ORDINANCE NO. 73-19
ENTITLED AN ORDINANCE AMENDING CHAPTER 42 OF
THE CODE OF ORDINANCES OF BEAUMONT, TEXAS,
AND IN PARTICULAR THE BOUNDARIES OF THE ZONING
DISTRICTS AS INDICATED UPON THE ZONING MAP OF
THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, BY
CHANGING THE CLASSIFICATION OF A 4.ACRE TRACT
OF LAND OUT OF THE F. BIGNER SURVEY, BEAUMONT,
JEFFERSON COUNTY, TEXAS, AS DESCRIBED HEREIN,
PRESENTLY ZONED "R-1" TO "C-111; PROVIDING FOR
SEVERABILITY; AND PROVIDING A PENALTY.
BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS:
Section 1.
That Chapter 42 of the Code of Ordinances of.Beaumont,
Texas, and in particular the boundaries of the zoning districts
as indicated upon the Zoning Map of the City of Beaumont, re-
ferred to in Section 42-9 thereof, is hereby amended by
changing the zoning classification of the following described
tract of land, presently zoned "R-1", Single Family Dwelling
District, to "C-111, Neighborhood Commercial District, to -wit:
Being a 4 acre tract of land, more or less,
out of the F. Bigner Survey, Beaumont,- Jeffer-
son County, Texas, and being more particularly
described as follows:
BEGIN at an iron rod in the northeast line of
the Eastex Freeway (U. S. Hwys, 69, 96 & 287) for
PLACE OF BEGINNING of the herein described tract
of land, said iron rod lying in the centerline
of the abandoned Southern Pacific Railroad right-
of-way; thence north 47 deg. 59 min. east, 50
feet to a point for corner in the northeast line
of the abandoned Southern Pacific Railroad right -
of way; thence north 88 deg. 41 min. east, 301.9
feet to a point for corner;. thence north 01 deg.
55 min. east, 20.9 feet to a point for corner;
thence south 89 deg. 15 min. east, 122.5 feet
to a galvanized pipe for a point, then continue south
89 deg. 11 min. east, 87.1.feet to the most south-
easterly corner of the herein described tract of
land;
THENCE north 01 deg. 06 min. east, 271.4.feet
to a point for corner, said point lying 150 feet
south of the south right-of-way line of Concord
Road if measured perpendicularly;
THENCE in a northwesterly direction along a line
150 feet south of and parallel to the south right-
of-way line of Concord`Road a distance of 357
feet, more or less, to the most northerly corner
of the herein described tract of land;

THENCE south 28 deg. 15 min. west, 484.8 feet
to a point for corner in the northeast line of
the abandoned Southern -Pacific Railroad right-
of-way; thence south 47 deg. 59 min. west, 50
feet to a point for corner in the.centerline
of the abandoned Southern Pacific Railroad
right-of-way; thence south 42 deg. 01 min. ,, east, ,
a distance of 46.6 feet to the place of beginning,
said herein described tract of land containing
4 acres,,more or less, and also including,half
the width of abutting highway right-of-way,
and the official zoning map of the City of Beaumont is hereby
amended to reflect such changes.
Section 2.
That in all other respects the use of the property
hereinabove described shall be subject to all of the applicable
regulations contained in Chapter 42 of the Code of Ordinances
of Beaumont, Texas, adopted August 19, 1958, effective
October 19, 1958, as amended.
Section 3.
That the terms and provisions of this ordinance shall
be deemed to be severable, and that if the validity of the
zoning affecting any portion of the property described herein-
above shall be declared to be invalid, the same shall not
affect the validity of the zoning of the balance of the
property described herein.
Section 4.
That any person or corporation violating any of the
terms and provisions of this ordinance shall be subject to
the same penalties provided for in the said Chapter 42 of the
Code of Ordinances of Beaumont, Texas.
