Beaumont, Texas, September 1, 1937
1.71HEREAS, the City Commission of the City of Beaumont,
by ordinance duly passed, authorized the surrender by the
Eastern Texas Electric Company and M. G. Muse, its Receiver,
of all franchises heretofore granted_ by the City of Beaumont
pursuant to which the street railway= system, including the motor
coach transportation service furnished in connection therevvith;is,
or may be operated upon the filing of the Eastern Texas Electric
Company or M. G. Muse, its Receiver, with the Clerk of the City
an instrument in writing stating that such franchises are
surrendered to the City, whereupon said Eastern Texas Electric
Company of Texas and M. G. Muse, its Receiver, will thereupon be
relieved of any obligations imposed by any of said franchises,
either expressed or implied, in connection with the operation
of said- street railway system, which surrender shall be made upon
the conditions set forth in said ordinances,
NOW, THEREFORE, M. G. Muse, Receiver of Eastern Texas
Electric Company, thereunto duly authorized by order of the United
States District Court of date the 30th day of August, A. D. 1937,
in cause styled Eastern Texas Electric Company (Delaware), Complainant,
vs. Eastern Texas Electric Company (Texas), Defendant, and numbered
496 In Equity, hereby files with the Clerk of the City of
Beaumont said instrument in writing stating that said franchises
in said ordinance authorized -to be surrendered have been surrendered
and Eastern Texas Electric Company of Texas, acting herein by and
through M. G. Muse, Receiver, do hereby surrender to the City of
Beaumont said abovenamed franchises, and all of them, conditioned
as in said ordinance is Y)rovided and there is hereby delivered to
the City of Beaumont in place all existing street railway tracks,
ties, switches, frogs and other track equipment and track raving
heretofore the property of the Eastern Texas Electric Company and
located in and on all said streets, avenues or other public places,
whether or not the same are now paved, together with all poles,
supporting structures, including all signal systems
wires and;
now owned by the Eastern Texas Electric Company of Texas, in6luding

the ra ls, ties and bolts situated in said.streets so that said
street railway tracks, ties, switches, frogs and other track
equipment and track raving, poles, wires and supporting structures,
including all signal systems in, upon and tinder said streets,
shall be and become the Property of the City of Beaumont.
