ENTITLED AN ORDINANCE AMENDING CHAPTER 42 OF
THE CODE OF. ORDINANCES OF BEAUMONT, TEXAS, AND
IN PARTICULAR THE BOUNDARIES OF THE ZONING
DISTRICTS AS INDICATED UPON THE ZONING MAP OF
THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, BY
CHANGING THE CLASSIFICATION OF A 19.093 ACRE
TRACT OF LAND IN THE F. BIGNER.SURVEY TO THE
CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS, AS
DESCRIBED HEREIN, PRESENTLY ZONED "R-1" AND
'' C-1" TO "C--1" ; ,. PROVIDING FOR SEVERABILITY;
AND PROVIDING A PENALTY.
BE IT ORDAINED'BY THE CITY OF BEAUMONT, TEXAS:
Section 1.
That Chapter 42 of the Code of.Ordinances of Beaumont,
Texas, and in particular the boundaries of the zoning districts
as indicated upon the Zoning Map of Tne City of Beaumont, re-
ferred to in Section 42-9 thereof, is hereby amended by chang-
ing the zoning classification of the following described
tract of land, presently zoned "R-1" Single -Family Dwelling
District and "C-1" Neighborhood Commercial District to "C-1"
Neighborhood Commercial District, to wit:
Being several adjoining tracts of land in the
Frederick Bigner Survey, Beaumont, Jefferson
County, Texas, and being more particularly
described as follows:
Being a 19.093 acre tract of land in the F.
Bigner Survey, Beaumont, Jefferson County,
Texas, more particularly described as follows:
BEGINNING at a point in the westerly right-of-
way line of the Eastex Freeway (U.S. Hwy. 69,
96 & 287), said point lying approximately 450
feet southeast of the southeast corner of the
intersection of the Eastex Freeway and Treadway
Road;
THENCE South 200 37' West 664.21 feet to a
point for corner;
THENCE South'340 42' East 85.1 feet to a
point for corner;
THENCE South 000 25.5' East 705.7 feet to a
point for cornet;
THENCE in a westerly direction along the north
property lines of tracts 139, 138, 137, 136,
and 135 out of Plat D-22, F. Bigner Survey
(City Tax Roll tract numbers) a calculated dis-
tance of 460 feet, more or less, to a point for
corner;
THENCE North 10 34' East 208.8 feet to a point
for corner.,
THENCE in a westerly direction a distance of
522 feet to a point for corner in a drainage
ditch, same being in the west line of the A.
Williams Survey;
THENCE along the aforesaid west line of the A.
Williams Survey and the east line of the F.
Bigner Survey, same being :in a drainage ditch,
North 10 34' East to a point for corner in the
westerly right-of-way line of the'Eastex Freeway;
THENCE in a northwesterly direction along the
westerly right-of-way line of the Eastex Freeway
a calculated distance of 1212 feet, more or less,
to the PLACE OF BEGINNING and including one-half
the widths of all bounding street rights-of-way.
and the official zoning map of The City of Beaumont is hereby
amended to reflect such changes.
Section 2.
That in all other respects the use of the property
hereinabove described shall be subject to all of the applicable
regulations contained in Chapter 42 of the Code of Ordinances
of Beaumont, Texas, adopted August 19, 1958, effective October
19, 1958, as amended.
Section 3.
That the terms and provisions of this ordinance shall
be deemed to be severable, and that if the validity of the
zoning affecting any portion of the property described here-
inabove shall be declared to be invalid, the same shall not
affect the validity of the zoning of the balance of the pro-
perty described herein.
Section 4.
That any person or corporation violating any of the
terms and provisions of this ordinance shall be subject to
the same penalties provided for in the said Chapter 42 of the
Code of Ordinances of Beaumont, Texas.
