ORDINANCE NO. 73-13
ENTITLED AN ORDINANCE AMENDING ARTICLE IV, OF
CHAPTER 42 OF THE CODE OF ORDINANCES BY AMEND-
ING SECTION 42-44, ADOPTING OFFICIAL STREET
CONSTRUCTION STANDARDS, DATED FEBRUARY 1, 19723
AND OFFICIAL STREET CONSTRUCTION SPECIFICATIONS,
DATED FEBRUARY 1, 1972, WITH AMENDMENTS THERETO
DATED FEBRUARY 13, 1973; AND BY AMENDING SEC-
TION 42-45 OF THE CODE OF ORDINANCES PROVIDING
FOR ROLL CURBS AND SIDEWALKS; PROVIDING FOR
NEW STREET AND RIGHT-OF-WAY WIDTHS FOR ARTERIAL
STREETS; PROVIDING FOR CITY PAYMENT FOR COSTS
OF PIPE FOR DRAINAGE UNDER CERTAIN CONDITIONS;
PROVIDING FOR CITY PAYMENT FOR STREET.WIDTHS IN
EXCESS OF TWENTY-SIX FEET (261); PROVIDING AN
OBLIGATION FOR A SUBDIVIDER TO CONSTRUCT
ADEQUATE DRAINAGE; PROVIDING FOR SEVERABILITY;
AND PROVIDING FOR REPEAL OF ALL ORDINANCES IN
CONFLICT.
BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS:
Section 1.
That Section 42-44 and Section 42-45 of the Code of
Ordinances of the City of Beaumont shall be amended to read as.
follows:
"Sec. 42-44. Official street construction
standardsand specifications
adopted.
"The official street construction standards
dated February 1, 1972, with.amendments dated
February 13,'1973, and the official street
construction specifications dated February 1,
.1972, with amendments dated February 13, 1973,
for the construction of streets in the City of
Beaumont are hereby incorporated into and made
a part of this section,by reference and shall
be on file in the office of the City Clerk.''
'Sec. 42-45. General standards for street
construction..
01(a) Arterial Streets. An 'arterial street'
is a public right-of-way with the highest
degree of traffic continuity and serving
as a major traffic way for fast or heavy
traffic between the various districts of
the City. The developer of a new sub-
division shall be required to dedicate
appropriate right-of-way for arterial
streets required within said subdivision
in accordance with the Official Street and
Highway Plan. The City of Beaumont shall
be responsible for the improvements, main-
tenance and operation of the facility. The
right-of-way required for arterial streets
shall be from sixty (60') feet to one hundred
twenty -(120') feet in width as may be required.
The pavement width of arterial streets shall
be forty-four (44') feet to seventy-two (72')
feet from face to face of curb and any addi-
tional channelization and storage lane as may
be appropriate. Drainage shall be underground,
and curbs and gutters of Portland cement con-
crete are required. Sikewalks are required
in the vicinity of schools.
"(b) Frontage Roads. A 'frontage road' is a street
which is parallel to and adjacent to, or in
the immediate vicinity of, an arterial street
and which has for its purpose the relief of
such arterial street from the local service
of abutting property. Frontage roads may be
required along arterial thoroughfares where
individual properties are platted to have
ingress and egress from the side adjacent to
the arterial street. Frontage roads, as appro-
priate, shall be constructed in a new sub-
division by the.developer. The City will
accept frontage roads upon completion and
determination that they conform to the City's
standards. The right-of-way required for
frontage roads shall be forty (40') feet in
width. The width of pavement -for a frontage
road shall be twenty (20') feet from face to
face of curb. Drainage shall be underground
as required to serve the subdivision. The
City will pay the difference in pipe size
costs when larger storm sewer pipe than
adequate for a particular subdivision is re-
quired. Curbs and gutters of Portland cement
concrete are required. Sidewalks are not
required.
"(c) Residential Collector Streets. A 'residential
collector street' is a street of considerable
continuity which carries traffic from residential
streets to arterial streets, including the prin-
cipal entrance streets of residential develop-
ments and the principal circulating street with-
in such developments. Residential collector
streets shall be constructed in new subdivisions
by the developers of said new subdivisions and
shall be accepted by the City for maintenance

and operation upon a determination that
they have been constructed in conformance
with the City's standards. The City will
pay costs of increased width of pavement
over twenty-six (26') feet from face to
face of curb. The right-of-way required for
residential collector streets shall be sixty
(60') feet in width. The pavement width shall
be thirty-six (36') feet from face to face
of curb. Drainage shall be underground and
provided by the developer. The City will pay
the difference in pipe size costs when a
larger storm.sewer pipe than adequate for
a particular subdivision is required by the
City. Sidewalks shall be required on one
side only on the parabolic crown street
section. On the street section with roll -type
curbs sidewalks will be required on both sides.
"(d) Industrial Collector Streets. An: ''industrial
collector street' is a street designed to
accommodate the increased volume movements,
turning movements and truck traffic created by
the.use of adjacentland to carry traffic
to arterial streets. Industrial collector
streets as required shall be constructed by
the developer of adjacent land. The City
shall accept industrial collector streets
for maintenance and operation upon a determi-
nation that they have been constructed in con-
formance with the City's standards. The
right-of-way required for industrial collector
streets shall be a minimum of sixty (60') feet
in width. The pavement width of industrial
collector streets shall be forty (40') feet
from face to face of curb. Drainage shall
be underground as required to serve the
subdivision and shall be -provided by the
developer. The City will pay the difference
in pipe size costs when a larger storm
sewer pipe than adequate for a particular
subdivision is required by the City. Curbs
and gutters of Portland cement concrete are
required, and sidewalks are required only
in the vicinity of schools.
"(e) Residential Streets. A "residential street' is
a street which may be of limited continuity used
primarily for access to the abutting property
and the local needs of the neighborhood. Resi-
dential streets shall be constructed in new
subdivisions by the developers of said new sub-
divisions and shall be accepted by the City
upon completion and determination that they
conform to the City's standards. The minimum
right-of-way required for residential streets
shall be fifty (50') feet in width. Pavement
width shall be twenty-six (26') feet from face to
face of curb. Drainage shall be underground

as required to serve the subdivision and
shall be provided by the developer. The
City will pay the difference in pipe size
costs. when a larger storm sewer pipe than
adequate for a particular subdivision is
required by the City. Roll -type curbs are
allowed and curbs and gutters of Portland
cement concrete are required. Sidewalks
are not required.
Section 2.
That if any section, subsection, sentence, clause or
phrase of this ordinance or the application of same to a par-
ticular set of persons or circumstances should for any reason
be held to be invalid, such invalidity shall in no wise affect
the remaining portions of this ordinance and to such end the
various portions and provisions of this ordinance are declared
to be severable.
Section 3.
That all ordinances and parts of ordinances in conflict
herewith are hereby repealed.
