ENTITLED AN ORDINANCE AMENDING CHAPTER 42 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF THE CODE OF ORDINANCES SOF BEAUMONT, TEXAS, BY CHANGING THE C.LASSIFICATI.ON OF TWO TRACTS OF NAND SITUATED IN THE F.. BIGN'ER SURVEY IN THE CITY OF BEAUMONT, JEFFERSON:COUNTY,.TEXAS, AS DESCRIBED HEREIN, PRESENTLY ZONED "R-111 TO "C•-111; PROVIDING FOR SEVERABILITY; AND PROVIDING A PENALTY. BE IT ORDAINED BY THE CITY OF BEA;UMONT,TEXAS: Section 1. That Chapter 42.of the Code of Ordinances of Beaumont, Texas, and in particular the boundaries of the zoning districts as indicated upon the Zoning Map of The City of Beaumont, referred to in Section 42.-9 thereof, is hereby amended by changing the zoning classification of the following described tracts of land, presently zoned,"R-1", Single Family Dwelling District, to ttC-lit, Neighborhood Commercial District, to wit: TuArT 7. BEING an 0.051 acre tract of land out of -the Ray- mond Crow 55 --acre tract, F. Bigner Survey, Beaumont, Jefferson County, Texas,.described as follows, to wit: BEGINNING at a point in the southerly right. -of --way line of Freeway Highways Nos. 69,and 96, from which point the northwest corner of the Raymond Crow 55 -- acre tract bears N. 60° 551 W. 19.001 and N. 49° 43t 3011 W. 219.421 and N. 0`421 421 301" W. 599.761 , and from which point the intersection of the West line of Crow Road with the southerly right-of-way line of said Freeway bears S. 600 551=E.. 313.491, and which point is the Northwest corner of the tract of land herein described, an iron pin for corner; THENCE S. 60° 551 E• 277.491 along a portion of the southerly right-of-way line of said Freeway to the most easterly corner of the tract of land herein de- scribed, an iron pin for corner; THENCE S. 890 301 W. 322.961 to the most westerly corner of the tract of land herein described, an iron pin for corner; THENCE N. 30° 181 E., 159.451 to the PLACE OF BEGIN-- NING. TR &CT TT That certain tract, piece or parcel of land lying and being situated in the F. Bigner Survey in Jef- ferson County, Texas, and being more particularly described as follows: - The north one --half (N. 1/2) of that certain 2.1 - acre tract of.land conveyed by Raymond Grow, et ux to Raymond Irving Blythe, et ux, by deed dated Novem- ber 29., 1943, recorded in Vol. 545; page 359, Deed Records of_Jefferson County, Texas, and BEGINNING at the northwest corner of said 2.1 --acre tract; THENCE south 101.75 feet to the northwest corner of a tract of landconveyed to John B. Grunstrom by Raymond Grow, et ux, by.deed.dated March 6, 1943; THENCE East with Grunstromt s north line -447.8 feet to corner on road; THENCE North 00 301 West with said road 101.%5 feet to the northeast corner of said 2..1 --acre tract; THENCE West with the north line of said 2.1 --acre tract 449.5 feet to Place of Beginning, containing 1.05 acres of land, more or less; SAVE AND EXCEPT that portion of the above described tract which was conveyed to the State of Texas by L. Bellamy, et ux, by,deed dated August 14, 1959, recorded in Vol. 1182, page 39, Deed Records, Jefferson County, Texas, and one half of the abutting street right of way; and the official zoning map of The City of Beaumont is hereby amended to reflect such changes. Section 2. That in all other respects the use of the property here- inabove described shall be subject to all of the applicable regulations contained in Chapter 42 of the Code of Ordinances of Beaumont, Texas, adopted August 19, 1958, effective October 19, 1958, as amended. Section 3. That.the terms and provisions of this ordinance shall be deemed to be severable, and that if the validity of the zoning a affecting any portion of the property described hereinabove. --,Shall be declared to be invalid, the same shall not affect the validity of the zoning of the balance of the property described herein. Section 4. That any person or corporation violating any of the terms and provisions of this ordinance shall be subject to the same penalties provided for in the said Chapter 42 of the Code of Ordi- nances of Beaumont, Texas.
