HomeMy WebLinkAboutORD 26 I IORDINANCE NO. , r ENTITLED AN ORDINANCE VACATING AND ABANDONING A PORTION OF COLORADO AVENUE BETWEEN CALLAGHAN STREET AND CUNNINGHAM STREET AS MORE PARTICULARLY DESCRIBED HEREIN AND VACATING AND ABANDONING A PORTION OF GEORGIA AVENUE BETWEEN CALLAGHAN STREET AND CUNNINGHAM STREET AS MORE PARTICULARLY DESCRIBED HEREIN; PROVIDING THAT SUCH ABANDONMENTS SHALL IN NO WAY AFFECT CERTAIN EASEMENT FOR GENERAL UTILITY J{ AND DRAINAGE PURPOSES, DATED FEBRUARY 28, 1968) AS SET FORTH HEREIN. WHEREAS, Lamar State College of Technology has requested that that portion of Colorado Avenue lying between Callaghan Street and Cunningham Street, as more particularly described herein, be vacated and abandoned; and, WHEREAS, Lamar State College of Technology has requested that that portion of Georgia Avenue lying between Callaghan Street and Cunningham Street, as more particularly described her be vacated and abandoned; and, WHEREAS, said requests have been referred to the Planning and Zoning Commission of The City of Beaumont for examination and approval, and the same have been approved by said Commission; and, WHEREAS, it appears to the City Council that it is to the best interest of The City of Beaumont and benefit to the public that the hereinafter described portions of Colorado Avenue and Georgia Avenue be vacated and abandoned; NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS: That the -following described portiorsof Colorado Avenue and Georgia Avenue in The City of Beaumont, Texas, be and the same are hereby vacated and abandoned and that title to said portions of said vacated and abandoned streets shall revert to and become the property of the person entitled thereto, as provided by law, said portions being described as follows: and 1 BEING a portion of Colorado Avenue, a sixty (60) foot right of way between Callaghan Street and Cunningham Street and lying in The City of Beaumont, Jefferson County, Texas, and more particularly described as follows: BEGINNING at the southeast corner of the intersection, the most southerly sixty (60) foot right of way line of Colorado Avenue and the most easterly sixty (60) foot right of way line of Cunningham Street, said point being. the same as the northwest corner of Lot 1, Block 3, Lamar Addition to The Cityof Beaumont; THENCE in an easterly direction along.the most southerly right of way line of Colorado Avenue and the.most northerly boundary line of Block 3 of the Lamar Addition to The City of Beaumont, Texas, to a point for corner, said point being ten (10) feet east of the northwest corner of Lot 12, Block 3 of said addition, said point also being 100 feet in a westerly direction from the northwest corner of Lot 1, Block 4, Lamar Addition to The City of Beaumont; THENCE in a northerly direction to a point for corner, said point being ten (10) feet east of the southwest corner of Lot 13, Block 2 of said addition and in the most northerly sixty (60) foot right of way line of Colorado Avenue, said point also being 100 feet in a westerly direction from the southwest corner of Lot 30, Block 1, Lamar Addition to The City of Beaumont; THENCE in a westerly direction along the most northerly right of way line of Colorado Avenue and the most southerly boundary line of Block 2, Lamar Addition to The City of Beaumont, Jefferson County, Texas, to a point for corner, said point being at the intersection of the most easterly sixty (60) foot right of wayline of Cunningham Street and the most northerly sixty (60) foot right of way line of Colorado Avenue, same being the southwest corner of Lot 24, Block 2 of said addition; THENCE in a southerly direction along the most easterly right of way line. of the Cunningham sixty (60) foot right of way to the point of beginning, said point being the northwest corner of Lot 1, Block 3, Lamar Addition to The City of Beaumont, Jefferson County, Texas, containing .771 acres, more or less. Provided, however, that the vacating and abandoning of said portions of said streets shall not be construed as abandoning and shall in no way affect the easement for general utility and drainage purposes granted on February 28, 1968, by Lamar State College of Technology to The.City.of Beaumont across property in the Lamar.Addition to The City of Beaumont, Jefferson County, Texas; the rights granted in said easement for general utility -and drainage purposes being expressly reserved.
