ENTITLED AN ORDINANCE VACATING AND ABANDONING
A TWENTY FOOT (20') BY THREE HUNDRED FOOT
(300') ALLEY IN BLOCK FIVE (5) OF THE McFADDIN
SECOND ADDITION IN THE CITY OF BEAUMONT,
JEFFERSON COUNTY, TEXAS, AS MORE PARTICULARLY
DESCRIBED HEREIN; PROVIDING THAT SUCH ABANDON-
MENT SHALL IN NO WAY'AFFECT A CERTAIN EASEMENT
FOR GENERAL UTILITY PURPOSES, DATED SEPTEMBER 17,
19712 AND ACCEPTED BY THE CITY OF BEAUMONT THIS
DATE, AS SET FORTH HEREIN.
WHEREAS, on February 15, 1971, the Planning and Zoning
Commission recommended that a twenty foot (20') by three hundred
foot (300') alley located in B1ock.Five (5) of the McFaddin
Second Addition be abandoned subject to the dedication by property
owners of a twenty foot (20') by three hundred.foot (300') general
utility easement; and,
WHEREAS, it appears to the City Council that it is to
the best interest of the City of Beaumont and benefit to the
public that the hereinafter described twenty foot (20') by three
hundred foot (300') alley in the McFaddin Second Addition to the
City of Beaumont be.vacated and abandoned; and,
WHEREAS, the abutting property owners have formally
requested the abandonment of said alley and have tendered to the
City of Beaumont a twenty foot (20') by three hundred foot (300')
general utility easement dated September 17, 1971;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
OF BEAUMONT, TEXAS:
That the following described twenty foot (20') by three hundred
foot (300') alley in the City of Beaumont, Texas, be and the same
is hereby vacated -and abandoned and that title to said portion of
said vacated and abandoned alley shall revert to and become the
property of the persons entitled thereto, as provided by law,
said alley being described as follows:
Being that certain 20 foot wide by 300 feet in
length parcel of land extending 300 feet from
the west right-of-way line of Fifth Street on
the east to the east right-of-way line of Sixth
Street on the west, said parcel of land lying
south of and adjacent to the south lot lines of
lots seven (7) thru twelve (12), Block Five (5)
of the McFaddin Second Addition to the City of
Beaumont, Jefferson County, Texas, and said
parcel of land lying north of and adjacent to
the north lot lines of lots one (1) thru six
(6), said Block Five (5) of the McFaddin Second
Addition to the City of Beaumont, Jefferson
County, Texas, said.parcel containing 6000 sq.
feet of land, more or, less.
Provided, however, that the vacation and abandonment of
said alley shall in no way affect a general utility easement
accepted by the City Council by resolution of even date herewith.
PASSED by the City Council this day of January,
1972.
