HomeMy WebLinkAboutORD 73-6LLJ/s1d/1/18/73 • ORDINANCE NO. 73-6 • ENTITLED AN ORDINANCE AMENDING CHAPTER 42 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS,.AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF THE CODE OF -ORDINANCES OF BEAUMONT, TEXAS, BY CHANGING THE CLASSIFICATION OF A 5.25 ACRE TRACT OF LAND OUT OF THE NOAH TEVIS SURVEY, BEAUMONT, JEFFERSON COUNTY, TEXAS, AS DE- SCRIBED HEREIN PRESENTLY ZONED "C-1" TO "I-111; "-_PROVIDING FOR SEVERABILITY; AND-- PROV-ID-ING - A- , PENALTY. BE IT ORDAINED BY -THE CITY OF BEAUMONT, TEXAS: Section 1. I --113 -tA_23 That Chapter 42 of. -the Code of, Ordinances of Beaumont, Texas, and in particular the boundaries of the zoning districts as indicated upon the Zoning Map of the City of Beaumont, re- ferred to in Section 42-9 thereof, is hereby amended by chang- ing the zoning classification of the following described tract of land, presently zoned "C-1", Neighborhood Commercial District, to "I-1", Light Industrial District, to -wit: Being a 5.25 acre tract of land out of the Noah -Tevis Survey, Beaumon-t-,.,..Jeff-e-r--son--County, Texas; said tract being primarily out of parts of Blocks 33, 34, 35, 36, and 38 of the Van Wormer 2nd Addition to the City of Beaumont, and includ- ing street, alley and Missouri Pacific Railroad Company rights-of-way; said tract being more particularly described as follows: Beginning at the point of intersection of the centerline of the Laurel Avenue 60 feet wide street right-of-way with the centerline of the Sawyer Street 60 :foo;' t wide street right-of-way extended, locating the beginning corner of the herein described tract of land; Thence west along the centerline of Laurel Ave- nue a distance of 130 feet to a point for corner; Thence south along a line 130.feet west of and parallel to the centerline of Sawyer Street, said line crossing through Blocks 33, 341 35, 36' and 38 of the Van Wormer 2nd Addition, a distance of 1,760 feet, more or less, to.a point for cor- ner within the right-of-way of the Missouri Pacific Railroad.Company, said point being at the point of intersection of the railroad right- of-way with a westward extension of the center- line of the Smart Street 60 foot wide street right-of-way; Thence east a distance of 130 feet, more or less, to a point for corner at the intersection of the centerline of Smart Street with the centerline of "Sawyer Street, said point being in the north line of the Missouri Pacific Railroad right-of-way; Q -73- 1-2-3-73 27 Thence north along the centerline of Sawyer Street a distance of 1,760 feet, more or less, to the place of beginning; said above described tract of land containing an area of 228,800 square feet or 5.25 acres of land, more or less. and the official zoning map of the City of Beaumont ischereby amended to reflect such changes. Section 2. That in all other respects the use of the property hereinabove described shall be subject to all of the applicable regulations contained in Chapter 42 of the Code of Ordinances of Beaumont, Texas, adopted August 19,1958, effective October 19, 1958, as amended. Section 3. That the terms and provisions of this ordinance shall be deemed to be severable, and that if the validity of the zoning affecting any portion of the property described herein- above shall be declared to be invalid, the same shall not affect the validity of the zoning of the balance of the pro-- perty described herein. Section 4. That any person or corporation violating any of the terms and provisions of this ordinance shall be subject.to the same penalties provided for in the said Chapter 42 of the Code of Ordinances of Beaumont, Texas.
