ENTITLED AN ORDINANCE.AMENDING CHAPTER 42 OF
THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND
IN PARTICULAR THE BOUNDARIES OF THE ZONING
DISTRICTS AS INDICATED UPON THE ZONING MAP OF
THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, BY
CHANGING THE CLASSIFICATION OF THE FOLLOWING
TWO TRACTS OF LAND IN THE F. BIGNER SURVEY IN
THE CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS,
AS DESCRIBED HEREIN, PRESENTLY ZONED "R-1" TO
"R-2" AND "C-111; PROVIDING FOR SEVERABILITY;
AND PROVIDING A PENALTY.
BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS:
Section 1.
That Chapter 42 of the Code of Ordinances of Beaumont,
Texas, and in particular the boundaries of the zoning districts
as indicated upon the Zoning Map of the City of Beaumont, re-
ferred to in Section 42-9 thereof, is hereby amended by changing
the zoning classification of the following described tract of
land, presently zoned "R-1", Single Family Dwelling District to
"C-1", Neighborhood Commercial District, to wit:
BEING a 0.9672 acre tract of land in the F.
Bigner Survey, Beaumont, Jefferson County,
Texas, said tract being a part of a tract
which was deeded by Quitclaim by Mrs. Viola.
Meyer to Gerald Meyer, said tract being more
particularly described as follows:
BEGINNING at an iron stake at the most Southwest
corner of the herein described 0.9672 acre tract
said stake being in the Northeast line of the
Eastex Freeway, (U.S. Highways 69, 96 and 287),
same being in the North line of the abandoned
Southern Pacific, (S. & E.T. RR Co), Railroad
right-of-way;
THENCE N. 57031'35" W. along the Northeast line
of the Eastex Freeway 179.11 feet to an iron
stake for corner, said stake being in the center-
line of the abandoned Southern Pacific Railroad
right-of-way and in the Northeast line of the
Eastex Freeway;

THENCE N. 47051'05" E. 49.56 feet to an iron
stake for corner in the North line of the
abandoned Southern Pacific Railroad right-of-
way;
THENCE N. 89005'50" E. 301.30 feet to an iron
stake for corner in the West line of the Prater
Cemetery, being the most Northeast corner of
the herein described tract;
THENCE S. 00018'49" E. along the West side of
the cemetery 129.80 feet to an iron stake for
corner in the Southwest corner of the cemetery;
THENCE S. 89037118" E. along the South side of
the cemetery 21 feet, more or less, to a point
for corner;
THENCE in a Southeasterly direction along a line
parallel to and 150 feet North of, measured at
right angles, the Northeast line of the afore-
mentioned Eastex Freeway, a distance of 90 feet,
more or less, to a point for corner;
THENCE N. 76051'58" W. 263.16 feet to the place
of beginning, said above described tract con-
taining 0.9672 acres, more or less, and also
including half the width of the abutting highway
right-of-way.
Section 2.

That Chapter 42 of the Code of Ordinances of Beaumont,
Texas, and in particular the boundaries of the zoning districts
as indicated upon the Zoning Map of the City of Beaumont, re-
ferred to in Section 42-9 thereof, is hereby amended by changing
the zoning classification of the following described tract of
land, presently zoned "R-1", Single Family Dwelling District to
"R-211, Two Family and Multiple Dwelling District, to wit:
BEING a 2.1396 acre tract of land in the F.
Bigner Survey, Beaumont, Jefferson County,
Texas, said tract being a part of a tract
which was deeded by quitclaim by Mrs. Viola
Meyer to Gerald Meyer, said tract being more
particularly described as follows:
FOR LOCATIVE POINT begin at an iron stake in
the Southwest corner of the Prater Cemetery,

thence S., 89°37'18" E. along the South side of
the cemetery a distance of 21 feet, more or less,
to the PLACE OF BEGINNING; thence continue S.
89°37'18" E. along the South side of the cemetery
a distance of 126.20 feet to an iron stake for
corner in the Southeast corner,of the cemetery;
THENCE N. 00038'08" E. 148 feet to an old fence
corner post for corner at the Northeast corner
of -the cemetery;
THENCE S. 89049'32" E. 99.50 feet to an iron
stake for corner;
THENCE S. 18059'28" W. 42.50 feet to an old iron
stake for corner;
THENCE S. 75028'03" E. 218.86 feet to an old iron
stake in a fence for point; and continuing along
fence 78°18'50" E. 186.06 to an iron stake for
corner;
THENCE S. 11018'33" W. 67 feet to an iron stake
for corner;
THENCE N. 78018'50" W. 98 feet to a concrete
monument for corner;
THENCE S. 11018'33" W. a distance of 134.07 feet
to a concrete monument for corner;
THENCE N. 76051'58" W. along a fence a distance
of 436.04 feet, more or less, to a point for
corner;
THENCE in a. Northwesterly direction along a line
parallel to and 150 feet North of, measured at
right angles, the Northeast line of the Ea.stex
Freeway, (U.S. Highways 69, 96 and 287), a dis-
tance of 90 feet, more or less, to the place of
beginning, said above described tract containing
2.1396 acres, more or less.
Section 3.
That in all other respects the use of the property

hereinabove described shall be subject to all of the applicable
regulations contained in Chapter 42 of the Code of Ordinances
of Beaumont, Texas adopted August 19, 1958, effective October
1911 1958, as amended.

Section 4.
That the terms and provisions of this ordinance shall
be deemed to be severable, and that if the validity of the zoning
affecting any portion of the property described hereinabove
shall be declared to be invalid, the same shall not affect the
validity of the zoning of the balance of the property described
herein.
Section 5.
That any person or corporation violating any of the
terms and provisions of this ordinance shall be subject to the
same penalties provided for in the said Chapter 42 of the Code
of Ordinances of Beaumont, Texas.
