ORDINANCE NO.
ENTITLED AN ORDINANCE AMENDING CHAPTER 4 OF THE
CODE OF ORDINANCES OF BEAUMONT, TEXAS, BY RE-
PEALING CHAPTER 4, AND ENACTING IN LIEU. THEREOF
A NEW CHAPTER 4 REGULATING AMBULANCES, DEFINING
TERMS, REQUIRING PERMITS, REQUIRING APPLICATIONS
FOR PERMITS AND SPECIFYING THE PROCEDURE THEREFOR,
SPECIFYING CONDITIONS FOR ISSUANCE AND REVOCATION
OF PERMITS, REQUIRING CERTAIN EQUIPMENT, REQUIRING
DRIVER'S LICENSES, REQUIRING APPLICATIONS FOR
LICENSES AND SPECIFYING THE PROCEDURE THEREFOR,
SPECIFYING CONDITIONS FOR ISSUANCES AND REVOCATION
OF DRIVERS' LICENSES; PROVIDING A PENALTY; PROVIDING
FOR SEVERABILITY; AND REPEALING ALL ORDINANCES OR
PARTS OF ORDINANCES IN CONFLICT HEREWITH.
BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS:

That Chapter 4 of the Code of Ordinances of Beaumont, Texas, be and
the same is hereby repealed, and in lieu thereof the following is enacted; to wit:
Chapter 4
REGULATION OF AMBULANCES
Sec. 4-1. Definitions.
1. Street. By the term "street" is meant the entire width between the
boundary lines of every way publicly maintained when any part thereof is open to
the use of the public for purposes of vehicular travel.
2. Ambulance. Any vehicle used, designed or redesigned for the purpose
of transporting the sick or injured.
3.' Ambulance Permit. The permit issued under Sec. 4-3 of this Chapter.
Sec. 4-2. Operating Ambulance Without Permit.
No person shall drive or operate an ambulance for the purpose of trans-
porting the sick or injured for hire upon the public ;streets of The City of Beaumont
unless there is attached to the windshield of such ambulance a valid Ambulance
Permit issued for such ambulance by the Health Director of the City of Beaumont.
Sec. 4-3. Ambulance Permit; Application.
Every person, partnership or corporation desiring to obtain an
ambulance permit for an ambulance shall make application in writing on a
form provided for that purpose to the Health Director of the City of Beaumont.
Such application shall contain the name, address and telephone number of the
applicant, the owner of the ambulance for which the permit is to be issued,
and the address and telephone number of the location from which ambulance
service will be originated. The application shall also show the make, model,
motor number, and correct state license number of the ambulance for which a
permit is being requested. Every application when filed shall be sworn to by
the applicant and shall be accompanied by a permit fee of One Dollar ($1. 00).
No permit shall be transferable and every permit shall expire on the 31st day
of December of the calendar year in which issued.
Sec. 4-4. Conditions for Issuance of Ambulance Permit.
No ambulance permit shall be issued:
(a) Insurance. Unless there is in full force and effect a policy or
policies of public liability and property damage insurance, issued by a casualty
insurance company authorized to do business in the State of Texas, and in the
standard form approved by the Board of Insurance Commissioners of the State
of Texas, with coverage provisions insuring the public from any loss or damage
that may arise to any person or property by reason of the operation of the
ambulance for which the permit is issued, and providing that the amount of
recovery shall be in limits not less than the following sums:
(1) For damages arising out of bodily injury to or death of one
person in any one accident, $100, 000. 00.
(2) For damages arising out of bodily injury to or death of two
or more persons in any one accident, $300, 000. 00.
(3) For any injury to or destruction of property in any one accident,
$25, 000. 00; and,
the Health Director of the City of Beaumont has been furnished with a current
insurance certificate certifying that such a policy as specified above is in full
force and effect.

(b) Taxes. If any delinquent taxes are due the City upon any ambulance
operated in the applicant's ambulance business.
(c) State Permit. Unless the applicant has been issued a permit by
the State Board of Health pursuant to Article 4590b of Vernon's Annotated Texas
Civil Statutes.
(d) Revocation of Prior Permit. If the applicant, an employer or any
employee of the applicant, or any person residentially domiciled with the appli-
cant, an employer or any employee of the applicant has had an ambulance permit
revoked within one year preceding the date of application.
(e) Radio. If a shortwave radio receiving device attuned to the radio
frequency of the police, department or the radio frequency of the fire department
is installed in such ambulance.
Sec. 4-5. Equipment.
Every ambulance for which an ambulance permit is issued shall be
equipped with the equipment required by the Rules and Regulations of the State
Board of Health which Rules and Regulations were promulgated pursuant to
Article 4590b of Vernon's Annotated Texas Civil Statutes and which Rules and
Regulations concerning equipment on ambulances are incorporated by reference
as if, set out in full at this point.
Sec. 4-6. Revocation of Ambulance Permit.
An ambulance permit may be revoked by the Health Director of the City
of Beaumont upon determination by him that:.
(a) The permit holder, an employer or any employee of the permit
holder has violated any provision of this chapter within sixty (60) days immediately
preceding the date of revocation.
(b) The permit holder or owner of the ambulance for which the permit
is issued is failing to comply and maintain such ambulance in compliance with
the requirements set forth in section 4-5 providing for certain equipment.

(c) The permit holder, an employer or any employee of the permit
holder has used information received from a broadcast on the shortwave
radio frequency of the police or fire departments for his own benefit, or the
benefit of another person in connection with the operation of an ambulance within
the sixty (60) days immediately preceding the date of revocation.
(d) The permit holder or owner of the ambulance for which the permit
is issued has, within sixty (60) days preceding the date of revocation allowed
the ambulance to be operated transporting the sick or injured for hire upon the
public streets of The City of Beaumont by one not having a valid City of Beaumont
ambulance driver's license.
(e) The permit holder, an employer or any employee of the permit holder
has originated ambulance service from any area in The City of Beaumont zoned
"R-1" or "R-2" as set out and defined in Chapter 42 of the Code of Ordinances of
The City of Beaumont, Texas.
Sec. 4-7. Ambulance Driver's License Required.
No person shall operate or drive an ambulance for the purpose of trans-
porting the sick or injured for hire upon the public streets of T:he City of Beau -
moat unless he has been issued a City of Beaumont Ambulance Driver's License
issued by the Health Director of The City of Beaumont.
Sec. 4-8. Application for Ambulance Driver's License.
Application for a City of Beaumont Ambulance Driver's License shall
be made in writing to the Health Director of the City of Beaumont on a form
provided for that purpose. Such application shall give the name, address, and
telephone number of the applicant. The applicant must be twenty-one (21) years
old, the holder of a valid Texas Chauffer's .License, the holder of a current Red
Cross Card certifying that the holder thereof has passed the advance Red Cross
First Aid Course and shall not have been convicted of a felony or of a misdeameanor
involving moral turpitude within the past ten (10) years. Such application must
be signed and sworn to before a Notary Public.

Sec. 4-9. Revocation of Ambulance Driver's License.
The Health Director of the City of Beaumont may revoke the ambulance
driver's license of any driver upon conviction for a violation of any provision
of this Chapter or upon conviction for a moving violation of the traffic laws of
the State of Texas, or its political subdivisions, provided such moving violation
occurs while the violator is driving or operating an ambulance, or the driver
no longer meets the requirements of Section 4-8 of this Chapter.
II.
That any person who violates any provision of this ordinance shall,
upon conviction, be punished as provided in Section 1-8 of the Code of Ordinances
of Beaumont, Texas.
That if any section, subsection, sentence, clause or phrase of this
ordinance or the application of same to a particular set of persons or circum-
stances should for any reason be held to be invalid, such invalidity shall in no
wise affect the remaining portions of this ordinance, and to such end the various
portions and provisions of this ordinance are declared to be severable.
IV.
That all ordinances and parts of ordinances in conflict herewith are
hereby repealed.
