HomeMy WebLinkAboutORD 16 I IORDINANCE N0. -- 2,2 ENTITLED AN ORDINANCE ORDERING A SPECIAL ELECTION TO BE HELD IN THE CITY.OF BEAUMONT, TEXAS, -ON THE QUESTION OF THE ADOPTION OF A ONE PERCENT (1%) LOCAL SALES AND USE TAX WITHIN THE CITY; DESIGNATING TEH 13TH DAY OF JANUARY, 1968, AS..THE DAY OF SUCH ELECTION; DESIGNATING THE POLLING PLACES FOR SUCH ELECTION; APPOINTING OFFICERS TO PRESIDE OVER SAID ELECTION; PROVIDING THAT ALL DULY QUALIFIED RESIDENT VOTERS SHALL BE QUALIFIED,TO VOTE; PRESCRIBING THE FORM OF BALLOT FOR SAID ELECTION; PROVIDING FOR NOTICE OF.SAID ELECTION; AND PROVIDING THE MANNER, OF HOLDING SAID ELECTION. WHEREAS, Article 106.6c, Vernon's Texas Civil Statutes (Acts 1967, 60th Legislature, Regular. Session, Chapter 36, Page 62) authorizes the governing body of any city, town or village in Texas to,call an election for the purpose of adopting a local sales and use tax within such city, town or village; NOW, THEREFORE, BE'IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS: Section 1. That a special election shall be held in and throughout the City of Beaumont., Texas, on the 13th day of January, 1968, at which election there shall be submitted to the resident qualified voters of the said The City of Beaumont, for their action thereupon, the following propositions: "FOR adoption of a one percent (1%)' local sales, and use tax within the city." "AGAINST adoption of a one percent (1%) local sales and use tax within the city." Section 2. That said election shall be held in accordance with the Constitution and laws of the State of Texas, and all duly qualified resident voters of The City of Beaumont, Texas, shall be qualified to vote. Section 3. That the Jefferson County Election Precincts heretofore established within The City of Beaumont are hereby combined into municipal election precincts as hereinafter set forth for said election and each qualified voter shall vote in the municipal election precinct of his residence. Mrs. Waldo Abbe, Alternate Presiding Judge The presiding judge for each municipal election precinct shall appoint two clerks and as many additional clerks as he deems necessary for the proper conduct of the election, provided not more than a total of five clerks shall be appointed for any municipal election precinct, who shall be selected from different political parties when practicable. Section 4. That the form of ballot which shall be used in said special election shall comply with the requirements of Article 1066c, Vernon's Texas Civil Statutes and the requirements of the Election Code of the State of Texas and shall be substantially as.follows: OFFICIAL BALLOT INSTRUCTIONS: Place an "XB1 in the square beside the statement indicating the way you wish to vote. FOR adoption of a one percent (1%) local sales and use tax within the city. AGAINST adoption of a one percent (1%) local. sales U and use tax within the city. - 4 - 8l0 L"T A,- . Section 5. That notice of the election hereby ordered and called shall be given: (a)- by publication of the notice hereinafter set forth together with a copy of this ordinance on the same day of two successive weeks in a newspaper of general circulation published W' -within said City of Beaumont, the.date of the first publication to be at least twenty-one (21) days prior to the date set herein for such election; and (b) by posting of such notice together with a copy of this ordinance at the polling place in each of the municipal election precincts of The City of Beaumont not less than twenty (20) days prior to the date set.herein for such election. It is hereby found and determined that the .Beaumont Journal is a newspaper published within The City of Beaumont, Texas, and is a newspaper of general circulation within said City. Said notice shall be in the following form: 4' "NOTICE OF SPECIAL ELECTION "TO THE DULY QUALIFIED RESIDENT VOTERS OF THE CITY OF BEAUMONT, TEXAS, A1\D TO ALL OTHER INTERESTED -PERSONS: "NOTICE IS HEREBY GIVEN that an election will be held in and throughout The City of Beaumont, Texas on the 13th day of .January, 1968; on the question of the adoption of a One Percent (1%) Local Sales and Use Tax within said City, in accordance with Ordinance No. 67-72 adopted by the City Council of said City, a copy of which is attached hereto." f Section 6. That in accordance with the provisions of the laws of the State of Texas, voting machines shall be used for voting on the day of election and also for the casting of absentee votes by personal appearance at the City Clerk's office. In accordance - 5 - with the provisions of the laws of the State of Texas absentee votes,by mail shall be counted by a special canvassing board which shall be composed of Hardy D. Akin, Dr. Charles Walker, and Roy Gibbs. Hardy D. Akin is hereby appointed Presiding Judge of said Special Canvassing Board and Dr. Charles Walker and Roy Gibbs are hereby appointed Clerks.
