Beaumont, be amended and added
to so that it shall hereafter read as follows.' -
Art -336 --The Chief of the Fire Department and Assistant
Chief shall be elected by a majority vote of the City
Council, on n6mination by the Mayor, the f irst election
to take place as provided by Sec -8, of the Charter, -and
such officers and -those now holding said offices shall
serve until their successors are chosen and qualified,,
unless sooner removed for cause by vote of two-thirds of
all;, th.e al -de rme hr: e 3 e dt e d .
The Chief of tYe Fire Department and the Assistant
Chief shall be liable to be removed from office or
suspended dor a designated period during their term of
service by a sustained impeachment before the City
Counci, two-thirds of all the al dor men elected voting
to sustain the charge. They may be .impeached for "
incompetency, habitual neglect of duty, or bribery.
All charges against the Chief of the Fire Department or
the Assistant Chief must be made in writing and presented.
to the Fire Committee of the council, and due notice
given to the accused.
Before entering upon the duties of their respective
offices, the Chief of the Fire Department and the
Assistant Chief shall make the following oath before
the I,Iayor : "I, .......... , do dolemnly swear that I will
faithfully observe the laws of the Stc:te of Texas and-
the
ndthe ordinances of the City of Beaumont, and to the
best of my ability perform the duties of my office."
If a vacancy occurs in any of the offices, it shall
be the duty of the I,Iayor to nominate . a suitable person
for confirmation as in the mannei aforementioned, to
fill such vacancy or vacancies within.such time as he
may deem .desirable of ter such vacancy may occur.
All persons at a fire shall give aid in suppressing
it when called upon to d.o so by the Mayor, Chief of
Police, or any officer of the department; and any one
refusing or neglecting to.. render such .assistance shall,
upon conviction thereof before the recorder, be fined
not more than Twenty-five Dollars.
To prevent the spread. of fire, the Fire Chief may
order any building or fence to be blown up or otherwise

The Assistant Chief shall convey the orders of
the Chief to the officers of the different companies,
and aid in the execution of them, and perform all other
duties which he may require of him; and in the absence
of the Fire Chief, the Assistant shall have the authority
and perform the duties of Fire Chief.
It shall be the duty of the Fire Chief, to visit
and inspect buildings in process of construction:ithin
the 'corporate limits of the city. IIe shall thoroughly
inspect and report to the Mayor the cause and origin
of all fires acenring within the corporate lilits of
the city.

He shall be regp.ired, and for this purpose is hereby
suthorized,to visit and enter all buildings within the.
cox-porate lirlits of the City of Beaumont to ascertain
thearangement and condition of the flues, stove pipes
and apparatus for heating used in said buildings. He
shall, at the request of any citizen occupying any
house within the corporate limits of the cit;-, visit
and inspect their flues, chimneys, stove pipes and
other apparatus for heating used in said building, and
recommend such alterations as he may deem necessary.
The _Chief of the Fire Department shall pay all
expenses for gasoline andtires for the City's
automobile which he usesl.and he shall give so much
of his time to look after the fire Department of the
City ofBeaumont, and to abide by the Ordinances .of
the City, relative to the fire department, as is or
may be requisite and necessary for the proper conduct
of the Fire Der'artment of the 'City of Beaumont.
Section two
All Ordinances or parts of ordinances in con-
flict herewith are hereby repealed.
Section Three
Owing to the fact that it is necessary to
provide immediately for the duties of the Fire Chief on the
basis of the duties required during the ensuing tw:> years,
an emergency and public necessity is created, demanding that
the rule requiring. ord-7,nances to be. read at thrae separate
meetings b,C and the same is hereby suspended, and this
ordinance shall go into effect from end after its passage
and lawful 1>ublication.
