ENTITLED AN ORDINANCE AMENDING ARTICLE IV OF
CHAPTER 42 OF THE CODE OF ORDINANCES OF THE
CITY OF BEAUMONT BY ADDING FOUR NEW SECTIONS
THERETO, ENTITLED SECTIONS 42-44, 42-455
42-46, AND 42-47; ADOPTING OFFICIAL CONSTRUC-
TION STANDARDS AND SPECIFICATIONS FOR STREETS
WITHIN THE CITY OF BEAUMONT; PROVIDING GENERAL
STANDARDS FOR THE CONSTRUCTION OF STREETS IN
THE CITY OF BEAUMONT; REQUIRING THAT ALL NEW
STREETS CONSTRUCTED IN THE CITY OF BEAUMONT
BE CONSTRUCTED IN ACCORDANCE WITH THE OFFICIAL
CONSTRUCTION STANDARDS AND SPECIFICATIONS FOR
STREET CONSTRUCTION; REQUIRING DEDICATION OF
RIGHT-OF-WAY AND CONSTRUCTION OF STREETS BY
DEVELOPERS; PROVIDING FOR NEW AND RECONSTRUCTED
STREETS ON EXISTING RIGHT-OF-WAY; PROVIDING FOR
SEVERABILITY; AND PROVIDING FOR REPEAL OF ALL
ORDINANCES IN CONFLICT.
BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS:
Section 1.
That Article IV of Chapter 42 of the Code of Ordinances
of the City of Beaumont be amended by adding four new sections
thereto, to be numbered Sections 42-44, 42-45, 42-46, and
42-47, which said new sections shall read as follows:
"Sec. 42-44.
Official Street Construction Standards
and Specifications Adopted.
"The official street construction standards dated
February 1, 1972, and the official street con-
struction specifications dated February 1, 1972,
for the construction of streets in the City of
Beaumont are hereby incorporated into and made
a part of this section by reference and shall be
on file in the office of the City Clerk."
"Sec. 42-45. General Standards for Street
Construction.
"(a) Arterial Streets. An "arterial street" is
a public right-of-way with the highest degree
of traffic continuity and serving as a major
trafficway for fast or heavy traffic between
the various districts of the City. The de-
veloper of a new subdivision shall be required
to dedicate appropriate right-of-way for

arterial streets required within said
subdivision in accordance with the official
street and highway plan. The City of
Beaumont shall be responsible for the im-
provement, maintenance and operation of
the facility. The right-of-way required
for arterial streets shall be from eighty
(80') feet to one hundred twenty (120')
feet in width as may be required. The
pavement width of arterial streets shall be
forty-eight (48') feet to seventy-two (721)
feet from face to face of curb and any
additional channelization and storage lane
as may be appropriate. Drainage shall be
underground, and curbs and gutters of
Portland cement concrete are required.
Sikewalks are required in the vicinity of
schools.
"(b) Frontage Roads. A "frontage road" is a
street which is parallel to and adjacent to,
.or in the immediate vicinity of, an arterial
street and which has for its purpose the
relief of such arterial street from the
local service of abutting property. Frontage
roads may be required along arterial thor-
oughfares where individual properties are
platted to have ingress and egress from the
side adjacent to the arterial street. Front-
age roads, as appropriate, shall be constructed
in a new subdivision by the developer. The
City will accept frontage roads upon comple-
tion and determination that they conform to
the City's standards.. The right-of-way re-
quired for frontage roads shall be forty (40')
feet in width. The width of pavement for a
frontage road shall be twenty (20') feet from
face to face of curb: Drainage shall be under-
ground as required to serve the subdivision,
and curbs and gutters of Portland cement con-
crete are required. Sidewalks are not required.
"(c) Residential Collector Streets. A "residential
collector street" is a street of considerable
continuity which carries traffic from residen-
tial streets to arterial streets, including the
principal entrance streets of residential
developments and the principal circulating street
within such developments. Residential collector
streets shall be constructed in new subdivisions
by the developers of said new subdivisions and
shall be accepted by the City for maintenance
and operation upon a determination that they
have been constructed in conformance with the
City's standards. The right-of-way required

for residential collector streets shall be
sixty (60') feet in width. The pavement
width shall be thirty-six (36') feet from
face to face of curb. Drainage shall be
underground, and.curbs_ and gutters of Portland
cement concrete shall be constructed. Side-
walks shall be required on one side only.
1°(d) Industrial Collector Streets. An "industrial
collector street" is a street designed to
accommodate the increased volume movements,
turning movements and truck traffic created by
the use of adjacent land and to carry traffic
to arterial streets. Industrial collector
streets as required shall be constructed by
the developer of adjacent land. The City shall
accept industrial collector streets for main-
tenance and operation upon a determination
that they have been constructed in conformance
with the City's standards. The right-of-way
required for industrial collector streets
shall be sixty (60') feet in width. The pave-
ment width of industrial collector streets
shall be forty (40') feet from face to face of
curb. Drainage shall be underground as required
to serve the development, and curbs and gutters
of Portland cement concrete are required. Side-
walks are required only in the vicinity of
schools.
"(e) Residential Streets. A "residential street" is
a. street which may be of limited continuity used
primarily for access to the abutting property
and the local needs of the neighborhood. Resi-
dential streets shall be constructed in new
subdivisions by the developers of said new sub-
divisions and shall be accepted by the City upon
completion and determination that they conform
to the City's standards. The right-of-way re-
quired for residential streets shall be fifty -
(50') feet in width. Pavement width shall be
twenty=six (26') feet from face to face of curb.
Drainage shall be underground as required to
serve the development, and curbs and gutters of
Portland cement concrete are required. Side-
walks are not required.11
"Sec. 42-46. Construction of Streets.
"All streets shall be constructed or reconstructed in
accordance with the official street and highway plan
of the City of Beaumont, the official street construc-
tion standards of the City of Beaumont, and the official
street construction specifications of the City of

"Sec. 42-47. New Streets on Existing Rights -
of -Way..
"The City of Beaumont will participate in the cost
of construction of new streets in existing rights-
of-way to the extent of one-third (1/3) of the
total cost, with the remaining two-thirds (2/3)
of the total cost to be provided by the abutting
property owners."
Section 2.
That if any section, subsection, sentence, clause or
phrase of this ordinance or the application of same to a par-
ticular set of persons or -circumstances should for any reason
be held to be invalid, such invalidity shall in no wise affect
the remaining portions of this ordinance, and to such end the
various portions and provisions of this ordinance are declared
to be severable.
Section 3.'
That all ordinances and parts of ordinances in conflict
herewith are hereby repealed.

"Sec. 42-46. Construction of Streets.
"All streets shall be constructed or reconstructed in
accordance with the official street and highway plan

"The City of Beaumont will participate in the cost
of construction of new streets in existing rights -
of -way to the extent of one-third (1/3) of the
total cost, with the remaining two-thirds (2/3)
of the total cost to be provided by the abutting
property owners."
Section 2.
That if any section, subsection, sentence, clause or
phrase of this ordinance or the application of same to a par-
ticular set of persons or circumstances should for any reason
be held to be invalid, such invalidity shall in no wise affect
the remaining portions of this ordinance, and to such end the
various portions and provisions of this ordinance are declared
to be severable.
Section.3.
That all ordinances and parts of ordinances in conflict
herewith are hereby repealed.
