ORDINANCE NO.
ENTITLED AN ORDINANCE AMENDING CHAPTER 42
OF THE CODE OF ORDINANCES OF BEAUMONT,
TEXAS, AND IN PARTICULAR THE BOUNDARIES OF
THE ZONING DISTRICTS AS INDICATED UPON THE
ZONING MAP OF THE CODE OF ORDINANCES OF
BEAUMONT, TEXAS, BY CHANGING THE CLASSIFI-
CATION OF A TRACT OF LAND 3.11 ACRES OF LAND
OUT OF THE FREDERICK BIGNER SURVEY, ABSTRACT
NO. 13 IN THE CITY OF BEAUMONT, JEFFERSON
COUNTY,, -TEXAS--, AS DESCRIBED HEREIN; -PRESENT-
LY ZONED "R-1" TO "C-111; PROVIDING FOR
SEVERABILITY; AND PROVIDING A PENALTY.
BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS:
Section 1.
That Chapter 42 of the Code of Ordinances of Beaumont,
Texas, and in particular the boundaries of the zoning districts
as indicated upon the Zoning Map of The City of Beaumont re-
ferred to in Section 42-9 thereof, is hereby amended by chang-
ing the zoning.classification of the following described tract
of land, presently zoned "R-1", Single Family Dwelling to "C-1",
Neighborhood Commercial, to -wit:
BEING.13-5.11 acres of land out of the Frederick
Bigner Survey, Abstract No. 1, Jefferson
County, Texas, being a portion of the First
Tract in deed dated February 13, 1933, from
Treadway Land Company to Yount -Lee Oil Com-
pany recorded in Volume 374,.page 113 of the
Deed Records of Jefferson County, Texas; said
3.11 acres more particularly described as
follows:
BEGINNING at a one.inch bronze rod set for the
most northerly northwest corner of a 137.816
acre tract of land described in surface deed
dated March,7, 1957, from Pan American -Petro-
leum Corporation to Jack S., Josey recorded in
Volume 1063, page 372 of the Deed Records of
the aforesaid county, said one inch rod also
being the north corner of that certain 30.00
_acre tract...of.land described in surface deed
dated June 145 1967, from Pari Americ"an Petro-
leum Corporation to Ben J: Rogers., Trustee,
recorded in Volume,1505; page 360 of.the
Deed Records of Jefferson County, Texas;
THENCE south 290 19 1/2' -west with.the north-
westerly line of said 30.00' -acre tract for a

distance of 1318.28 feet to its northwest
corner;
THENCE north 00 51 3/4' west with a north-
erly projection of the west line of said
30.00 acre tract a distance of 198.89 feet
to a point 100.00 feet.northwesterly, at
a right angle, from the northwesterly line
of said, tract;
THENCE north 290 19-l/2' east, -parallel to.
and 100.00 feet northwesterly, at a right
angle, from the northwesterly line of said
30.00 acre tract..a distance of.1274.03 feet
to an intersection with the 100 foot chord
of a 00 57' 34" curve in.the s-outhwesterly
right-of-way line of U. S. Hwys. 69,96 and
287, said curve having an external angle of
140 03' and a radius of 5971.22 feet;
THENCE south 550 01' 33" east with said
chord a distance of 0.33 feet to a point
on the arc of said curve;
THENCE south 550 59' 07" east with a chord
of said curve a distance of 100.00 feet to
a point on the are of said curve and which
point is on the northwesterly line of the
aforesaid 137.816 acres:tract;
THENCE south 290 19 1/2' west with said
northwesterly line a distance of 119.51 feet
to the PLACE OF BEGINNING and containing
3.11 acres of land and including half the
width of the abutting highway right-of-way.
and the official zoning map of The City of Beaumont is hereby
amended to reflect such changes.

That in all other respects the,use of the property
hereinabove described shall be subject to all of the applic-
able regulations contained in Chapter 42 of the Code of
Ordinances of Beaumont, Texas, adopted August 19, 1958,
effective October 195 1958, as amended.

That the terms and provisions of this ordinance -
shall be deemed to be severable, and that if the validity
of the zoning affecting any portion of the property des-
cribed hereinabove shall be declared to be invalid, the
same shall not affect the validity of the zoning of the
a
balance of the property described herein.
That any person or corporation violating any of
the terms and provisions of this ordinance shall be subject
to the same penalties provided for in the said Chapter 42
of the Code of Ordinances of Beaumont, Texas.
