ENTITLED AN ORDINANCE REPEALING ARTICLE III AND ARTICLE IV OF CHAPTER 12 OF THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT, TEXAS, AND ESTABLISHING A NEW ARTICLE III, SAID ORDINANCE ESTABLISHING A POSITION CLASSIFICA- TION AND PAY PLAN FOR THE CITY OF BEAUMONT; ESTABLISHING REGULATIONS FOR THE ADMINISTRA- TION OF SAID PLAN; ADOPTING THE CLASSES SET FORTH IN SAID PLAN; PROVIDING FOR SEVERABILITY; AND REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT HEREWITH. BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS: Section 1 That Article III and Article IV of Chapter 12 of the Code of Ordinances of the City of Beaumont, Texas, are hereby repealed. Section 2 That Article III of Chapter 12 of the Code of Ordinances of the City of Beaumont, Texas, shall read as follows: B1ARTICLE III. "Sec. 12-25. Short title. "This ordinance [article] shall be called the 'Position Classification -Compensation Plan' of the City of Beaumont. "Sec. 12-26. Definitions. "For the purpose of this ordinance [article] certain terms are herein.defined as follows: 11(a), A position is a group of currently assigned duties and responsibilities requiring the full or part-time employ- ment of one person. A position may be occupied or vacant. "(b) A class is a group of positions (or one position) that: (1) Have similar duties and responsibilities, (2) Require like.qualifications, and (3) Can be equitably compensated by the same salary range. "(c). The class title is the official designation or name of the class as stated in the class specification. It shall be used on all personnel records and actions. Working or office title may be used for purposeE of internal administration. "Sec. 12-27. Applicable to civil service employees. 11Where not in conflict with the Firemen's and Policemen Civil Service Act, this ordinance [article] and the position classification -compensation plan incorporated herein shall apply to all classified employees of the City of Beaumont. "Sec. 12-28. Responsibility for administration. "The city manager shall be responsible for administering the classification plan. The city manager may assign other officials or employees to assist him in this activity. "Sec. 12-29. Allocation of new positions. "The department head shall complete a position description covering the duties and responsibilities of each proposed position. The city manager shall allocate the position to one of the classes in the classification plan. If a suitable class does not exist he shall recommend the establish- ment of a new class and, after the adoption of the new class by the city council as provided in section 12-33, shall allocate the position to it. "Sec. 12-30. Allocation appeals. . "If an employee has facts which indicate to him that his position is improperly allocated, he may request a review of.the allocation of his position. Such request shall be submitted in writing through such employee's department head to the director of personnel and shall contain a statement of justification. The director of personnel, after study, shall submit the request, together with the director's recommendation, to the city manager for his decision on such request. The decision of the city manager shall be final. The city manager shall have absolute authority, either upon appeal or upon his own initiative to reclassify jobs within current adoptive classifications. "Sec. 12-31. Maintenance of plan. "(a) Each time a department or division is reorganized, position descriptions for all affected employees should be submitted to the city manager. -2- "(b) The city manager may require depart- ments or employees to submit position descriptions on a periodic basis, or any time he has reason to believe that there has been a change in the duties and responsibilities of one or more positions. "(c) Each time a new class is established, a class specification shall be written and incorporated in the existing plan. The class title shall be added to the schematic list of titles. Likewise, an abolished class shall be deleted from the classification plan by removing the class specification and eliminating the class title from'the schematic list of titles. 1P(d) Periodically after the adoption of this ordinance [article] the city manager may conduct a general review of the classifi- cation plan. "Sec. 12-32. Interpretation of class specifications. "The class specifications are descriptive and not restrictive. They are intended to indicate the kinds of positions which shall be allocated to the classes established. In a series of classes the specifications for all classes should be reviewed as a unit. "Sec. 12-33. Amendments to plan. "Each timea new class of positions should be established or a current class of positions abolished, the city manager shall submit his findings and recommendations to the city council. The council shall determine whether the establishment and or the abolition of a class is in order. Such changes shall take the form of amendments to section 12-34 of this ordinance [article]. "Sec. 12-34. Classes adopted. "The classes set forth in the 'Manual of Class Specifications' included in the position classification -compensation plan as amended on file in the office of the City Clerk are hereby adopted. "Sec. 12-35. Classification and pay plan adopted. . "The compensation plan and salary grades for all classes or positions as set forth in the 'Classification and Pay Plan' included in the position classification -compensation plan as amended on file in the office of the City Clerk are hereby adopted. -3- S "Sec. 12-36-12-40. "Sec. 12-41. Are hereby reserved for uture use. New appointees. 11Generally, a new employee shall be paid the minimum rate of pay for his class. Exceptions may be granted upon the written prior recommenda- tion of the department subject to the approval of the city manager in the following cases; "(a) The minimum rate for each class is based upon the assumption that a new employee meets the minimum qualifications stated in the class specification. "(b) If a new employee more than meets the minimum qualifications, and will not accept appointment at the minimum rate of the class, he may be appointed, at the discretion of the city manager, at the second step or in unusual cases at a higher step. "Sec. 12-42. Promotions and transfers. "When an employee is promoted to a position in a higher class, his salary may be increased at the minimum rate for the higher class. In the case of overlapping ranges, the promoted employee may be increased to the step immediately above his present salary. Promotional increases may be delayed for a period not to exceed ninety (90) days pending proven ability to perform the job to which promoted. "There shall be no immediate change in the salary rate of an employee who is transferred unless his salary is below the approved minimum of the new position. If an employee is transferred to a position in a class having a higher salary range than the class from which he was transferred, such change may be deemed a promotion and the provisions governing promotions may apply. `.'Sec. 12-43. Demotions. "When an employee is demoted to a lower class position, he shall be.paid at a rate which is within the approved range for the lower class position. The rate of pay shall be set by the city manager. "Sec. 12-44. Re -allocations downward. "When an employee's position is re -allocated to a lower class position the employee shall be permitted to continue at his present rate of pay during period of incumbency (except in event of -- general service -wide reductions) but shall not be entitled to a salary increase. -4- CA,, i 0 "Sec. 12-45. Reinstated employees. "A reinstated employee shall be paid at a salary rate within the approved salary range for the position in which he is reinstated. "Sec. 12-46. Part-time employment. "When employment is on a part-time basis, only the proportionate part of the rate for the time actually employed shall be paid'. ".'Sec. 12-47. Administrative salary adjustment. "The salary of each employee shall be reviewed annually by his department head for the purpose of determining which employees may be considered for salary increases. All the personnel records, tardiness, performance and 'Length of service shall be considered in making recommendations with major emphasis placed on the evaluation of services rendered. The city manager shall have absolute authority to grant salary increases within the present compensation ranges established, herein and shall do so only upon the positive recommendation of the department head of that employee. "Sec. 12-48. Responsibility for administration. "The city manager shall be responsible for administering the compensation plan for all positions. He shall be responsible for working out arrangements which will insure the administra- tion of the plan for all employees on an equitable basis. "Sec. 12-49. Interpretation. "The city manager shall be responsible for interpreting the application of the plan to pay problems which are not specifically covered by this ordinance [article] using the principles expressed herein as a policy guide. "Sec. 12-50. Initial adjustment to the compensation ."After the initial grade for a class of positions has been established, the provisions of section 12-47 above shall apply for all subsequent increases. "Sec. 12-51. Review and amendment of compensation p an• "(a) Prior to the annual submission of the budget to the city council, the city manager shall have completed a review of the compensation plan and submit his findings together with recommended amendments to the council. "(b) The rates of pay for each class of positions which are prescribed in this ordinance [article] shall be changed by the city council by amendment to section 12- 35 of this ordinance [article] . -5- . • �, ,Y c.r � r ` ._� W f v "Sec. 12-52. Longevity or service pay. "Commencing July 1, 1970, each employee shall receive three dollars ($3.00) per month for each year's service with the city, commencing with the date of his employment, up to and including twenty-five (25) years of service with the city. This longevity or service pay shall be paid in addition to all other moneys paid for services rendered to the city. As to all persons in the employ of the city as of July 1, 1970, all employment with the city prior to July 1, 1970, even though interrupted, shall be counted in com- puting longevity or service pay; providing, however, that any person employed or reemployed after July 1, 1970, shall be paid only for continuous service, and interrupted service shall not be counted in computing longevity or service pay.11 Section 3 That if any sentence, subsection, clause or phrase of this ordinance or the application of same to a particular set of persons or circumstances should for any reason be held to be invalid, such invalidity shall in no wise affect the remaining portions of this ordinance and to such end the various portions and provisions of this ordinance are declared to be severable.
