HomeMy WebLinkAboutORD 84 I IORDINANCE NO.(0�-- ENTITLED AN ORDINANCE AMENDING CHAPTER 10 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, BY AMENDING SECTION 10-2 PROVIDING FOR THE COLLECTION OF CERTAIN COSTS IN CORPORATION COURT; SECTION 10-6 PROVIDING FOR A FIVE DOLLAR CREDIT PER DAY FOR TIME SERVED BY PRISIONERS IN THE CITY JAIL; REPEALING SEC- TIONS 10-3 AND 10-4; PROVIDING A PENALTY; PROVIDING FOR SEVERABILITY; AND REPEALING ALL ORDINANCES IN CONFLICT HEREWITH., BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS: 1. That Section 10-2 of the Code of Ordinances of Beaumont, Texas, is hereby amended to read as follows: Section 10-2. Costs—Corporation Court. The following costs shall be taxed against the de- fendant and collected by the Clerk of the Corporation Court: (a) A warrant fee of $7.50 shall be collected in the Corporation Court in any case where a warrant of arrest is issued and served after due notice as prescribed by Article 45.06 of Vernon's Annotated Code of Criminal Procedure. (b) If the defendant is convicted in a criminal action tried by a jury in the Corporation Court, a jury fee of $3.00 shall be collected from the defendant. No other costs shall be collected unless expressly authorized by State Law. 0 That Section 10-6 of the Code of Ordinances of Beaumont, Texas, is hereby amended to read as follows: Section 10-6. Imprisonment or work on noppayment Mine and costs—Required, credit for labor. When a defendant is convicted of a misdemeanor in the corporation court of the city and his punish- ment is assessed at a pecuniary fine, if he is unable to pay the fine and costs adjudged against him, he may for such time as will satisfy the judg- ment be put to work in the workhouse, or the city farm, or streets, alleys, or other public improve- ments within the city limits, or if there be no such workhouse, farm or improvements, he shall be V'. v imprisoned in the city jail for a sufficient length of time to discharge the full amount of fine and costs adjudged against him, rating such labor or imprisonment at $5.00 for each day thereof. 3. That Sections 10-3 and 10-4 of the Code of Ordinances of Beaumont, Texas, are hereby expressly repealed. 4. That any person who violates any provision of this ordinance shall, upon conviction, be punished as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas. 5. That if any section, subsection, sentence, clause or phrase of this ordinance or the application of same to a particular set of persons or circumstances should for any reason be held to be invalid, such invalidity shall in no wise affect the remaining portions of this ordinance, and to such end the various portions and provisions of this ordinance are declared to be severable.
