ENTITLED AN ORDINANCE AUTHORIZING THE PROPER
OFFICIALS OF THE CITY OF BEAUMONT TO EXECUTE
AND DELIVER FOR AND ON BEHALF OF THE CITY OF
BEAUMONT A DEED WITHOUT WARRANTY EITHER
EXPRESS OR IMPLIED TO THE PORT OF BEAUMONT
NAVIGATION DISTRICT OF JEFFERSON COUNTY, TEXAS,
CONVEYING FIVE TRACTS OF LAND IN THE ORIGINAL
BEAUMONT TOWNSITE, JEFFERSON COUNTY, TEXAS,
MORE PARTICULARLY DESCRIBED HEREIN.
WHEREAS, on the 5th day of February, 1969, The City
of Beaumont entered into a contract with Southern Pacific
Company, The Kansas City Southern Railway Company, Missouri
Pacific Railroad Company, The Atchison Topeka and Santa Fe
Railway Company, and The Port of Beaumont Navigation District
of Jefferson County, Texas, said agreement being referred to
as the Port Exchange Yard Agreement; and,
WHEREAS, pursuant to said agreement and in order that
said agreement may be fulfilled, the City of Beaumont deems it
necessary and in the best interest of the City to convey the
hereinafter described property to the Port of Beaumont Navi-
gation District of Jefferson County, Texas;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS:
That the Mayor be, and he is hereby, authorized to execute and
deliver for and on behalf of The City of Beaumont a deed without
warranty express or implied conveying to the Port of Beaumont
Navigation District of Jefferson County, Texas, the following
described tracts of land,to wit:
FIRST TRACT:
All that certain tract or parcel of land in
The City of Beaumont, Jefferson County, Texas,
and being out of Lots 600, 601, 602, 603, 605,
606, 607 and 608, Block 24 of the Beaumont
Townsite, a plat of which is recorded in Vol-
ume 448, Page 249 of the Deed Records of said
FOR a locative point, an iron rod at the
intersection of the east line of Cypress Street
with the south line of Mulberry Street, said
iron rod also being the most northwesterly
corner of Lot 603 of said Block 24;
THENCE North 88058'50" East along the south
line of Mulberry Street a distance of 33.66 feet
to a point and the place of beginning;
THENCE continuing North 88058'50" East along
the south line of Mulberry Street a distance of
106.34 feet to a point;
THENCE South 17022'10" East a distance of
69.10 feet to a point;
THENCE deflecting to the right along the
arc of a 394.98 foot radius curve, 186.32 feet
to a point (chord of said curve bears South
18046'27" West 184.60 feet);
THENCE South 88058'50" West along the south
line of Lot 600 of said Block 24 a distance of
50.64 feet to a point;
THENCE North 06044'43" West a distance of
94.14 feet to a point;
THENCE deflecting to the right along the arc
of a 811.52 foot radius curve, 90.10 feet to a
point (chord of said curve bears North 03031'02"
West 90.05 feet);
THENCE North 0020'10" West a distance of
56.38' to a point and the place of beginning,
containing 24,700 square feet or 0.5670 acres
of land, more or less.
SECOND TRACT:
All that certain tract or parcel of land in
The City of Beaumont, Jefferson County, Texas,
and being out of Lots 605 and 606, Block 24 of
the Beaumont Townsite, a plat of which is recorded
in Volume 448, Page 249 of the Deed Records of
said County, and being more particularly described
as follows:
FOR a locative point, an iron rod at the
intersection of the east line of Cypress Street
and the south line of Mulberry Street, said iron
rod also being the most northwesterly corner of
Lot 603 of said Block 24;
THENCE North 88058'50" East along the south
line of Mulberry Street a distance of 140.00 feet
to a point;
THENCE South 17022'10" East a distance of
128.89 feet to a point and the place of beginning;
THENCE deflecting to the right along the arc
THENCE North 88058'50" East along the south
line of Lot 605 of said Block 24 a distance of
82.16 feet to a point;
THENCE North 17022'10" West a distance of
121.23 feet to a point and the place of beginning
containing 4,382 square feet or 0.1006 acres of
land, more or less.
The above -two tracts being further identified as
being Tract C-5 as set out in Exhibit "A" to Port
Exchange Yard Agreement dated February 5, 1969.
THIRD TRACT:
All that certain tract or parcel of land in
The City of Beaumont, Jefferson County, Texas,
and being out of Lot 599, Block 24 of the
Beaumont Townsite, a plat of which is recorded
in Volume 448, Page 249 of the Deed Records of
said County, and being more particularly des-
cribed as follows:
FOR a locative point, a nail at the inter-
section of the east line of Cypress Street and
the north line of Tevis Street, said nail also
being the most southwesterly corner of Lot 599
of said Block 24;
THENCE North 88058'50" East along the north
line of Tevis Street a distance of -52.32 feet
to an iron rod and the place of beginning;
THENCE continuing North 88058'50" East along
the north line of Tevis Street a distance -of
67.68 feet to a point, said point being the most
southeasterly corner of Lot 599 of said Block 24;
THENCE, North 01001'10" West along the east
line of Lot 599 a distance of 60.00 feet to a
point, said point being the most northeasterly
corner of said Lot 599;
THENCE South 88058'50" West along the north
line of said Lot 599 a distance of 73.75 feet
to a point;
THENCE South 06044'43" East a distance of
60.30 feet to the place of beginning, con-
taining 4,241 square feet or 0.0974 acres of
land, more or less.
FOURTH TRACT:
All that certain tract or parcel of land in
The City of Beaumont, Jefferson County, Texas,
and being out of Lots 591, 592, 593, 594, 595,
596, 597, 598 and 736, Block 23 of the Beaumont
Townsite, a plat of which is recorded in Volume
448, Page 249 of the Deed Records of said County,
and being a part of that tract of land conveyed
to W. D. Smith and Charles Meador by deed re-
corded in Volume 1291, Page 15, of the Deed Records

FOR a locative point, a railroad spike in a
one inch diameter iron pipe found at the inter-
section of the east line of Cypress Street with
the south line of the Southern Pacific Company
right-of-way;
THENCE North 71032120" East with the south line
of the Southern Pacific Company right-of-way a
distance of 63.66 feet to an iron rod and the place
of beginning;
THENCE South 06044'43" East a distance of 102.04
feet to a point;
THENCE deflecting to the left along the arc of
a 450.87 foot radius curve, 56.02 feet to an iron
rod for a point (chord of said curve bears South
10005'01" East 55.98 feet);
THENCE North 88058'50" East a distance of 181.17
feet to a point;
THENCE North 01001'10" West a distance of 2.06
feet to a point at the west bank of the Neches
River;
THENCE with the meanders of

Tract C-7 as set out in Exhibit "A" to Port Ex-
change Yard Agreement dated February 5, 1969.
FIFTH TRACT:
All that certain tract or parcel of land in The
City of Beaumont, Jefferson County, Texas, and
being out of Lots 589, 590, 594, 595, 596, 597, 736 and
737 of Block 23 of the Beaumont Townsite, a plat
of which is recorded in Volume 448, Page 249 of the
Deed Records of said County, and being a part of
that tract of land conveyed to Charles P. Ryan,
Wolfe Duberstein and Mitchel Duberstein by deed
recorded in Volume 1152, Page 93, of the Deed Re-
cords of Jefferson County, Texas, said tract of
land being more particularly described as follows:
FOR a locative point, an iron rod set at the
intersection of the east line of Cypress Street
with the north line of Hickory Street, said point

to an iron rod and the place of beginning;
THENCE continuing North 8805850" East along the
north line of Hickory Street a distance of 286.10
feet to a point in the Neches River, said point also
being the most easterly corner of Lot 737 of said
Block 23;
THENCE North 30050'47" West a distance of 294.54
feet to a point in the Neches River;
THENCE South 20035'17" West a distance of
12.50 feet to a point in the Neches River;
THENCE South 01001'10" East a distance of
121.84 feet to a point at the west bank of the
Neches River;
THENCE continuing South 01001'10" East a dis-
tance of 2.06 feet to a point;
THENCE South 88058'50" West a distance of
181.17 feet to an iron rod for a point;
THENCE deflecting to the left along the arc of
a 450.87 foot radius curve, 129.01 feet to an iron
rod and the place of beginning (chord of said
curve bears South 22003'47" East 128.57 feet) con-
taining 39,231 square .feet or 0.9006 acres of land,
more or less.
The above tract being further identified as being
Tract C-8 as set out in Exhibit "A." to Port Ex-
change Yard Agreement dated February 5, 1969.
and the City Clerk is hereby authorized to attest to said instru-
ment and to affix the Seal of The City of Beaumont thereto.
