HomeMy WebLinkAboutORD 35 GGENTITLED AN ORDINANCE AMENDING CHAPTER 37 OF THE CODE OF ORDINANCES OF BEA.UMONT, TEXAS, BY AMENDING SECTION 37.,2; AND BY ADDING NEW SECTIONS TO BE NUMBERED 37 -8.2 -AND 37-8.3; PROVIDING FOR THE REGU- LATING OF MAXIMUM AXLE LOAD LIMITS FOR VEHICLES USING CITY STREETS; CONTAINING DEFINITIONS; PROVID- ING FOR PERMITS; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; PROVIDING A PEN_ A� LTY; AND PROVIDING FOR SEVERABILITY. BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS: Section 1. That the present Section 37-2 of the Code of Ordinances of Beaumont, Texas, is amended to add an additional definition, as follows: 'tSec. 37-2. Terms used herein. "(43) Axle load. An axle load shall be defined as the total load transmitted to the road by all wheels whose centers may be included between two parallel transverse vertical planes 40 inches apart, extending across the full width of the vehicle. St Section 2. That the Code of Ordinances of Beaumont, Texas, is hereby amended by adding a new section 37-•8.2, said section to read as follows: "Sec. 378.2. Authority of traffic engineer to designate load restrictions for vehicles using streets. ItThe city traffic engineer is hereby authorized to determine and fix the maximum axle loads of all vehicles to be operated over, on, or upon the streets within the corporate limits of The City of Beaumont, taking into consideration the width, condition and type of pavement structures, and other circumstances on such street. "Such maximum axle load shall become effective and operative on said streets within The City of Beau- mont when appropriate signs, giving notice thereof, are erected by or under the order of the city traf- fie engineer, and it shall be unlawful for any per- son to drive, operate or move, or for the owner to cause or permit to be driven, operated, or moved, of vehicles which in any respect exceeds the maxi- mum axle loads designated by said signs. "Provided, however, that any person desiring to oper- ate or move a vehicle on said streets in excess of the maximum axle loads established by the city traf- fic engineer, shall first obtain a special permit from the city traffic engineer and such permit -shall not be issued unless reasonably necessary. "Any person moving or causing to be moved a load as set out in said permit, shall be liable to the city for any damage done by any such vehicle to the streets, bridges, or culverts in the city and the acceptance of the aforesaid permit shall be conclu- sive evidence that the person to whom such permit is issued agrees to pay all such damages upon demand thereof made by the city . tt Section 3. That the Code of Ordinances of Beaumont, Texas, is hereby amended by adding a new section 37.-8.3, said section to read as follows: ttSec. 378.3. Interference with signs. "No person shall without lawful authority attempt to or in fact alter, deface, injure, knock down, or remove any sign posted as provided in this chapter . tt. Section 4. All ordinances and parts of ordinances in conflict herewith are hereby repealed. Section $. Any person convicted of a violation of any of the provis- ions of this ordinance shall be punished as provided in Section 1--8 of the Code of Ordinances of Beaumont, Texas. Section 6. That if any section, subsection3 8entence� phrase or clause of this ordinance, or.the application of same to a particular set of persons or circumstances, should for any reason be held invalid, such invalidity shall in no wise affect the remaining portions of this ordinance, and to such end various portions and provisions of this ordinance are declared to be severable..
