ORDINANCE NO.
-ENTITLED AN ORDINANCE AMENDING CHAPTER 42 OF THE
CODE OF ORDINANCES OF BEAUMONT, TEXAS,,AND IN PAR--
TICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS
INDICATED UPON THE ZONING MAP OF THE CODE OF ORDI-
NANCES OF BEAUMONT, TEXAS, BY CHANGING THE CLASSI'
FICATION OF A 22.059 -ACRE TRACT OF LAND FRONTING
D_OWLEN ROAD AND APPROXIMATELY 290 FEET NORTH OF
PRUTZMAN ROAD; IN THE CITY OF BEAUMONT, JEFFERSON
COUNTY,.TEXAS,,AS DESCRIBED HEREIN, PRESENTLY ZONED
11R --1_A11• TO 11R-211; PROVIDING FOR SEVERABILITY; AND
PROVIDING A PENALTY.
BE IT ORDAINED BY THE CITY -OF BEAUMONT,.TEXAS:
Section 1.
That Chapter 42 of the Code of Ordinances of Beaumont,
Texas, and in particular the boundaries of the zoning districts
as indicated upon the Zoning Map of'The City of Beaumont, referred
to in Section 42-.9 thereof, is hereby amended by changing the
zoning classification of the following described tract of land,
presently zoned 1tR--1 -A11, Single --Family Residential District, to
11R_2f1, Two -Family and Multiple Dwelling District, to wit:
BEGINNING at an iron pin in the west line of Dowlen
Road, said iron pin being the southeast corner of
the herein described tract of land and the northeast
corner of a ten (10.00) -acre tract of land conveyed
to W. B. Phares and Beckworth, Inc. by deed from the
Estate of Margaret Smith Prutzman, said deed being
dated April 25, 1966, and filed in Volume 1465, Page
258 of the Deed Records of Jefferson County, Texas;
THENCE South eighty --nine degrees eleven minutes
zero seconds West (S. 890 llt 00i1 W.) at a distance
of eleven hundred twenty-one and seventy --two one -
hundredths (1121.'721) .feet pass the- northwest ;corner
of said W. B. Phares, et al, 10 -acre tract and con-
tinuing along said course for a total distance of
twelve hundred eighty. -nine and three one -hundredths
(1289.031) feet to the southwest corner of the herein
described tract of land;
THENCE with the west line of the herein described
tract of land North zero degrees twenty-eight minutes
thirty seconds East (N..000 28t 3011 E.) for a distance
of three hundred fifty and seventy one --hundredths
(350.70t) feet to a point for corner;

THENCE continuing with the west line of the herein
described tract of land -North zero degrees forty-
one minutes zero seconds .West (N. 000 41t 0011 W.)
at a distance of one hundred sixty- seven and fifty-
two one -hundredths (167.521) feet pass the southerly
right--of--way line of Keith Ditch, a sixty foot wide
drainage ditch; at two hundred.forty«-one and thirty-
four one -.hundredths (241.341),feet pass the north"
erly right -of --way line of said Keith Ditch, and
continuing along said west line of the herein de-
scribed tract of land for a total distance of three
hundred ninety. -seven and fifty --two one hundredths
(397.524) feet to a concrete monument for the north--
west corner;
TIIENCE with the north line of the herein described
tract of land North eighty-nine degrees twenty --six
minutes zero seconds :East '(N. 890 261 0011 E.) at
two hundred seventeen and twenty --nine one -hundredths
(217.291)feet .pass the westerly line of Keith ditch,
a sixty foot wide (601) drainage ditch, continuing
along said course at three hundred twenty (320.001)
feet pass the easterly line of said Keith Ditch and
continuing along said course for a total distance of
twelve hundred ninety-three and eight one -hundredths
(1293.081) feet to a concrete monument in the west
line of Dowlen Road, a sixty (60t)foot wide street
right of way, for the northeast corner of the herein
described tract of land;
THENCE with the west line of Dowlen Road South zero
degrees ten minutes thirty seconds West (S. 000 101
3011 W.) for a distance of seven hundred forty-two
and sixty -.seven one -.hundredths (742.671) feet to the
place of beginning, containing in area 22.059 acres
of land, more or less;
and the official Zoning Map of The City of Beaumont is hereby
amended to reflect such changes.
Section 2.
That in all other respects the use of the property herein --
above described.shall be subject to all of the applicable regula-
tions contained in Chapter 42 of the Code of Ordinances of Beaumont,
Texas, adopted August 19, 1958, effective October 19, 1958, as
amended.
Section 3.
That the terms and provisions of this ordinance shall be
deemed to be severable, and that if the validity of the zoning af-
fecting any portion of the property described hereinabove shall be

declared to be invalid, the same shall not affect the validity of
the zoning of the balance of the property described herein.
:Section ¢.
That any person or corporation violating any of the terms
and provisions of this ordinance shall be subject to the same pen-
alties provided for in the said Chapter 42 of the Code of Ordinan-
ces of Beaumont, Texas.
