ENTITLED AN ORDINANCE ORDERING A SPECIAL
ELECTION TO BE HELD IN THE CITY OF BEA.UMONT,
TEXAS. ON THE /-1_'-DAY OF V d1 !� 1969,
TO DETERMINE WHETHER DALE C.' HAGER SHALL E
REMOVED FROM THE OFFICE OF CITY COUNCILMAN OF
THE CITY OF BEAUMONT BY RECALL; NAMING THE
PLACES WHERE SAID ELECTION SHALL BE HELD AND
APPOINTING JUDGES AND ALTERNATES TO PRESIDE
OVER SAID ELECTION;.PROVIDING FOR THE FORM OF
NOTICE THEREOF; PROVIDING FOR THE FORM OF
BALLOT FOR USE IN SAID ELECTION; AND PROVIDING
THE MANNER OF HOLDING SAID ELECTION.
WHEREAS, on August 1, 1969, recall petition blanks
were obtained from the City Clerk of The City of Beaumont by
three electors of The City of Beaumont; and,
WHEREAS, on August 28, 1969, a recall petition was
filed with the City Clerk of The City of Beaumont, Texas,
seeking the recall of Dale C. Hager; and,
WHEREAS, in accordance with Article XI, Section 15 of
the City Charter, the City Clerk on the 2nd day of September,
1969, certified that said recall petition was sufficient and
contained the signatures of qualified electors representing
at least 30% of the total number of votes cast in the last gen-
eral municipal election; and,
WHEREAS, Article XI of the City Charter of The City
of Beaumont, Texas, provides that if recall petition blanks
are checked out from the City Clerk of The City of Beaumont and
are turned in or filed within 30 days of the check out date,
and if said petitions are signed by qualified electors of the
City equal in number of at least 30% of the total number of
votes cast at -the last general -municipal election and if the
City Clerk: checks said petition and finds it sufficient and
certifies the sufficiency to the City Council, and if the per-
son sought to be recalled does not resign within 5 days, the
City Council shall order and fix a. date for holding a recall
election not less than 30 days or more than 60 days after the

petition has been presented to the City Council. The Charter
further provides that if no municipal election will be held
within such time period the City Council shall call a special
election.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
OF BEAUMONT, TEXAS:
Section 1.
That in accordance with the provisions of the laws
of the State of Texas and Article XI of the City Charter of
The City of Beaumont, Texas, a special election within the
corporate limits of The City of Beaumont is hereby ordered to
be held on the "t day ofAluyEmbiEr , 1969, to
determine whether Dale C. Hager shall be removed from the office
of City Councilman of The City of Beaumont by recall.
Section 2.
Legally qualified voters residing within the corporate
limits of The City of Beaumont shall be entitled to vote at
said election.
Section 3.
That said election shall be held in The City of
Beaumont at the following places and the following named persons
are appointed.presiding judges and alternates for their re-
spective voting boxes, with the authority to select and appoint
their own clerks, to wit:
Precinct No. 1 - Edwards Elementary School, 4401 Detroit,
Mrs. C. C. Moore (Rastas C. Bowers, Alternate)
Precinct No. 2 - French High School, 4415 Concord Road,
Mrs. F. W. Forsythe (Mrs. Wm. Ehrensberger,
Alternate)
Precinct No. 3 - School for the Deaf, 1800 Tulane, Mrs. 0.

Section 4.
The mayor is hereby directed to cause the notice of
election hereinafter prescribed, together with a copy of'this
ordinance, signed by himself and attested by the city clerk,
to be posted at each of the places herein designated for
holding said election, at least twenty (20) days prior to the
date of holding said election. In addition, notice of this
election shall be published at least one time, not more than
twenty-five (25) days or less than ten (10) days before the
election, in the Beaumont Journal, a daily newspaper of general
circulation in The City of Beaumont, Texas. The notice of
election shall be as follows:

BEAUMONT, TEXAS, TO DETERMINE WHETHER DALE
C. HAGER SHALL BE REMOVED FROM THE OFFICE
OF CITY COUNCILMAN OF THE CITY OF BEAUMONT
BY RECALL.
"Notice is hereby given that a special elec-
tion will be held in The City of Beaumont,
Texas, on the j it day of Noye,gb�� ,
1969, from 77-D-0a.m. to 7:00 p.m. to deter-
mine whether Dale C. Hager shall be removed
from the office of City Councilman of The
City of Beaumont by recall, all as is more
particularly set forth in the copy of the
election ordinance passed by the City Council
and attached hereto."
Section 5.
In accordance with Article XI of the City Charter
of The City of Beaumont, Texas, the form of ballot which shall
be used in said special election shall be as follows:
"Shall Dale C. Hager be removed from the
office of City Councilman by recall?"

"FOR the recall of Dale C. Hager.
"'AGAINST the recall of Dale C. Hager."
Section 6.
That said election shall be held under and controlled
by the provisions of the state laws governing elections.
Section 7.
That in accordance with the provisions of the laws
of the State of Texas, voting machines shall be used for voting
on the day of election and also.for the casting of absentee
votes by personal appearance at the City Clerk's office. In
accordance with the provisions of the laws of the State of
Texas, absentee votes by mail shall be counted by a special
canvassing board which shall be composed of Hardy D. Akin,
Dr. Charles Walker, and Roy Gibbs. Hardy D. Akin is hereby
appointed Presiding Judge of said Special Canvassing Board
and Dr. Charles Walker and Roy Gibbs are hereby appointed Clerks.
