ENTITLED AN ORDINANCE AMENDING CHAPTER 42 .OF THE
CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND.IN
PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS
AS INDICATED UPON:THE ZONING MAP OF THE CODE OF
ORDINANCES OF BEAUMONT,.TEXAS, BY CHANGING THE
CLASSIFICATION OF A TRACT OF LAND SITUATED SOUTH
OF CARDINAL DRIVE (LOOP 251) AND EAST OF-HAGNER
12OAD, IN THE CITY.OF BEAUMONT, JEFFERSON COUNTY,
TEXAS, AS DESCRIBED HEREIN, PRESENTLY ZONED,"R-3"
TO "C-211; PROVIDING. FOR SEVERABILITY; AND PROVIDING
A PENALTY.
BE-IT.ORDAINED BY THE CITY OF BEAUMONT, TEXAS.
Section 1'. -
That Chapter 42 of the Code of Ordinances of Beaumont, Texas,
and in particular the boundaries of the zoning districts as indicated
upon the Zoning Map of The City of Beaumont, referred to in Section
42-9 thereof, is hereby amended.by changing the zoning classification
of the following described tract of land, presently zoned "R-3"51
Modified Two -Family and Multiple -Dwelling District to "C-2", Central
Commercial District, to wit:
BEING a part of and out of Lot 104 ofthe Gladys City
Lands in the John.A. Veatch -.Survey, Abstract'No. 55 as
recorded in the map or plat record of Jefferson County
Texas, and part.of and out of Lot 1.03 of the Gladys City
Oil, Gas and Manufacturing Company Subdivision of the
John A. Veatch Survey, Abstract No. 55 as awarded to
Emma E. Teeters in partition deed dated August 3, 1955,
and recorded in Volume 989, at page 129 of the Deed
Records of -Jefferson County, Texas, and containing
2.750 -acres of land more or less, said land being
situated South of.Loop 251 (Cardinal Drive) and being
more particularly described,as follows:
BEGINNING at a concrete monument which marks the inter-
section of the south right of way line of Loop 251
(Cardinal Drive) and,the east right of way line of
Hagner Road;
THENCE South 70055' East along the south right of way line
of Loop 251 (Cardinal Drive) for a distance of 63.90 feet
to an iron 'pin for corner, said point being on the south
right of way line of.Loop 251 (Cardinal Drive);
THENCE South 70055' East along the south right of way line
for Loop 251 (Cardinal Drive) for a distance of 366.87 feet
to a point for corner, said point being on the south right
of way line of Loop 251 (Cardinal Drive);'
THENCE South 64022' East along the south right of way line
of Loop 251 (Cardinal Drive) for a distance.of 250.81 feet
to a point for corner, said point being on the south right
of way line of Loop 251.(Cardinal Drive);
THENCE South 62025' West for a distance of 444.95 feet to
a point forcorner, said point being on the most easterly
right of way line of Hagner Road;
THENCE North.27035.' West along the most easterly right of
way line of Hagner Road fora distance of 40.3 feet to
a point, said point lying on the most easterly right of
way line of Hagner Road;
THENCE North 27040' West along the most easterly right of
way line of Hagner Road,.46.2 feet, to the.place of beginning,
said tract containing 2.750' acres, more or less, and,one
half of the abutting street right of way..
and the official zoning map of,The City of Beaumont is hereby
amended to reflect such changes.
Section 2.
That in all other respects the use of the property hereinabove
described shall be subject to all of the applicable regulations
contained in Chapter 42 of the Code. of. Ordinances of Beaumont,
Texas, adopted -August 19, 1958,,effective,October 19, 1958, as
amended.
Section 3.
That the terms and provisions of this ordinance shall be
deemed to be severable, and that if the validity of the zoning
affecting any portion of the property described hereinabove shall
be declared to be invalid, the same shall not affect the validity
of the zoning of the balance of the property described herein.
Section 4.
That any person or corporation violating any of the terms
and provisions of this ordinance shall be subject to the same
penalties provided for in the said Chapter 42 of the Code of
Ordinances of Beaumont, Texas
