ENTITLED AN ORDINANCE AMENDING CHAPTER 42 OF
THE CODE OF ORDINANCES OF BEAUMONT, TEXAS,
AND IN PARTICULAR THE BOUNDARIES OF THE ZON-
ING DISTRICTS AS INDICATED UPON THE ZONING
MAP OF THE CODE OF ORDINANCES OF BEAUMONT,
TEXAS, BY CHANGING THE CLASSIFICATION OF A
0.458 ACRE TRACT OF LAND IN THE ARLINGTON
ADDITION, BEAUMONT, JEFFERSON COUNTY, TEXAS,
AS DESCRIBED HEREIN PRESENTLY ZONED ITR -2f1
TO P1C-1"; AND BY CHANGING THE CLASSIFICATION
OF A 0.114 ACRE TRACT OF LAND IN THE ARLINGTON
ADDITION, BEAUMONT, JEFFERSON COUNTY., TEXAS,
AS DESCRIBED HEREIN PRESENTLY ZONED ITR -211 TO
"C-211; PROVIDING FOR SEVERABILITY; AND PRO-
VIDING A PENALTY.
WHEREAS, the City Council and the Planning and Zoning
Commission received verbal assurances from the applicant of this
amendment to the zoning ordinance that no structure or building
of a permanent nature would be erected on his property if the
zoning ordinance should be so amended; and,
WHEREAS, the Planning and Zoning Commission recommended
that the zoning ordinance be so amended on the condition that no
structure or building of a permanent nature be erected on the
property within the boundaries of this amendment to the zoning
ordinance;
TEXAS:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMONT,
Section 1.
That Chapter 42 of the Code of Ordinances of Beaumont,
Texas, and in particular the boundaries of the zoning districts
as indicated upon the Zoning Map of the City of Beaumont, re-
ferred to in Section 42-9 thereof, is hereby amended by changing
the zoning classification of the following described tract of
land, presently zoned 11R-211 to ITC -111, to wit:
BEGINNING at the southeast corner of the inter-
section of Van Buren Avenue and Sabine Pass
Avenue, being the northwest corner of Lot 6,
Block 35, Arlington Addition to the City of
Beaumont, Jefferson County, Texas;

THENCE south along the west lot lines of
Lots 6, 5, and 4, Block 35, Arlington Addition,
a distance of 145 ft. to a point for corner,
being the southwest corner of Lot 4, Block 35,
said addition;
THENCE east along the common side lot lines
of Lots 3 and 4, Block 35, said addition, a
distance of 140 feet to a point for corner
at the rear or east property lines of Lots 3
and 4, Block 35, said addition;
THENCE north along the east property lines of
Lots 4, 5 and 6, Block 35, said addition, same
being along the west line of an abandoned 15 ft.
wide alley a distance of 117.25 ft., more or
less, to a point for corner in the east line
of Lot 6, Block 35, said addition;
THENCE north 510 7t west along a line which
is 200 ft. from and parallel to the southwest
line of Railroad Avenue a distance of 40 ft.,
more or less, to a point for corner in the
south line of Van Buren Avenue;
THENCE west along the south line of Van Buren
Avenue to the PLACE OF BEGINNING, containing
0.458 acres of land, more or less, and also
including half the width of the abutting street
rights of way.
and the official zoning map of the City of Beaumont is hereby
amended to reflect such changes.
Section 2.
That Chapter 42 of the Code of Ordinances of Beaumont,
Texas, and in particular the boundaries of the zoning districts
as indicated upon the Zoning Map of the City of Beaumont, re-
ferred to in Section 42-9 thereof, is hereby amended by changing
the zoning classification of the following described tract of
land presently zoned "R-2" to "C-2", to wit:
FOR LOCATIVE POINT begin at the southeast corner
of Lot 4, Block 35, Arlington Addition to the
City of Beaumont, Jefferson County, Texas;
THENCE, north along the rear or east line of
Lot 4, Block 35, said addition, same being
along the west line of an abandoned 15 ft.
wide alley a distance of 5 ft. to the PLACE
OF BEGINNING:
THENCE from the PLACE OF BEGINNING continue
north a distance of 112.25 ft. to a point for
corner;

THENCE south 510 7' east along a line which
is 200 ft. from and parallel to the southwest
line of Railroad Avenue a distance of 138.47 ft.
more or less, to a point for corner in the
south lot line of Lot 8, Block 35, said addition,
same being the north -line of a 15 ft. wide public
alley;
THENCE west a distance of 88.7 ft. to the PLACE
OF BEGINNING,. containing 0.114 acres of land,
more or less, and also including half the width
of theabutting public alley.
and the official zoning map of the City of Beaumont is hereby
amended to reflect such changes.
Section 3.
That in all other respects the use of the property

hereinabove described shall be subject to all of the applicable
regulations contained in Chapter 42 of the Code of Ordinances
of Beaumont, Texas, adopted August 19, 1958, effective October 19,
1958, as amended.
Section 4.
That the terms and provisions of this ordinance shall
be deemed to be severable, and that if the validity of the zoning
affecting any portion of the property described hereinabove shall
be declared to be invalid, the same shall not affect the validity
of the zoning of the balance of the property described herein.
Section 5.
That any person or corporation violating any of the
terms and provisions of this ordinance shall be subject to the
same penalties provided for in the said Chapter 42 of the Code
of Ordinances of Beaumont, Texas.
