ORDINANCE NO. 73-26
ENTITLED AN ORDINANCE AMENDING CHAPTER 12A,
SECTION 12A -5(e)(2); PROVIDING A PERIOD OF
TWENTY (20) DAYS PRIOR TO POSTING OF NOTICE
TO VACATE WITHIN WHICH PERIOD OF TIME THE
OWNER MAY APPEAL THE PROPOSED NOTICE TO
VACATE TO THE HOUSING BOARD OF APPEALS; PRO-
VIDING FOR A NOTICE TO VACATE AND ITS CONTENTS;
PROVIDING A PENALTY; PROVIDING FOR SEVERABILITY;
AND REPEALING ALL ORDINANCES OR PARTS OF
ORDINANCES IN'CONFLICT THEREWITH.
BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS.
Section 1.
That Chapter 12A, Section 12A -5(e)(2) of the Code of
Ordinances of the City of Beaumont, Texas, is hereby amended
to read as follows:
"Sec. 12A -5(e)(2). Enforcing officer; powers
anduties.
"(2) If satisfactory evidence of action necessary
to abate said violation, or intent to take
such action, has not been presented to the
enforcing officer within fifteen (15) days
from receipt of aforesaid notice, he shall
notify in writing the owner and the occupant
that there is a violation of the provisions
of this ordinance. This notification shall
contain a description of the substandard
dwelling, dwelling units, rooming house, or
rooming units; a statement of particulars
which makes same substandard; and, notification
that the premises will be posted with a notice
to vacate twenty (20) days from and after the
_date of said letter. Within the twenty (20)
day period after notification as provided
herein, and prior to posting notice to vacate
as provided herein, the owner may appeal the
proposed order to vacate to the housing board
of appeals. This appeal is to be made in
writing on a form to be furnished by the
enforcing officer. The notice to vacate shall
contain a statement that the dwelling is sub-
standard, that the dwelling may not be
occupied, and state the specific date, one hundred
twenty (120) days from posting, by which time
said structure is.to be vacated."
Section 2.
That any person who violates any provision of this
ordinance shall, upon conviction, be punished as provided in
Section 1-8 of the Code of Ordinances of Beaumont, Texas.

Section 3.
That if any section, subsection, sentence, clause or
phrase of this ordinance or the application of same to a
particular setof persons or circumstances should for any reason
be held to be invalid, such invalidity shall in no wise affect
the remaining portions of this ordinance, and to that end the
various portions and provisions of this ordinance are declared
to be severable.
Section 4.
That all ordinances and parts of ordinances in conflict
herewith.are hereby repealed.
