AN , ORDINANCE
Entitled an ordinance creating.a Board of
Dock -and IWharf Commis.sioner's for the City of Beaumont;
providing for their appointment and terms of office;
prescribing qualifications of the members; defining
the rights, powers and duties of such board and declar-
ing an emergency:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
BEAMIONT:
SECTION 1.
There is hereby created a Boaxd of Dock and
Whaxf Commissi one -s -,-=for- the City„ of Beaumont with
exclusive jurisdi tion ii1a-f e control, management, and f�
maintenance of wharfs and wharf terminals of the city
of Beaumont .
MOTION II.
The members of the -Board of Dock andfharf
Commissioners shall be appointed by the M-�Iox, subject

to confirmation by the City Council.,;Any.person appoint-
ed and confirmed as a raember of said Board of Dock and
Iharf Commissioners shall within fifteen (15) days
thereafter file with the City Secretary his written,
acceptance'of such appointment and if samA is not done,
the appointment shall be held null and- joid and the

Mayor shall appoint someone else whose nomination
shall be confirmed by the City Council.
No person shall be appointed a member of said
Board of Dock and Wharf Commissioners--X0ioeif
is hot a
resident citizen and a qualifiedrote� the City
of Beaumont. The members of said Board shall serve
without compensation.
SECTION III.
The Mayor of the City of Beaumont shall not
later than the first regular meeting of the City Council
following the meeting at which this ordinance is adopt-
ed, appoint the members of said Board of Dock and
Wharf Commissioners.
Those appointed and confirmed by the City
Council shall hold their office until the first Tuesday
in May 1914 and until their successors shall qualify;
and should a vacancy occur in said Board it shall be
filled, as provided in Section 2 of this ordinance,- for ,
the remainder of the term of office, that is, until the
first Tuesday in May 1914. On the first Tuesday in
May 1914, the Mayor shall appoint five nitizens with
qualifications above set forth, as Dock and Vjharf Com"
missioners , three of whom shall hold office until the
first Tuesday in May 1915 and two of whom shall hold
office until the first Tuesday in May 1916• Said
Dock and Wharf Commissioners to determine by lot at
the first regular .meeting after their appointment, the

shall be confirmed by the City Council.
No person shall be appointed a member of said
Board of Dock and Wharf Commissionet„,�p-io is not a

resident citizen and a qualified oter the City
of Beaumont. The members of said Board shall serve
without compensation.
SECTION III.
The Mayor of the City of Beaumont shall not
later than the first regular meeting of the City Council
following the meeting at which this ordinance is adopt—
ed, appoint the members of said Board of Dock and
Wharf Commissioners.
Those appointed and confirmed by the City

in May 1914 and until their successors shall qualify;
and should a vacancy occur in said Board it shall be
filled; as provided in Section 2 of this ordinance,- for ,
the remainder of the term of office, that is, until the
first Tuesday in May 1914. On the first Tuesday. in
May 1914, the Mayor shall appoint five aitizens with
qualifications above set forth, as Dock and 0harf Com-
missioners , three of whom shall hold office until the
first Tuesday in May 1915 and two of whom shall hold
office until the first Tuesday in May 1916. Said
Dock and Wharf Commissioners to determine by lot at
the first regular .meeting after their appointment, the
term for which each shall serve. On the first Tuesday
in P.4ay 1915 and annually thereafter from said date; there
shall be appointed members of said Board of Dock and Wharf
Commissioners to fill the vacancies occurring in said
Board, who shall hold office for two years or until
their successors shall,qualify and.when any vacancy
occurs on said Board same shall be filled by appoint-

ment�as provided in Section 11 for the unexpired term .
SECTION IV:
The Board of Dock and Whsxf Commissioners shall
appoint from among their
number one
who
shall be
de-
signated as President of
said Board
and
one who
shall
be designated as Vice -President of said Board.
The President of said Board shall preside at
all meetings and shall have a vote on all questions
before .saidBoard. In the absence of the President;
the Vice -President shall preside and have the same
authority as the .President.
The Board shall adopt their own by laws and
rules governing the conduct of their members and the
dispatch of business at their meetings subject to the
terms of this ordinance.
SECTION V.
The Board of Dock and Wharf Commissioners shall
hold regular meetings at leas' once in each month, in
the Council Chamber of the City Hall and such other
meetings as may be necessary for the transaction of
business provided that the Board shall adopt a by law

occurs on said Board same shall be filled by appoint -

SECTION IV.
The Board of Dock and Wharf Commissioners shall
appoint from among their

SECTION VI.
The City Secretary of the City of Beaumont shall
be secreatry of said Board and shall -serve without com-
pensation. Such Secretary shall keep a full record of
all proceedings of said Board. The Secretary shall car-
tify such proceedings under his hand and to be authenti-
cated by a seal , if a seal Fie adopted and provided by
said Board for that purpose, and shall perform all other
such duties as the Board may prescribe. .
SECTION VII.
Thd City Engineer of the City of Beaumont shall
be Engineer to the Board of Dock and Wharf Commissioners.
He shall perform such efigineering and surveying necessary 1
for the public work done under the direction and super.;..
vision of the Board of said Dodk and Wharf. Commissoners
as said Board may require.
SECTION VIII.
The Board of Dock and Wharf Commissioners shall
have authority and the right -to employ all necessary
help to look after the wharfs and wharf terminals of
the .City of Beaumont; shall have the right to employ ,
discharge, suspend or remove from office any employee
and prescribe rules and regulations governing their
employment
SECTION IX.

The City Secretary of the City of Beaumont shall

SECTION IX.
The Board of Dock and 1%arf Commissioners
shall from time to time recommend to the City Council,
rates to be charged for wharfage; dockage, tolls and

cranage of all steamships, vessels and other water
craft admitted to the wharfs, piers, docks, slips, quays,
and landings owned, operated and controlled by the
City or leased by' the City to private individuals or
corporations and also the rates or charges for the
use of all warehouses, elevators, bunkers; marine ways,
dry docks and other structures, derricks, cranes and
other appliances owned, controlled or operated by the
City and constructed or used for the loading and un-
loading of,cargoes, steamships, vessels, and other
water craft and for the storage thereof and for the
use of appliances for taking on or discharging all
passengers by or from such steamship, vessels or other
water craft.
SECTION X.
All monies received or collected -from or
arising out of the use or operation of any and, all
railroads, wharfs , piers, docks, slips, moles, ways,
dry docks, quays, landings, elevators , cranes, ware-
houses ferrys, steamships, vessels and other water
craft, tugs boats, and all other appliances or utilities
owned, operated or controlled 'by the City of .Beaumont al
and all rates or other charges for rights, privileges
or franchises granted for the use of water frontage,
tide lands or submerged lands96,1.1 *rents,c for leases
of such lands, wharfs, docks or portions thereofhall
be collected under the direction of the said Dock and
craft admitted to the wharfs, piers;" docks, slips, quays,
and landings owned, operated and controlled by the
City or leased by the City to iivate individuals or
corporations and also the rates or charges for the
use of all warehouses, elevators, bunkers, marine ways,
dry docks and other structures, derricks, cranes and
other appliances owned, controlled or operated by the
City and constructed or used for the loading and un-
loading of,;cargoes, steamships, vessels, and other
water craft and for the storage thereof and for the
use of appliances for taking on or discharging all
passengers by or from such steamship, vessdls or other
water craft.
SECTION X.

All monies received or collected, from or
arising out of the use or operation of any andall
f railroads, wharfs , piers; docks, slips, moles, ways,
dry _docks, quays, landings, elevators , cranes, ware --
houses , ferrys; steamships, vessels and other water
craft, tugs boats, and all other appliances or utilities
owned, operated or controlled by the City of .Beaumont al
and all rates or other charges for rights, privileges
or franchises granted fox the use of water frontage,
tide lands or submerged lands9 6,1.1'rents,_ for leases
of such lands, wharfs, docks or portions thereof -'shall
be collected under the direction -of the said Dock and
Wharf Commissioners, and shall be deposited in the City

Treasuryto the credit of a fund to bd known as
" Harbor Rovenue Fund " and same shall be kept separate
and apart frame other monies of the City. Ironies
shall only be drawn from said Fund in pursuance of an
appropriation by the Board of Dock and Wharf Commission-
ers and upon vouchers signed by the Presicbnt, or acting
President of said Board and its Secretary.
SECTION XI.
The monies collected and pain in the said
Harbor Revenue Fund shall not be appropriated or used
for any purpose or purposes other than the following,
to -wit;
First: For the, necessary expense of conducting
the Board of Dock and Vharf Commissioners and operat-
ing any and allre4i.lroads, wharfs, piers,. docks, slips,
quays, moles, landings, warehouses and other utilities ,
zteamships, ferry boa4s, pilot boats, tug boats and other
vessels and other water craft, belonging to the City and
;other works, appliances and utilities ownedi operated
or controlled by the City and pertaining to its wharfs
and wharf terminals
Becond: For the acquisition, construction; com-
Pletion or maintenance of sea walls, embankments, bulk-
heads, wharfs, ferries, docks, slips, quays, moles, landings
warehouses, and other structures, steamships, ferry boats,
pilot boats, tugkboats and other vessels and other water
craft and other appliances and utilities pertaining to
the crater front, and for extraordinary improvements or

appropriation by the Board of Dock and Wharf Commission-
ers and upon vouchers signed by the Presicbnt, or acting

heads. wharfs, ferries, docks, slips, quays, moles, landings
warehouses, and other structures, steamships, ferry boats,
pilot boats, tugIEboats and other vessels and other water
craft and other appliances and utilities pertaining to
the nater front r and for extraordinary improvements or
betterments to the property under the management and
control of said Board of Dock and Wharf Commissioners,
including also the purchase of necessary lands and other
pr opei ty.
Thixd: The payment of the interest and
principal coming, due on any bonds issued fox the building
of wharfs and wharf terminals.
SECTION XII.
Said Board shall submit to the City Council
on the last day of February of each year. thereafter ,
and on the first day of the following September
of each year, a written report containing an itemized
statement of all revenues collected and paid into the
pity Treasury from any source whatsoever during the last
preceding six months, together with a statement of all
disbursements eluting said period, and the purpose and
character thereof] Said statement to be a complete
digest of all the acts of said Board during the last
preceding six months.
SECTION XIII.
Whereas the improvements now being made on the
Neches River and the Neches -Sabine Canal will soon be
finished, and whereas it is necessary that the City of
Beaumont make arrangements to take care of the water -
traffic, creates an emergency and public necessity and
the rulL requiring ordinances to be read at three separate
meetings is hereby suspended and this ordinance shall go
into force and effect from -and after its pasda�e and lawful
including also the purchase of necessary lands and other
px operty:
