ENTITLED AN ORDINANCE AMENDING CHAPTER 42 OF THE
CODE OF. ORDINANCES OF BEAUMONT, TEXAS, AND IN
PARTICULAR THE BOUNDARIES OF THE ZONING,DISTRICTS
AS INDICATED UPON THE ZONING MAP OF THE CITY OF
BEAUMONT, TEXAS, BY CHANGING THE CLASSIFICATION
OF A TRACT OF LAND, IN THE CITY OF BEAUMONT,
JEFFERSON COUNTY TEXAS, AS DESCRIBED HEREIN,
PRESENTLY ZONED �'R-2" TO "C -l'; PROVIDING FOR
SEVERABILITY; AND PROVIDING A PENALTY.
BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS.
Section 1.
That Chapter 42 of the Code of Ordinances of Beaumont, Texas,
and in particular the boundaries of the zoning district as indicated
upon the Zoning Map of The City of Beaumont, referred to in Section
42-9 thereof, is hereby amended by changing the zoning classification
of the following described tract of land, presently zoned "R-2",
Two Family and Multiple Dwelling District, to "C-1", Neighborhood
Commercial District, to wit:
All"that certain tract or parcel of land out of a
certain 5 38/100 acre tract sold to David Bean.by
Daniel Lewis by Deed dated December 9, 1897, recorded
in Vol. 22,.page 89, Deed Records of Jefferson County,
Texas; same being out of the A. Williams Survey and
beginning at a point on the west side of Magnolia
Avenue 30 feet North of the south line of Magnolia
Avenue for corner;
THENCE Northward 210 feet along the west line of Magnolia
Avenue for corner;
THENCE Westward parallel with Gill Street for a distance
of 453.7 feet or a sufficient length to enclose two
acres for corner;
THENCE Southward along a line parallel with Magnolia Avenue
210 feet to a point in the North right-of-way line of
Gill Street for corner;
THENCE Eastward along a line parallel with the north line
of said tract for a distance of 453.7 feet, plus or minus,
to the place of beginning, said tract containing -two acres,
plus or minus, save and except the front (East) 150
feet in depth of said property fronting on Magnolia
Avenue; and one-half of the abutting street right-of-way.
and the official Zoning Map of The City of Beaumont is hereby
amended to reflect such changes.

That in all other respects the use of the property hereinabove
described shall be subject to all of the applicable regulations
contained in Chapter 42 of the Code of Ordinances of Beaumont, Texas,
adopted August 19, 1968, effective October 19, 1958, as amended.
That the --terms and provisions of.this ordinance shall be deemed
to be severable, and that if the validity of the zoning affecting
any portion of the property described hereinabove shall be declared
to be invalid, the same shall not affect the validity of the zoning
of the balance of the property described herein.
Section 4.
That any person or corporation violating any of the terms and
provisions of this ordinance shall be subject to the same penalties
provided for in the said Chapter 42 6f the Code of Ordinances of
Beaumont, Texas.
