FOR FORFEITURE OF SUCH LICENSES; REQUIRING PERMITS FOR ELECTRICAL CON-
STRUCTION OR WORK OF ANY CHARACTERS PROVIDING THE MANNER AND WAY IN WHICH
ELECTRICAL WORK SHLLL BE DONE AND CLASS OF HATEJRIALS TO BE USED IN XCH

PRESCRIBING PENALTIES FOR VIOLATION OF ANY PROVISION OF THIS ORDINANCE
AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH.
SECTION I
Defini tion s
For the purpose of this licensing, ordinance, the following terms
and words be interpreted as having the following meanings;
The_C_ity_Electrical Inspector shall mean any person duly qualified
and appointed for the purpose of enforcing the provisions of this ordi-
nance.
Journeyman._Electri cacal Forker shall mein any electrician having at
least four yeArs' experience in the practice of his trade.
Electrical_Qorker shall mean any person not less than eighteen years
of age who does any work of installing electric wires, conduits, appa-
ratus, fixtures, or other appliances for wire.
aectrical l`ork shall mean any act in connection with the installing;
altering, repairing, or maintaining of an electrical system designed or
capable of carrying an electromotive force of 25 volts or more, which
act ordinarily requires the use of tools°
nlectri cal bys tem shall mean all materials, devices, or appliances
located for the purpose of conducting or safeguarding electrical current.
Electrical Gi Ling shall moan electric wiring devices or material,
construction and/or =ec;uipment..
Master Elact.r:ician shall mean any person having a regular place of
business in his n.amn who by the employment of journeymen electricians
and apprentices p arforms the work of installing wires, conduits, appa-
ratus, fixtures or other appliances for carrying on or using electricity
.for light, ho 4t or power puPpoacso ,
Person shall mean any person, firm or corporation.
SECTION II
- It is the puroose of this ordinance to supplement the minimum safety
regulations of the Hational Electrical Code relating to the installation
of wiring and electrical o uipment with such additional regulation of
local application as is necessary for adec+uate protection of life and
property.
SECTION III
Liability. Thi provisions of this chapter shall not bo construed to
ralieve from or to lassen the responsibility of any person owning, oper-
ating, controlling or installing any electrical equipment for damage or
injury to any parson or prop orty, nor shall it be construed to impose on
the city any li Fbili ty by ro son of the inspection herein provided for

In order to protect the Lives of the citizens and the property
of citizens from the dangers incident to defective wiring of
buildings, and structures, it shall be unlawful for any firm or
corporation to allow any electrical current used for any purpose
in buildings or structures belonging to any person, firm or cor-
poration, to be turned on without first having had an inspection
made of the wiring by the electrical inspector and having re-
ceived from the inspector a certificate approving the wiring of
such building.
It shall be unlawful for any person, firm or corporation
engaged in the business of selling electricity to furnish any
electrical current for use for light, heat or power purposes in
any building or buildings of any person, firm or corporation un-
less the said building or buildings have been first inspected by
the electrical inspector or j:ii_s assistants and a certificate given
as her-eina.fter provided..
SECTION V
Electrical Inspector
Art. 1 A city electrical inspector and his assistants shall
be appointed by th=:: City Manager and must have had at least four
years' experience as a journeyman in the practise of his trade.
He shall devote his entire time to the duties of his" office. He
shall make all inspections of electric wiring as prescribed by
the city ordinance. He shall make an annual report.
Art. 2 The electrical inspector shall not engage in the
business of electrical contracting or any branch of the elec-
trical business either directly or indirectly or have such
financial interest in such business within the city of Beaumont,
Texas.
Art. 3 The electrical i_nsp ector or his duly authorized
assistant shall have the right to enter any building during
reasonable hours in the discharge of his official duties and
shall have the authority to cause the disconnection of any wiring
or equipment where such wiring or equipment, in his judgment, is
dangerous to life or propertyg or may interfere with the work of
the Fire Department.
Art. 4 The electrical _inspector shall keep complete records
of all hermits issued and inspections made; and a complete
statistical record of fees, and of accid.ants from electrical
causes.
Art. 5 The electrical inspector shall maintain a file of
listed inspected electrical appliance cards issued by or for
UnderwriterTs Laboratories, Inc., which file shall be accessible
for public reference during regular office Hours.
Art. 6 The electrical inspector is empowered to employ, after
receiving the approval of the City Manager, any assistant inspec-
tors necessary to the prober conduct of his office and the inspec-
tion of electrical installations, and may deputize,them to act as
his authority.
SECTION VI
Permits
Art. 1 No wiring devices or equipment for the transmission,
distribution or utilization of electric energy for light, power,
radio and/or heat, shall be installed within or on any building
or structure or property nor shall any alteration or addition be
made in any such existing wiring devices or equipment without
first securing a written permit therefor from the electrical in-
spector or his duly authorized assistant, except as stated in the
following Daragraphs o

(1) No permits shall be required for the repl.a.cement of lamps
or the connection of portable appliances to suitable receptacles
which have been permanently installf.
(2) No permit shall be required for maintenance and repair
work on the premises of a person, firm or corporation regularly
employing one or more Licensed journeymen electrical workers for
the purpose. This shall not apply to new construction.
(3) No permit shall be required for the installation of
electric wiring, devices or equipment to be installed as an in-
tegral part of public utility electric system for the use of such
a corporation in the generation, transmission, or sale of elec-
trical energy, or for the use of such a corporation in the trans-
mission of intelligence.
Art. 2 Application for such permit, describing the work to
be done shall be made in writing to the electrical inspector by
the person, firm or corporation installing the work and permit
when issued shall be to such applicant. The person, firm or
corporation making application for such permit shall state in
the application the premise to be wfied, the size of conductors
to be used in or upon any building for all services, mains,
feeders and sub -feeders, the method of wiring the areas to be
served by such conductors and the basis used in computing the
required sizes of such conductors and shall when required by the
electrical inspector, file with him, complete plans and s_cacifi-
cations for the installation showing sizes of all conductors and
such other details as may be necessary to determine whether the
installation as described will be in conformity with the require-
ments of this ordinance. If it shall be found that the installa-
tion as described will in gcnera.l conform with the requirements
of this ordinance, a permit for such -installation shall be issued;
provided, howeverg that the issuance of the permit shall not be
taken as permission to violate any of the requirements of this
ordinance.
Art. 3 The permit when issued shall be for such installation
as is described in the application on specified premises and no
deviation shall be made from the installation so described with-
out the written approval of the electrical inspector.
Art. 4 No permit for the installation or alteration of any
electric wiring, devices or equippent shall be issued to any per-
son, firm or corporation unless such person, firm or corporation
is the holder of a license entitling such person, firm or cor-
poration to secure permits for and to execute the work described
in the application for the permit.
Art. 5 Any permit issued to any applicant shall be void, if
unused after ninety days.
SECTION VII
Fees for Permits and Inspection
Art. 1 Before any permit is granted for the installation or
alteration of electric wiring, devices or equipment, the person,
firm or corporation making application for such permit shall pay
to the City of Beaumont, Texas, a fee in such amount as specified
below.
Art. 2 For a hermit to install one or more lighting fixtures
or to install wiring for lighting when such wiring is added to
existing wiring, the minimum fee shall be $0.25. For any other
permit the minimum fee shall be 110.50
Art. 3 For the installation of wiring for lighting,.
A. For service and up to ten outlets -----------------$ 1.00
B. For each additional outlet --------------------------$ 0.10
C. Each wall switch for the control of one or
more outlets including wiring for same ------------$ 0.10
D. For the installation of lighting fixtures,
drop cords and lamp receptacles. Each socket

F. A stage border light, footlight or strip
light or a metal trough, raceway or conduit
with sockets or receptacles attached used for
lighting a show window or show case or for
similar purpose shall be considered a lighting

tifiers, welding apparatus, furnaces., heating appliances
or equipment, motion picture machines and/or any other
electrical apparatus, appliances and equipment, up to

The .rate of each unit shall be considered separately in
figuring these fees.

Art. 9. For the inspection of ,any electrical equipment,
n.ppliance or apparatus for which no fee is herein prescribed,
there shall be charged for each hour a fee of -----------$ 1.50
Art. loo For transmitting or broadcasting stations (including
�lso the receiving equipment in such stations) the fee shall be
ietermined on the basis of the electrical equipment installed but
in no case shall such fee be less than $5.00.
SECTION VIII.
Inoection and Certificates

Art. 1 Upon the completion of the installation of the
electric wiring, devices and equipment which has been authorized
by issuance of a permit, it shall be the duty of the person,
firm or corporation installing the same to so notify the elec-
trical inspector, who shall insect the installation promptly
after such notice -is given; and, if it is found to be fully in
compliance with the provisions of this ordinance, he shall issue
to such person, firm or corporation a final certificate of
approval authorizing connection to the electric service, the
turning on of the current and the use of the electrical system,
and he shall send written notice of such authorization to such
public utility, Derson,,firm or corporation as may be furnishing
the electric service° ,,.Then a. certificate is issued authorizing
the connection and use of temporary work; such a certificate
shall be issued to expire at a stated tine and shall be revo-
cable by the electrical insonctor at his discretion. A Vrelimi-
nary certificate may be issued authorizing the connection and use
of certain specified portions of an unccmrleted installation;
such _nrelimina.ry certificate shall be revccable at the discretion
of the electrical inspector.
Art. 2 If upon inspection the electrical system is not
,found to be fully in compliance with this ordinance, the electri-
cal inspector shall at once forward to the person, firm er corpora-
tion installing the wiring, a written notice stating the defects
which have been found to exist
Art. 3 When aanv part of an electrical wiring is to be hidden
from view by the permanent olacamant of parts of the building,
the ;person, firm or corporation installing the wiring shall so
notify the electrical inspector and such harts of the wiring in-
stallation shall not ba concealed until they have been inspected
or approved or until 48 hours (exclusive of Sundays and legal
holidays) shall have elapsed frai=l the time. cf -such notification, -
provid.-eci that on large installations, where the concealment of
parts of the electrical siring ,proceeds continuously, the parson,
firm or corporation installing the wiring shall give the elec-
trical inspector due notice and inspections shall be made period-
ically during the progress of the work.
SECTION IX
Rainspection
The electrical inspector shall make periodically a thorough
reinspection of the installation of all electrical wiring, elec-
tric devices and electric equipment now installed or that may
hereafter be installed within the City of Beaumont, Texas, and
within the scope cf this ordinance, and when the installation
of any such electrical wiring, devices and/or equipment is found
to be in a dangerous or unsafe condition, the perscns, firm or
corporation owning, using or oDerating the same shall be so
notified in writing by the inspector and shall make the necessary
repairs or changes required to place such ;;Tiring, devices and.
equipment -in safe condition and have such -work completes' within—

15 days or any longer period specified by the electrical inspector
in said notice. The electrical inspector is hereby empowered to
disconnect or order the discontinuance of electric service to such
wiring, devices and/or equipment so found to be defectively or im-
properly installed until the installation of such ,Tiring, devices
and equipment has been made safe as directed by him.
SECTION X
Review of Decisions
When the electrical inspector condemns all 'or. part of any
electrical system, the owner may, within five days after receiv-
ing written notice to that affect from the electrical inspector,
file a petition in writing for review of said action of the elec-
trical inapector with the Board of a7psal, upon receipt of which

said .Board of A-ppeal shall at once proceed to determine whether.,
said electrical system complies with this ordinance and within
three days it shall make a decision in accordance with its find-
ings. No action shall be taken by the electrical inspector until
the Board has rendered its decision.
SECTION XI
A;-),;)rcved Methods
No certificate of approval shall be issued unless the elec-
tric light, ower, radio and heating installations are in strict
conformity with the provisions of this ordinance, and the statutes
of the State of Texas.

No more than two extensions not exceeding 6 feet in length
each shall be run from any one conduit outlet.

half horsepower or more, the conduit of which shall in every case
come flush with the terminal side of the motors and be equipped

14. Wiring in all buildings used for commercial purposes:
Methods A -B -G.
A. In alterations to existing wiring of a method not approved
for new work; the wiring may be of same method as existing, pro-
vided the total number of additional outlets shall not exceed 10
percent of the total number of existing outlets; and that such
wiring is not obsolete or unsafe and conforms to methods of wiring
recommended by the old ordinanc:.
Bo 1. Not more than 4 live outlets shall be permitted on
any one circuit in commercial buildings.
20 Not more than 8 outlets shall be permitted on any
one circuit for show windows lighting and the connected load shall
not exceed 1320 watts.
3. Not more than 16 live outlets shall be permitted on
any one circuit for decorative or arming lights and the connected
load shall not exceed 1320 watts.
4. Not more than 6 live outlets shall be permitted on
any one circuit in residential wiring.
5. all outlet boxes for ceiling and bracket lights
must be flush with ceiling or wall surface or never extend more
than one-eighth inch inward from the finished surface. - -
o. Drop cords must not be installed in clothes closets,
or in places where wearing apparel is likely to be hung; however,
ceiling and bracket fixtures will be permissable.
7, .All wires for meter loops must be No. 8 B. & S.
guage wire or larger. In all two -wire installations, four wires
must be brought out for meter loops. In all three -wire installa-
tions, five wires must be brought out for nater loops and shunt
spires must be taped inside of cabinet and securely soldered. All
sub -feeders -must not be smaller than No. 8 B. & S. guage wire.
Cross over tubes will not be required on inside of cabinets or
cabinet gutters.

8. On all three -wire installation the Load must be bal-
anced as near as possible with respect to each side of the three -
wire installation. In. all residences where the connected load
is 5,000 watts or more, the system of wiring must be three -wire.
9. All service wiring shall be No. 8 E. & S. guage or
larger.
10. All alternating current motors of 7! horsepower and
over shall be provided with an approved compensator or auto -
starter. All polyphase motors of 5 horsepower shall be con-
trolled with a double throw switch with insertion of starting
and running fuses, the switch being so constructed that it will
be impossible to leave same in the -starting position. Switches
in all classes of mills, grain elevators, or factories controll-
ing rotor circuits or individual motors of more than 5 horsepower
shall be of an approved oil break type and equipped with a, low
voltage release.
11. All resistances and rheostats with exposed live parts
shall be equipped with face plates of an approved type.
C. 1. It shall be unlawful for any person, firs, or corpora-
tion to hereafter erect or construct any pole, pier, abuttment,
wire or other fixture, appurtenance, or appliance in the City of
Beaumont, without first obtaining the written consent of the
electrical inspector.
2. All poles shall be -erected and maintained in a per-
pendicular position and shall be straight and free from bark and
placed immediately within the curbing where -the sidewalks are
eight feet or upwards in width, and shall be placed in the curb-
ing on a line with its outer surface where the sidewalks lks are less
than eight- feet ' in t��id.th. - Y..Then the curbing is not laid, the-'

outer line of same shall be taken and poles set 8 inches within
such outer lines.
3. Each line of poles shall be run on one side of the
street, alley or avenue only oxcept when absolutely necessary
to change to the other side, but this may be done only by per-
mission of the City Enginser. Cross -arms shall be of uniform
length, strengthened by braces, and no wires shall be less than
twenty -feet from the curb in height, except trolley or service
wires.
4. It shall be unlawful for any parson, .firm or corpora-
tion to place or allow to be placed any advertising cards or
posters or other light Daterial on any of their poles.within
the City limits, and any person, firm or corporation allowing
same to be done shall be guilty of an offense punishable under
this ordinance.
5. -llenevbr it shall become necessary for any electric
light or power company to carry its wires- across the -line -of any-- -
fire alarm, telegraph, telephone, or other electric light or
power company, such wires shall be at a distance from the other
wires not less than three feet. No wires shall be allowed over
the fire alarm and police telegraph wires, unless special permis-
sion is given by the electrical inspector.
6. No wires of telegraph, telephone, electric railways,
electric light of :,ower companies shall be allowed under sheds,
galleries or awnings without first being inspected and found safe
and a proved in writing by the Electrical Inspector.

D. That the rules and regulations of the National Board of Fire
Underwriters, embodied in its "National Electrical Code', published in
1935, and such subsequent codes, amendmc-:nts �nd supplements of said
National Board of Fire Underwriters, may hor-eafter adopt are hereby
adopted as the rules and regulations to govern and to be observed and
followed in all electrical v--riring and in all construction, installation,
repair, alteration, operation and maintenance of electrical c,iring,work
apparatus, and fixtures except as otherwise specially provided in this
ordinance and the same are hereby made a part of this ordinance as
fully and to the same extent as if copied hdrein in full. That any
printed book entitled, '!National Electrical Code", containing the regu-
lations of the National Board of Fire Underwriters for electrical wiring
and apparatus as recoimnended by the National Fire Protective Association
for the year 1935, or for any subsequent year and all books containing
supplements or amendments to such code which purport on their face to be
the rules and requirements of the National Board of Fire Underwriters,
governing such matters, shall be admitted in evidence with the same
force and effect as the original rules and regulations without further
proof and the interpretation of such code by the Electrical Inspector
shall be final and conclusive.
SECTION XIII.
P en al ty
Art. 1. Any person, firm or corporation who shall fail to comply
?Uith any of the provisions hereof shall upon conviction thereof, be
punished by a fine of not less than $10.00 nor more than $100.00 for
each offense, and if such person, firm or corporation is the holder of
a license as provided for in this ordinance, said license shall be re-
voked.
Art. 2. Each day's continuance of a violation of any provision of
this ordinance shall 'be deemed a separate offense.
SECTION XIV.
Examination and Certification
Art. 1. The City IUfanager shall appoint a board of examiners of
electricians, which board shall be composed of the electrical inspector,
two master electricians and two journeyman electricians of proved merit.
Art. 2. No person, either individually, as a member of a firm, or
as an officer or employee of a corporation, shall conduct the business
of electrical wiring contracting as a master electrician unless such
person shall have a license as required by this ordinance, and no elec-
trical work shall be done by a person not having such license unless
such work is done under the supervision of a licensed electrician.
Art. 3. There shall be two classes of licenses issued that pertain
to electrical work in the City of Beaumont, Texas, namely, Class A and
Class B. Class A license shall be issued to a Arson desiring to enter
into the business of electrical wiring and construction. Class B shall
be issued to a person desiring to work as a journeyman electrical worker.
However, competency must be shown before a license is granted to either.
Art. 4. A fee for a new applicant for Class A license shall -be $50.00.
Renewal for each succeeding year shall be X5.00. The fee for a. new appli-
cant for Class B license shall be $,)2.00. Renewal fee for each succeeding
year shall be 01.00.
Art. 5. Every person licensed as a Class A or master electrician
shall give a bond to the City of Beaumont, Texas,in the, sum of $2500.00
with such sureties as the City Manager shall approve with the condition
that such person will comply with the ordinEnces and laws relating -to
electrical wiring and that he will pay all damages, costs and expenses
that may be caused by the negligence of such persons in his employ, or
occasioned by his or their failure to comply with said laws and
ordinances.

Art. 6 any license may be sus.Dend_ed or revoked by the elec-
trical inspector on the recommendation of the board of examiners
should the licensee violate any ordinance or law relating to elec-
trical wiring. any person whose license shall have been revoked
shall not again be licensed within a period of one ,year from date
of such action. No licenso shall be revoked. unless the licensee
has been notified in writing of the charges against him at least
10 days before such meeting. The licensee shall have the right
to appear before the board of examiners to answer the charges and
present testimony in his favor.
Art. 7 Examinations for both classes of licenses for elec-
tricians shall be given periodically by the board of examiners.
Any person desiring any such license 'shall make application,
therefor to said board of examiners not less than 5 days prior
to the date on which an examination is to be held. The board of
examiners shall then examine such applicants at such place as it
shall designate as to his qualifications- and competency either to
conduct a business or to :,,vork as an electrician.
Art. 8 Any applicant who is refused a Class A or Class B
license may appeal to the Board of Appeals for a review of his
case.
SECTION XV$
Board of riDneal
Art. 1 A. The Board of Appeal shall consist of three mem-
bers appointed by the City Manager, who, by experience and train-
ing, shall be qualified. to 1 -)ass au -)on the safety of installations
and apparatus regulated by this ordinance. Members of the board
shall be appointed for each case as it arises. No member of the
Board of Appeal shall sit in a case in which he is directly or
indirectly interested, and. in case of disqualification for such
cause, or in case of his necess«.ry absence, the City Manager shall
make temporary appointment of a substitute.
Art. 2 A. The Beard of Appeal shall meet at the call of .the
City Manager.
B. Any applicant for an electrical permit, whose
application has been rejected by the Inspector, or a person who
has been ordered by the Inspector to incur an expense in the
alteration, repair or construction of the electrical installation
of any building, may, within fifteen days thereafter, appeal
therefrom by giving to the Inspector notice in writing of such
an appeal; such notice or a certified coley thereof shall at once
be transmitted by the Inspector to the Board of Appeal. After
notice to such parties as the Board may direct, a hearing shall
be had, and the Board may by a majority vote affirm, annul or
modify such action of the Inspector. If the action of the In-
spector is affirmed, such action shall have full force and effect.
If the action of the Inspector is modified or annulled., a permit
shall be issued accordirgy.
C. Any requirement deemed_ by the Inspector
necessary for safeguarding the hazards from fire and to life in
connection with any electrical installation not specially covered
by the ordinance, shall be determined by the Inspector., subject
to the Board of Appeal in the manner prescribed by Paragraph B.
D. It shall be the duty of the Electrical Inspector
to submit to the City Commission on or before the first of January
of each year, a report giving a summary of all the decisions of
the Board of appeal, a lfst of equivalents consented to and a re-
cord of such other business as may have come before them, together
with such recommendations as to desirable legislation pertaining
to electrical installations in or about buildings, as may to them
seem advisable.

Art. 3. Any person appealing from the decision of the Inspector
shall attach to the <<.!ritt-:,n appeal a certified check for ; 5.00, made
out in favor of the City Tax Collector., and in case the appeal is lost
the check shall be turned over to the City Tax Collector as a cost,
but if the appoal is granted the check shall bo returned to the
app i cent.
SECTION XVI.
Validity of Ordincnco.
If any section, sub -section, sentence, clause or phrase of this
ordinance is, for -m—iy reason, held to be invalid, such decision shall
not affect the validity of the remaining portions of this ordinance.
The City Commission of tho City of Beaumont, Toxas, hereby declares
th t it viculd have passed this ordinance and each section, sub -section,
sentence, clause or phrase thereof, irrespective of the fact that any
one or more sections, sub -sections, sentences, clauses or phrases be
declared invalid.
SECTION XVII.
Repealing of Conflicting Ordinances.
All Ordinances or parts of ordinances conflicting with the
provisions of this ordinance are hereby repealed.
