ENTITLED AN ORDINANCE AMENDING CHAPTER 42 OF
THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND
IN PARTICULAR THE BOUNDARIES OF THE ZONING
DISTRICTS AS INDICATED UPON THE ZONING MAP OF
THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, BY
CHANGING THE CLASSIFICATION OF A 0.062 ACRE
TRACT OF LAND, MORE OR LESS, OUT OF THE F.
BIGNER SURVEY IN THE CITY OF BEAUMONT, JEFFERSON
COUNTY, TEXAS, AS DESCRIBED HEREIN PRESENTLY
ZONED "R-1" TO "C-11'; PROVIDING FOR SEVERABILITY;
AND PROVIDING A PENALTY.
BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS:
Section 1.
That Chapter 42 of the Code of Ordinances of Beaumont,
Texas, and in particular the boundaries of the zoning districts
as indicated upon the Zoning Map of the City of Beaumont, re-
ferred to -in Section 42-9 thereof, is hereby amended by chang-
ing the zoning classification of the following described tract
of land, presently zoned "R-1", Single Family Dwelling District,
to 11C-111, Neighborhood Commercial District, to -wit:
Being a triangular-shaped.parcel of land
situated in Beaumont, Jefferson County, Texas,
said parcel containing in area 0.062 acres of
land, more or less; said parcel being the most
southwest corner of tract No. 39-A out of Plat
D-22, F. Bigner Survey, as recorded in the City
of Beaumont's property tax rolls; and being more
particularly described as follows:
For locative point begin at the intersection of
the south right-of-way line of U.S. Highway 69,
96,'& 287 (Eastex Freeway) with the east right-
of-way line of Treadway Road; thence south along
the east right-of-way line of Treadway Road to
a point which lies 200 feet southwest (measured
at a right angle) from the right-of-way line of
the Eastex Freeway, said point being the Place
of Beginning of the herein described tract of
land;
Thence southeast along -a line 200 feet from
and parallel to the southwest right-of-way line
of the Eastex Freeway a distance of 110.53 feet,
more or less,,to a point for corner;
Thence north 84°29'13" west 70 feet, more or
less, to a point for corner in the east right-
of-way line of Treadway Road;
Thence north 1°43'3018 west along the east right-
of-way line of Treadway Road to the place of
beginning, said parcel containing approximately
2684.22 square feet or 0.62 acres, more or less.
Zoning extends to the centerline of the abutting
street,
and the official zoning map of the City of Beaumont is hereby
amended to reflect such changes.
Section 2.
That in all other respects the use of the property
hereinabove described shall be subject to all of the applicable
regulations contained in Chapter 42 of the Code of Ordinances
of Beaumont, Texas, adopted August 19, 1958, effective October
193 1958, as amended.
Section 3.
That the terms and provisions of this ordinance shall
be deemed to be severable, and that.if the validity of the
zoning affecting any portion of the property described herein-
above shall be declared to be invalid, the same shall not
affect the validity of the zoning of the balance of the pro-
perty described herein.
Section 4.
That any person or corporation violating any of the
terms and provisions of this ordinance shall be subject to the
same penalties provided for in the said Chapter 42 of the Code
of Ordinances of Beaumont, Texas.
