HomeMy WebLinkAboutORD 73-71ORDINANCE NO. 73-71 ENTITLED AN ORDINANCE AMENDING CHAPTER 42 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, BY CHANGING THE CLASSIFICATION OF Two (2) TRACTS OF LAND AS FOL- LOWS: TRACT NO. 1 CONTAINING 34.75 ACRES OF LAND, MORE OR LESS, OUT OF THE W. B. DYCHES SURVEY IN BEAUMONT, JEFFERSON COUNTY, TEXAS, PRESENTLY ZONED "R-1" TO "R-2"; TRACT NO. 2 CONTAINING 4.862 ACRES OF LAND, MORE OR LESS, OUT OF THE W. B. DYCHES SURVEY IN BEAUMONT, JEFFERSON COUNTY, TEXAS, PRE- SENTLY ZONED "R-1" TO "R-2"; PROVIDING FOR SEVERA- BILITY; AND PROVIDING A PENALTY. BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS: Section 1. THAT Chapter 42 of the Code of Ordinances of Beaumont, Texas, and in particular the boundaries of the zoning districts as indicated upon the Zoning Map of The City of Beaumont, referred to in Section 42-9 thereof, is hereby amended by changing the zone classification of the following described tracts of land, presently zoned "R-1", Single Family Dwelling District-, to "R-211, Two Family and Multiple Dwelling District, to -wit: TRACT NO. 1: BEING a 34.75 acre tract of land out of the W. B. Dyches Survey in Beaumont, Jefferson County, Texas and being more particularly described by metes and bounds as follows: FOR LOCATIVE CORNER, begin at an iron stake in the North right-of-way line of the Lower Neches Valley Authority canal and in the South line of the Gusman et al tract of land and in the East line of the now abandoned T & NO Railroad right-of-way line; THENCE North 34 degrees 07 minutes 30 seconds East(N34007130" E) with the North line of said canal 594.68 feet to an iron stake locat- ing the Southeast and beginning corner of the tract of land herein described; THENCE North 88 degrees 53 minutes 49 seconds West (N 880531491.' W) 578.52 feet to an iron stake; l 2- 4-1973 THENCE South 48 degrees 31 minutes 30 seconds West (S 48031130" W) 27.5 feet to an iron stake locating the Southeast corner of a 1.23 acre tract of land that the zoning was previously changed; THENCE North 41 degrees 28 minutes 30 seconds West (N 41028'30" W) 773.82 feet to an iron stake; THENCE South 62 degrees 48 minutes West (S 62048' W) 74.80 feet to an iron stake in the East line of the now abandoned T & NO Railroad right-of-way; THENCE North 41 degrees 28 minutes 30 seconds West (N 41028'30" W) with said East line 680.95 feet to a stake on the North side of the City Service Pipe- line Company right-of-way; THENCE South 89 degrees 29 minutes 30 seconds East (S 89029130" E) parallel to and North of said pipe- line right-of-way.line 2277.66 feet to the North -most right-of-way line of the Lower Neches Valley Canal; THENCE South 34 degrees 07 minutes 30 seconds West (S 34007130" W) with said canal right-of-way line 1205.24 feet to the PLACE OF. BEGINNING containing 34.75 acres of land. TRACT NO. 2: BEING a 4.862 acre tract of land out of the French' Land in the W. B. Dyches Survey in Beaumont, Jeffer- son County, Texas and being more particularly described by metes and bounds as:.follows: BEGINNING at a point in a drainage ditch locating the Southmost Southwest corner of the 25.537 acre tract of land heretofore conveyed by the Jefferson Amusement Company to H. K. Maxey and also locating the Southwest corner of a 1.23 acre tract of land conveyed by H. K. Maxey to the Suburban Acres Group and the Southwest.and the beginning corner of the tract of land herein described; THENCE North 41 degrees 28 minutes 30 seconds West (N 41028'30" W) with a West line of said 25.537 acres and the West line of the now abandoned T & NO Railroad right-of-way 545 feet t -o an iron -stake for corner; THENCE North 48 degrees.3l, minutes 30 seconds East (N 48031130" E),200 feet to an iron stake for corner; THENCE South 88 degrees 53 minutes 49 seconds East (S 88053149" E) 578.52 feet to an iron stake in the Northmost line of a 100 foot width right-of-way here- tofore conveyed to the Lower Neches Valley Authority; THENCE South 34 degrees 07 minutes 30 seconds West (S 34007'30" W) with said line and with the center line of a drainage ditch and with the center line of a 40 foot width drainage easement 594.68 feet; THENCE South 42 degrees 02 minutes West (S 42002' W) with said,line and with said easement 50.32 feet to the PLACE OF BEGINNING containing 4.862 acres of land, -2- C.6, 73-7 ! and the official zoning map of The City of Beaumont is hereby amended to reflect such changes. Section 2. That in all other respects the use of the property here- inabove described shall be subject to all of the applicable regulations contained in Chapter 42 of the Code of Ordinances of Beaumont, Texas, adopted August 19, 1958, effective October 19, 1958, as amended. Section 3. That the terms and provisions of this ordinance shall be deemed to be severable, and that if the validity of the zoning affecting any portion of the property herein described above shall be declared to be invalid, the same shall not affect the validity of the zoning of the balance of the herein described property. Section 4. ,That any person or corporation violating any of the terms and provisions of this ordinance shall be subject to the same penalties provided for in said Chapter 42 of the Code of Ordinances of Beaumont, Texas.
