ELECTION IN THE CITY OF BEAUMONT, TEXAS,
ON THE 18TH DAY OF NOVEMBER, 1967, PUR-
SUANT TO SECTIONS 5 AND 16(a) OF THE URBAN
RENEWAL LAW OF TEXAS; NAMING THE PLACES
WHERE SAID ELECTION SHALL BE".HELD; APPOINTING
OFFICERS TO PRESIDE OVER SAID ELECTION; PRO-
VIDING FOR THE FORM OF NOTICE THEREOF; PRO-
VIDING FOR THE FORM OF BALLOT FOR USE IN
SAID ELECTION; AND PROVIDING THE MANNER OF
HOLDING SAID ELECTION.
WHEREAS, pursuant to a Resolution duly adopted on the 8th
day of August, A.D. 1967, and the notice duly published in the
August 10, 1967, and the September 8, 1967, editions of the
Beaumont Journal, in The City of Beaumont, Jefferson County,
Texas, (the official newspaper of The City of Beaumont) in
accordance with said Resolution, the City Council of The City
of Beaumont, Texas, on the 13th day of October, 1967, at
10:00 -o'clock a.m., Central Daylight Saving Time, met at City
Hall in Beaumont, Texas, and held a public hearing on the question
of whether or not said City Council will order an election,
as required by the Urban Renewal Law of the State of Texas; to
determine if the City Council should adopt a certain Resolution
under said Urban Renewal Law, substantially in the form set
forth in the Form of Notice contained in Section 5 hereof; and,
WHEREAS, after due consideration of said question and of
the matters presented at said public hearing, the City Council
has determined to call said election;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF
BEAUMONT, TEXAS:
Section 1.
That in accordance with the provisions of the Urban
Renewal Law of the State of Texas, including particularly
Sections 5 and 16(a) thereof, a special election within the
corporate limits of The City of Beaumont, Texas, is hereby
ordered to be held on the 18th day of November,1967, to
determine whether the City Council should adopt a Resolution
substantially in the form set forth in the Form of Notice
contained in Section 5 hereof.
Section 2.
Only legally qualified voters residing within the corporate
limits of The City of Beaumont, owning taxable property within
said corporate limits, who have duly rendered such property for
taxation, shall be entitled to vote at said election.
Section 3.
Except as otherwise provided herein, said election shall be
held and conducted during the hours and in the manner, and the
ballots cast shall be canvassed and the returns made and the
results declared, all substantially as required by the applicable
provisions of the Constitution and laws of the State of Texas and
the Charter of The City of Beaumont,vkth respect generally to
special elections in said City.
Section 4.
That the County Election Precincts heretofore established
within The City of Beaumont are hereby designated as municipal
election precincts for said election and each qualified voter
shall vote ini:the precinct of his residence. Said election
shall be conducted and held in the several election precincts
so designated and at the respective polling places hereinafter
stated, and the following named persons are hereby appointed
officers to conduct said election in said election precincts,
respectively, to wit:

The presiding judge for each election precinct shall appoint
two clerks and as many additional clerks as he deems necessary for
the proper conduct of the election, provided not more than a total
of five clerks shall be appointed for any precinct, who shall be
selected from different political parties when practicable.
Section 5.
The City Council of The City of Beaumont hereby orders that
at least thirty (30) days' notice of the special election herein
ordered shall be given in the manner required by the applicable
provisions of the laws of the State of Texas and the Charter of
The City of Beaumont with respect generally to special elections
in said City. The notice to be given shall be as follows:

"NOTICE OF SPECIAL ELECTION IN THE CITY OF BEAUMONT,
TEXAS, TO DETERMINE WHETHER THE CITY COUNCIL SHALL
ADOPT A RESOLUTION PERTAINING TO URBAN RENEWAL."
"Pursuant to the applicable provisions of the laws
of the State of Texas and the Charter of The City
of Beaumont, including particularly the Urban
Renewal Law of the State, notice is hereby given
that a special election will be held in the said
City on the 18th day of.November, 1967, from
7:00 a.m, to 7:00 p.m., to determine whether the
City Council of said City shall adopta resolution
substantially as follows:
'A RESOLUTION MAKING CERTAIN FINDINGS,
DETERMINATIONS AND ELECTIONS UNDER AND
PURSUANT TO THE URBAN RENEWAL LAW OF
TEXAS.
'BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF BEAUMONT, TEXAS:
'SECTION 1. That it is hereby found and
etermine that one or more slum or blighted
areas exist in The City of Beaumont.
'SECTION 2. That it is hereby further found
and determined that the rehabilitation,conser-
vation or slum clearance and redevelopment
or a combination thereof, of such slum or
blighted area or areas, is necessary in the
interest of public health, morals or welfare
of the residents of said City.
'SECTION 3. That it is hereby further determined
that The City of Beaumont shall exercise
the powers granted to the City by the Urban
Renewal Law of the State of Texas, except
the Urban Renewal Project Powers as defined
in said Urban Renewal Law.
'SECTION 4. That it is hereby further determined
to be necessary and in the public interest that
The City of Beaumont elect, and, accordingly,
the City hereby elects to have said Urban Renewal
Project Powers exercised by the Urban Renewal
Agency of The City of Beaumont, which agency
is created by said Urban Renewal Law.
'SECTION 5. That the findings, determinations,
and elections herein made are made in accordance
with and the various terms used are used in the
same sense as used or defined in said Urban
Renewal Law.'

At Tuesday's Council meeting, you requested permission
to ask the question, "If the Action Now Committee had procured copies
of the tax rolls of the City of Beaumont". In answer to your question,.
you were advised in open meeting that we did not know whether they
had used such copies of the tax rolls and if it had been used, being a
public record, it would be available to your group or any other group
of citizens or citizens of Beaumont.
Tuesday, just before noon, you were called to'my office and
in the presence of the'press, you were given the following information:
"That the Action Now Committee had requested that a list of the tax-
paying citizens in Beaumont be prepared for them. " Such request was
granted and in order to make such list as requested, the IBM Computer
Machine, leased and operated by the City, was used to make selective
address cards from the tax rolls, eliminating duplications as much as
possible, for -which a charge was made of $1. 05 per thousand. The total
number of cards amounted to 26, 000. The Action Now Committee re-
quested that the same machine be used by using the card list which was
prepared to print the names and addresses on the gum labels which.were
furnished by the. Action Now Committee to be placed on materials which
they would use. For this addressing the gum labels, a charge was made
of $18. 00 per hour and it took six hours to complete the process. You
were informed that this same.list or any variation thereof so far as
addressing gum labels or just furnishing cards or lists was available.
to any person who requested the same and was willing to pay the charge
and -so long as the city business being operated on the machine was not
interfered with. You were further told in answer to your inquiry as to
the basis for the charge, and you were informed that it was based upon
the pro rata lease rental which we pay for the machine and the labor of
the man operating the machine in the process.

You were further informed that all of the public had .the right
to inspect public records but that if they wanted copies, they could
either make the copies themselves or if they wanted the city to make
them for them, a charge. would be made. You were further informed
that since the matters that we were talking about are matters of public
record, that we never question the persons making the request as to
who he represented or what he wanted the information for. You were
further told that we did not advertise or request people to use this service
but if they asked for it, it was available on the basis above mentioned to
all. The Go Beaumont Committee was furnished this same type of list
in 1963 for which they were charged and paid. In the Drainage Bond

I will further inform you now that after practicing law about
40 years in Beaumont, I can get the same information from the County
as I have always been able to get from the City and it has always been
on a similar basis. I could make my own copies. or I could pay for
copies. These are matters which are handled in each administrative
department which keeps the records and any additional information you
want will be available to you or anyone else that cares to take the time
to avail themselves of the information.
I know of no other way to answer the questions for information
which you have submitted than to give you the facts of the operation,
which I am doing. It is a pleasure to give any citizen any information
relative to city operation at any time but without prior notice of what
information may be needed, since the Council does not keep all these
records, but depend upon the authorized department to keep them, we
necessarily have to go and get the information for you. It would be
much easier if you would get the information directly from the Adminis-
trative Head through each of the departments.

(a) When was the policy of allowing private persons or
groups the use of City equiptment and personnel adopted?
i I wish to know the date of the Council Meeting, and the.
wording of the resolution as it appears in the minutes.
(b) Has this policy ever been announced by the City?
I have been active in local public affairs for a number

4 of years, and I have never heard of it.. I have not
met any one else who knew of it.
(c) For an election, what groups in the past ten years
• have used this service? Have any groups not connected
with the Chamber of Commerce ever used this service?
(d) I know that public records, such as the City tax
;:•: "! rolls, are available for inspection by any citizen.
I did not understand that the.City would perform work
for or sell my name and address to private persons or
firms. By doing this is the City placed in direct
competition with private firms that provide addressing
services?
(e) why was the policy you announced in the last
Council Meeting different from the one that you
announced on Tuesday afternoon? In the morning you
stated that"if they used it ", we could use it, In
' the evening, ydu stated that the service was available
to all, without the requirement•of prior use by another

the IBM equiptment to be a reasonable one?
