ORDINANCE NO.
ENTITLED AN ORDINANCE AMENDING CHAPTER 42 OF
THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND
IN PARTICULAR THE BOUNDARIES OF THE ZONING
DISTRICTS AS INDICATED UPON THE ZONING MAP OF
THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, BY
CHANGING THE CLASSIFICATION OF A CERTAIN TRACT
OF LAND OUT OF THE ABSOLOM WILLIAMS SURVEY,
BEAUMONT, JEFFERSON COUNTY, TEXAS, AS. DESCRIBED
HEREIN; PRESENTLY ZONED "R-2" AND "C-1" TO
"C-1"; PROVIDING FOR SEVERABILITY; AND PROVIDING
A PENALTY.
BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS:
Section 1.
That Chapter 42 of the Code of Ordinances of Beaumont, Texas,
and in particular the voundaries of the zoning districts,as.
indicated upon -the Zoning Map of The City of Beaumont, referred
to in Section 42-9 thereof, is hereby amended by changing the
zoning classification of the following described tract of land,
presently zoned "'R-2", Two Family and Multiple Dwelling District
and "C-1'1', Neighborhood Commercial -District to "C-1", Neighborhood
Commercial District, to wit:
ALL that certain property situated in Jefferson
County, Texas, described as follows,.to wit:
ALL of that certain tract -or parcel of land, out
of a certain 5-38/100 acre tract sold to David
Bean by Daniel Lewis by deed dated December 9,
1897, recorded in Vol. 22, page 89, Deed Records
of Jefferson County, Texas, and being out of the
Absolom Williams Survey in Jefferson County,
Texas, and being a part of the Daniel Lewis
111 acre tract., more particularly described as
follows, to wit:
BEGINNING at a point on the west side of Magnolia
Avenue 210 feet south from the northeast corner
of the Mollie Bean Tract on the west side of said
Magnolia Avenue;
THENCE West Four Hundred Fifty-three and 7/10 feet
to corner;
THENCE Southward parallel with Magnolia Avenue,
94.6 feet to corner;
THENCE East 453.7 feet to Magnolia Avenue;
THENCE North along said Avenue 92.4 feet to Place
of Beginning; the same being that tract containing
0.9 acres of land on the map of Dave Bean Estate
as prepared by C. B. Daniel, C. E.; in the name
of Hennie Watson; which deed was recorded in Vol.
455, page 303 of the Deed Records of Jefferson
County, Texas, to which reference is made herein
for further and more detailed description of said
property, and one-half of the abutting street right
of .way.
and the official zoning map of The City of Beaumont is hereby
amended to reflect such change.
Section 2.
That in all other respects the use of the property hereinabove
described shall be subject to all of the applicable regulations
contained in Chapter 42 of the Code of Ordinances of Beaumont,
Texas, adopted August 19, 1958, effective October 19, 1958,
as amended.
That the terms and provisions of this ordinance shall be
deemed to be severable, and that if the validity of the zoning
affecting any portion of the property described hereinabove.
shall be declared to be invalid, the same shall not affect the
validity of the zoning of the balance of the property described
herein.
Section 4.
That any person or corporation violating any of the terms and
provisions of this ordinance shall be subject to the same penalties
provided for in the said Chapter 42 of the Code of Ordinances of
Beaumont, Texas.
