ENTITLED AN ORDINANCE AUTHORIZING PUBLICATION OF NOTICE OF INTENTION TO ISSUE
CERTIFICATES OF OBLIGATION
WHEREAS, the City Council of the City of Beaumont, Texas, has heretofore
found and determined that it was necessary and desirable for said City to con-
struct public works for said City, to -wit; the construction of improvements
to the City's sanitary sewer system, said improvements to be accomplished through
awarding contracts II, IIIA through Ill -I, inclusive, all as set forth in the
contract documents prepared by Schaumburg & Polk, Inc., consulting engineers
("Engineers"), Beaumont, Texas, dated July, 1973, revised October, 1973; and,
WHEREAS, said Council has heretofore advertised for bids on said con-
tracts and gave notice of the time, place, when and where such contracts would
be let, such notice having been published once a week for two consecutive weeks
in a newspaper as defined in Article 28a, V.T.C.S., of general circulation in
the City of Beaumont, the date of the first publication having been fourteen
(14) days prior to the date set for the receipt of bids, and said notice speci-
fied that plans and specifications for the work to be done were on file with
the City Clerk at the City Hall where they could be examined without charge;
and,
WHEREAS, bids were received by said Council on November 20, 1973, and
referred to bids to said Engineers for tabulation and recommendations; and,
WHEREAS, the Engineers have tabulated all bids relating to the forego-
ing contracts as follows:

WHEREAS, the contract documents permitted the bidders to tie their bids
for the purpose of offering a discount if awarded all contracts; and,
WHEREAS, Holloway Sand & Gravel Company, Inc., offered to deduct twelve
(12%) per cent from all unit prices if awarded all contracts; and,
WHEREAS, the City Council hereby affirmatively finds and determines as
follows:
With the twelve (12%) per cent reduction offered by Holloway Sand &
Gravel Company, Inc., it is the lowest responsible bidder over-all and each of
its bids in all ways meets the specification set forth in the notice to bidders,
and the acceptance of all of its bids is in the best interest of the City; and,
WHEREAS, the total cost of the sanitary sewer project (the "Project"),
designated as Federal Water Pollution Control Administration Project No. WPC-
TEX-975, Contracts II and III (A through 1), is now estimated to be as follows:

WHEREAS, the City Council has the following funds available to pay the
costs of the sewer project:
Proceeds from bonds to be sold $ 1,000,000
Federal Grant Moneys $ 7,208,857
Other Available Funds $ 608,974

WHEREAS, the City Council deems it essential to the public health and
welfare of the present and future inhabitants of the City of Beaumont and hereby
declares that there is an urgent public necessity for the Project to be completed,
so that the City will be assured of proper sanitary sewer service; and,
WHEREAS, Article 2368a.1, Section 7(8), V.T.C.S., authorizes the City
to issue certificates of obligation to cover the deficiency in any public works
project where an advertisement for bids has been previously published for the
Project but the available current funds or bond funds are not adequate to permit
the awarding of the contract; and,
WHEREAS, the City desires to issue and sell for cash not to exceed
$2,093,450 certificates of obligation to cover the deficiency in needed funds
to carry out and complete the Project, said amount not being in excess of twenty-
five (25%) per cent of the amount of those funds committed to the project at
the time the advertisement for bids was published; and,
WHEREAS, said Article 2368a.1 requires that the City Council give notice
of its intention to issue such certificates; therefore
BE IT ORDAINED BY THE CITY OF BEAUMONT:
Section I. That the facts and recitations contained in the preamble
of this ordinance are hereby found and declared to be true and correct,
Section 2. 'That the City Clerk is hereby authorized and directed to
cause to be published in the manner required by law a notice of intention to
issue certificates of obligation in substantially the following form:
NOTICE OF INTENTION TO ISSUE CERTIFICATES OF OBLIGATION
NOTICE IS HEREBY GIVEN that the City Council of the City of Beaumont,
Texas, will meet in the City Hall, Beaumont, Texas, at ten (10:00) o'clock A.M.
on December 18, 1973, to adopt an' -ordinance authorizing the issuance of said
City's certificates of obligation, payable from ad valorem taxation, in the
maximum amount of $2,093,450, bearing interest at a rate notin excess of that
prescribed by Article 717k-2, V.T.C.S,, as amended, and maturing over a period
of years.not to exceed forty C401 years from the date thereof, Said certificates
are to be issued for the purpose of evidencing the indebtedness of said City

for paying a part of the cost of constructing public works for said City, to -
wit: the construction of improvements to the City's sanitary sewer system.

November, 1973.

Section 3, That the notice set forth in Section 2 shall be published
once a week for two consecutive weeks in a newspaper of general circulation in
the City of Beaumont, Texas, the date of the first publication to be not less
than fourteen (14) days prior to the date tentatively set out in said notice
for the passage of the ordinance authorizing the issuance of the certificates .
mentioned in said notice.
Section 4, That the Mayor, City Clerk and other officers of the City
are hereby authorized and directed to do any and all things necessary and de-
sirable to carry out the provisions of this ordinance.
