" 10 ENTITLED AN ORDINANCE AMENDING CHAPTER 42 OF THE CODE OF ORDINANCES OF BEAUMONT., TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, BY CHANGING THE CLASSIFICATION OF A 3.00 ACRE TRACT OF LAND OUT OF THE W. C. KEITH 59.491 ACRE TRACT LOCATED IN THE W. B. DYCHES SURVEY, BEAUMONT, JEFFERSON COUNTY, TEXAS, AS DESCRIBED HEREIN, PRESENTLY ZONED P1R-111 TO "'R-3"; PROVIDING FOR SEVERABILITY; AND PROVIDING A PENALTY. BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS: Section 1. That Chapter 42 of the Code of Ordinances of Beaumont, Texas, and in particular the boundaftes of the zoning districts as indicated upon the Zoning Map of The City of Beaumont, referred to in Section 42-9 thereof, is hereby amended by changing the zoning classification of the following described tract of land, presently zoned B1R-1" Single Family Dwelling District to "R-3" Modified Two Family and Multiple Dwelling District, to wit: BEING a 3.00 acretract" more or less,. out of the W. C. Keith 59.491 acre tract located in the W. B. Dyches Survey, more particular described as follows: BEGINNING at the northwest corner of the tract.herein described, said corner lying on the south line of the Highway 105 and 300 feet east of the intersection of the south right of way line of State Highway 105 and the east ,right of way liege of Walker Road; THENCE continuing along the south right of way of Highway 105 for a distance of 419.20 feet to point for -corner; THENCE South fora distance of.308.13 feet to a point for corner; THENCE West 419.20 feet to point for corner; THENCE North 322.4 feet to the place of beginning. and the official zoning map of the City of Beaumont is hereby amended to reflect such change. Section 2. That in all other respects the use of the property hereinabove described shall be subject to all of the applicable regulations contained in Chapter 42 of the Code of Ordinances of Beaumont, Texas, ,adopted August 19, 1958, effective October 19, 1958, as amended. 'I That the terms and provisions of this ordinance.shall be deemed to be severable, and that if the validity of the zoning affecting any portion of the property described hereinabove shall be declared to be invalid, the same shall not affect the validity of the zoning of the balance of the property described herein. Section 4. That any person or corporation violating any of the terms and provisions of this ordinance shall be subject to the same penalties provided for in the said Chapter 42 of the Code of Ordinances of Beaumont, Texas.
