ENTITLED AN ORDINANCE AMENDING SEC. 40-8 AND 40-9
OF CHAPTER 40 OF THE CODE OF ORDINANCES, CITY OF
BEAUMONT, TEXAS, TO BE EFFECTIVE JULY 11 19713
ESTABLISHING RATES, RULES AND REGULATIONS FOR WATER
SERVICES BOTH INSIDE AND OUTSIDE THE CITY LIMITS BY
CHANGING SAID RATES, RULES AND REGULATIONS; PROVIDING
FOR A PENALTY; PROVIDING FOR SEVERABILITY; AND RE-
PEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN
CONFLICT HEREWITH.
BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS:
1.
That Sec. 40-8 of the Code of Ordinances, City of Beaumont,
Texas, is hereby amended effective July 1, 1971, to read as follows:
"Sec. 40-8. Rates, rules, regulations—Service Inside City.
"Effective July 1, 1971, the following rates, rules
and regulations are hereby established and shall be
enforced and collected by the City Council for water
services furnished within the corporate limits of the
city:
"(1) The following metered rate for water measured
through meters approved by the waterworks
department shall be effective:
(a) Minimum charge, First
1,500 gallons ............ $ 1.50
(b) Next 98,500 gallons ......
(c) Next 100,000 gallons .....
(d) Next 100,000 gallons .....
(e) Next 100,000 gallons .....
(f) Next 100,000 gallons .....
(g) All over 500,000 gallons .

"(2) No flat -rate connections shall be made to the
mains of the waterworks system except for
private fire lines. Private fire line rates
are as follows:
(a) Minimum Charge, 4" tap
or smaller ............... $ 4.00 per month
(b) Minimum Charge, 511 tap ... 5.00 per month

(c) Minimum Charge, 6" tap ... $ 6.00 per month
(d) Minimum Charge, 8" tap ... 8.00 per month
(e) Minimum Charge, 10" tap .. 10.00 per month
(f) Minimum Charge, 12" tap .. 12.00 per month
"(3) All bills shall be computed at the herein
prescribed rates and shall be payable within
thirty (30) days from the date of such bills,
which is also the date of reading the meter.
"(4) Failure or refusal by any customer to pay any
bill to the water department, or its authorized"
representatives, upon demand, shall constitute
a breach of contract, and water and sewer
service may, within ten days from notice of
such failure, be discontinued to the customer,
and, at the discretion of the Director of Water
Utilities, such services shall not be renewed
until the customer has paid all delinquent bills,
plus the following applicable service-charge(s):
For cutting service and
locking meter ............ $ 4.00
For replacing a broken
lock ..................... 7.00
For removal of a meter.... 12.00
For killing tap (cutting
off service at the main
line) .................... 35.00
Protest of charges on file with the water depart-
ment shall not in any manner alter or extend the
purposes of this subsection.
"(5) The water department, or its authorized agents,
may require from any applicant for water service
a cash deposit to secure payment of water, sewer
and sanitation charges, or any other charges that
may accrue, and when such deposit is made it
shall be not less 'than fifteen dollars; provided,
however, additional deposits may be required from
any applicant to pay charges accrued or to accrue
for these services. Failure to pay additional
deposit will forfeit right to water, sewer and
sanitation services and same may be discontinued
five (5) days after notice to pay such additional
deposit.
"(6) Each building containing one or more dwelling
units shall be served by a separate meter of a
size to be determined by the water department.
Accessory buildings, including servants quarters,
may be served by the same meter as serves the
main building. Motels, motor hotels and trailer
camps are not included and may be served by a
single meter.

"(7) Where the services are used by more than
one (1) dwelling unit and is served by a
single meter, or where the dwelling units
are not served by separate meters, a minimum
charge of one dollar and fifty cents will be
made for each dwelling unit served, and water
used over fifteen hundred gallons per unit
per month shall be billed at the appropriate
rate as listed in paragraph (1) hereof.

That Sec. 40-9 of the Code of Ordinances of the City of
Beaumont is hereby amended, effective July 1, 1971, to read as follows:
"Sec. 40-9. Same—Service outside City.
"No water service shall be furnished any sub-
division outside the city limits of the city unless and
until a plan, plat or replat shall have been first approved
in the manner and by the authorities provided for in
Article 427b, Tex. Civ. Stat., and Article 974a, Tex. Civ.
Stat. If such a plan, plat or replat shall have been so
approved in accordance with the said state statutes, the
city council may, if it is deemed advisable, furnish water
service to premises outside the city limits of the city,
under the following rules:
"(1) Any person residing outside of the city
limits desiring to use city water shall
make application to the waterworks depart-
ment requesting service, which shall state
the location of the premises to be served
and the purpose for which water is to be
used. Such application shall be made upon
blanks furnished by the city clerk and shall
be signed by the agent or owner of the
property to be served, and he will become
liable for charges for water furnished under
such services.
"(2) Water service to consumers outside the city
limits shall be rendered at the following
metered rates: Same as inside the city limits,
plus twenty-five percent each month; provided,
however, the minimum charge shall be two
dollars per month.
"(3) Failure or refusal by any customer to pay any
bill to the water department, or its authorized
representatives, upon demand, shall constitute
a breach of contract, and water and sewer service
may, within ten days from notice of such failure,
be discontinued to the customer, and, at the
discretion of the Director of Water Utilities,
such services shall not be renewed until the

"(4) The city council may make special contracts with
a customer whether inside or outside the city
limits with reference to rates charged for
services furnished by the waterworks department,
which shall be equal and uniform and a sufficient
rate to pay all operating, maintenance, depre-
ciation, replacement, betterment, and interest
charges, and for interest and sinking fund
sufficient to pay any bonds issued to improve,
extend or repair the waterworks system, or any
outstanding indebtedness against the same.
"(5) The city council may make contracts with owners
of suburban property for extensions of mains
to such property and for connections of such
mains to the waterworks system of the city;
provided, nothing in this section shall be
construed to compel the city council to give
service to any customer outside the city limits."

That any person who violates any provision of this Ordinance
shall, upon conviction, be punished as provided in Sec. 1-8 of the
Code of Ordinances of Beaumont, Texas.

That if any section, subsection, sentence, clause or phrase
of this Ordinance or the application of same to a particular set of•
persons or circumstances should for any reason be held to be invalid,
such invalidity shall in no wise affect the remaining portions of this
Ordinance, and to such end the.various portions and provisions of this
Ordinance are declared to be severable.

5.
That all Ordinances and parts of Ordinances in conflict here-
with are hereby repealed. /
