ENTITLED AN ORDINANCE ESTABLISHING A PROGRAM
AND POLICY OF RESIDENTIAL STREET PAVING ASSESS-
MENT BY THE CITY OF BEAUMONT, TEXAS; PROVIDING
FOR AVAILABILITY OF ASSESSMENT PAVING; PROVIDING
FOR APPLICATION BY THREE-FOURTHS (3/4) OF THE
PROPERTY OWNERS'AND TWO-THIRDS (2/3) OF TOTAL
PROPERTY FRONTAGE OR THREE-FOURTHS (3/4) OF
TOTAL PROPERTY FRONTAGE AND TWO-THIRDS (2/3)
OF THE PROPERTY OWNERS; PROVIDING FOR ASSESS-
MENT.RATES; PROVIDING FOR CITY PAYMENT FOR ALL
COST OF STORM SEWERS AND APPURTENANCES; PROVID-
ING FOR FINANCING OF STREET ASSESSMENT CERTIFI-
CATES BY THE CITY AND MONTHLY PAYMENTS; PROVID-
ING FOR A SIDE LOT ASSESSMENT PROCEDURE; REPEAL-
ING ALL ORDINANCES AND PARTS OF ORDINANCES IN
CONFLICT HEREWITH.
WHEREAS, The City Council of the City of Beaumont de-
sires to promulgate a residential.street paving assessment
program/policy in order to implement.a workable paving assess-
ment program under which citizens,may obtain assistance from
the City in the paving of residential streets;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF
BEAUMO NT, TEXAS:
Section L

That the following general program and policy of resi-
dential -street paving assessment is hereby adopted by the City
Count il:
A) The paving assessment procedure .is available only
for the improvement of existing residential streets in existing
residential neighborhoods. This program is not designed to aid
subdividers and real estate developers in the construction of
proposed new subdivisions; and the City Council reserves the
right to reject any application; for street assessment paving
participation by the City of Beaumont which it believes does
not satisfy the established requirements. The City Council of
the City of Beaumont must pass upon each application for paving
assessment assistance by the City of Beaumont.
B) Street improvements under this street assessment
policy will be ordered for one of the following reasons:
1) Upon application executed by three-fourths (3/4)
or more of'the property owners and two-thirds (2/3) or more of
the total property frontage of a proposed project or applica-
tion executed by three-fourths (3/4) or more of the total pro-
perty frontage and two-thirds (2/3) or more of the property
owners of any proposed project-.
2) If a.public need exists for such improvements.
3) If improvements are needed to eliminate exces-
sive maintenance costs.
C) Assessment rates are hereby set on 26 foot wide
paving only as follows:
l) $6.00 per front foot if prepayment of total cost
in one lump sum is made and assessment proceedings are not
necessary.
2) $10.00 per front foot if assessment proceedings
are necessary.
D) City will pay all costs of storm sewer and appur-
tenances.
E) Financing of street assessment certificates will
be handled by the City tax office and monthly installments in
an amount equal to not less than $10.00 for each fifty feet

(50') of property frontage will be accepted.
F) Assessment certificates shall bear interest at
six per cent (6%) per annum.
G) Paving of sides of lots will be charged at three-
fourths (3/4) the rate set out herein for front footage. The
side of a lot is defined as that portion of a.lot that does
not face the street upon which that lot is addressed.
Section 2.
All ordinances or parts of ordinances in conflict here-
with are repealed to the extent of the conflict if any.
