HomeMy WebLinkAboutORD 10 GGENTITLED AN ORDINANCE AMENDING CHAPTER 42 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF THE CODE OF ORDINANCES OF BEAU-- MONT, TEXAS, BY CHANGING THE CLASSIFICATION OF LOT 1, UNIT "C" OF TYRRELL PARK ADDITION TO THE CITY OF BEAU- MONT, JEFFERSON COUNTY, TEXAS,.AS DESCRIBED HEREIN, PRESENTLY ZONED ttR--ltt, T.0 "C--111; AND BY CHANGING THE CLASSIFICATION OF TRACTS.A AND B, BLOCK THREE (3) OF FRENCH HEIGHTS SUBDIVISION IN THE CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS, AS DESCRIBED HEREIN, PRESENTLY ZONED "R--311 AND "R-ltt, RESPECTIVELY, TO "C -11t; PROVID- ING FOR SEVERABILITY; AND PROVIDING A PENALTY. BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS: Section 1. That Chapter 42 of the Code of Ordinances of Beaumont, Texas, and in particular the boundaries of the zoning districts as indicated upon the Zoning Map of The City of Beaumont, referred to in Section 42--9 thereof, is hereby amended by changing the zoning classification of the following described property, presently zoned ttR--111, Single -- Family Dwelling District, to ttC-111, Neighborhood Commercial District, t o wit : Being Lot 1, Unit ttCtt, Tyrrell Park Addition, City of Beaumont, Texas, fronting 1,029 feet on Fannett Road and 180 feet each on Seale Road and Phelps Road, containing 4.252 acres, more or less; and including one half of all bounding streets; and by changing the zoning classification of the following described property, being two (2) tracts of land, designated Tract A and Tract B, in Block No. 3 of French Heights Subdivision, in the A. Williams Survey, Beaumont, Jefferson County, Texas, and including one half of all bounding streets; Tract A being presently zoned 11R-3", Modified Two -Family and Multiple Dwelling District, and Tract B being present- ly zoned ttR--1, Single -Family Dwelling District, to ttC-111, Neighbor- hood Com-nercial District, to wit: TRACT A. Being a 1.148"acre tract of land, and being a portion of Lot No. 28 of Block No. 3 of French Heights Subdivision, fronting 200 feet on the North-- east side of Concord Road and extending to a depth t_o the Northeast of 250 feet; described as follows: of Concord Road; THENCE N. 370 001 E. along common lot line of Lots Nos. 28 and 5, for a distance of 250 feet; THENCE N. 51015t W. parallel with Concord Road for a distance of .200 feet; THENCE S. 370 001 W. along common lot line of Lots Nos. 28 and 27 for a distance of 250 feet to point in Northeast line of Concord Road; THENCE S. 510 151 E. along Northeast line of Concord Road for a distance of 200.feet to place of beginning; TRACT B. Being a 1.102« -acre tract of land, and being a portion of Lot No. 5 of Block No. 3 of French Heights Subdivision, fronting 200 feet on the Northeast side of Concord Road and extending to a depth to the North- east of 240 feet; described as follows: BEGINNING at the Southmost corner of Lot No. 5 in the Northeast line of Concord Road; THENCE N. 37° 001 E. along common lot line of Lots Nos. 5 and 4 -for a distance of 240 feet; THENCE N. 510 15t'W. parallel with Concord Road for a distance of 200 feet; THENCE S. 370 001 W. along common lot line of Lots Nos. 5 and 28 for a distance of 240 feet to point in the Northeast line of Concord Road; THENCE S. 510 151 E. along Northeast line of Concord Road for a distance of 200 feet to the place of begin=- ning; and the official Zoning Map of The City of Beaumont is hereby amended to reflect such changes. Section 2. That in all other respects the use of the property herein- above described shall be subject to all of the applicable regulations contained in Chapter 42 of the Code of Ordinances of Beaumont, Texas, adopted August 19, 1958, effective October 19, 1958, as amended. Section 3. That the terms and provisions of this ordinance shall be deemed to be severable, and that if the validity of the zoning affect- ing any portion of the property described hereinabove shall be declared to be invalid, the same shall not affect the validity of the zoning of the balance of the property described herein. Section 4. That any person or corporation violating any of the terms and provisions of this ordinance shall be subject to the same penalties provided for in the said Chapter 42 of the Code of Ordinances of Beaumont, Texas.
