HomeMy WebLinkAboutORD 32-LCREATING THE OFFICE OF ELECTRICAL INSPECTOR, PRESCRIBING HIS DUTIES, DEFINING ELECTRICAL WORKER, JOURNEYMEN ELECTRICAL WORKER, ELECTRICAL WORK, ELECTRICAL SYSTEM, ELECTRICAL WIRING, MASTER ELECTRICIAN; PROVIDING FOR BONDING AND LICENSING MASTER ELECTRICIAN AND FOR PROVIDING FEE FOR SAID LICENSE, PROVIDING FOR FORFEITURE OF SUCH LICENSES; REQUIRING PERMITS FOR ELECTRICAL CONSTRUCTION OR WORK OF ANY CHARACTER; PROVIDING THE MANNER AND WAY IN WHICH ELECTRICAL WORK SHALL BE DONE AND CLASS OF MATERIALS TO BE USED IN SUCH WORK; PROVIDING FOR ADOPTION OF THE NATIONAL ELECTRICAL CODE AS PROMULGATED BY THE NATIONAL BOARD OF FIRE UNDERWRITERS FOR 1935, EXCEPT AS MODIFIED HEREIN, PROVIDING THAT SUBSEQUENT CODES, AMEN17MENTS AND SUPPLEMENTS OF THE NATIONAL BOARD OF FIRE UNDERWRITERS ARE ADOPTED AS RULES AND REGULATIONS TO GOVERN IN ALL ELECTRICAL WIRING; PROVIDING FOR THE INSPECTION OF ELECTRICAL WORK AND THE SCALE OF FEES FOR SUCH INSPECTION; PROVIDING FOR THE CREATION OF A BOARD OF EXAMINERS; PROVIDING FOR THEIR QUALIFICATION; PROVIDING FOR BOARD OF APPEAL AND THEIR QUALIFICATION; PROVIDING FOR FINAL APPEAL TO THE CITY COMMISSION; PRESCRIBING PENALTIES FOR VIOLATION OF ANY PROVISION OF THIS ORDINANCE AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH. SECTION 1. Definitions For the purpose of this ordinance, the following terms and words have the following meanings: THE CITY ELECTRICAL INSPECTOR shall mean any person duly qualified and appointed for the purpose of enforcing the provisions of this ordinance. JOURNEYMEN ELECTRICAL WORKER shall mean any electrician having at least .four years f experience in the practice of his trade. ELECTRICAL WORKER shall mean any person not less than eighteen years of age who does any work of installing electric wires, conduits, apparatus, fixtures, or other appliances for wire. ELECTRICAL WORK shall mean any act in connection with the installing, altering, repairing, -or maintaining of an electri- cal system designed or capable of carrying an electromotive force of 49 volts or more, or used to furnish light, heat or power, which act ordinarily requires the use of tools. ELECTRICAL SYSTEM shall -mean all materials, devices, or appliances located for the purpose of conducting or safeguarding electrical current. VASTER ELECTRICIAN shall mean any person having a regular place of business in his name who by the employment of journeymen electricians and apprentices performs the work of installing wires, conduits, apparatus, fixtures or other appliances for carrying on or using electricity for light, heat or power purposes. PERSON shall mean any person, firm or corporation. SECTION II It is the purpose of this ordinance to supplement the minimum safety regulations of the National Electrical Code relating to the installation of wiring and electrical equipment with such additional regulation of local application as is necessary for adequate protection of life and property, SECTION III LIABILITY. The provisions of this chapter shall not be construed to relieve from or to lessen the responsibility of any person owning, operating, controlling or installing any electrical equipment for damage or injury to any person or property, nor shall it be construed to impose on the city any liability by reason of the inspection herein provided for or by reason of any certificate issued hereafter® SECTION IV ELECTRIC WIRING OF ALL BUILDINGS AND STRUCTURES® In order to protect the lives of the citizens and the property of citizens from the dangers incident to defective wiring of buildings, and structures, it shall be unlawful for any person, firm or corp- oration to allow any electrical current used for the purpose of producing light, heat or power in buildings or structures belonging to any person, firm or corporation, to be turned on without first having had an inspection made of the wiring by the electrical inspector and having received from the inspector a certificate -2- engaged in the business of selling electricity to furnish any electrical current for use for light, heat or power purposes in any building or buildings of any person, firm or corporation unless the said building or buildings have been first inspected by the electrical inspector or his assistants and a certificate given as hereinafter provided. SECTION V ELECTRICAL INSPECTOR Art. 1 A city electrical inspector and his assistants shall be appointed by the City Manager and must have at least four years' experience as a journeyman in the practice of his trade. He shall devote his entire time to the duties of his office. He shall make all inspections of electric wiring as prescribed by the city ordinance. He shall make an annual report. Art. 2 The electrical inspector shall not engage in the business of electrical contracting or any branch of the electri- cal business either directly or indirectly or have such financial interest in such business within the City of Beaumont, Texas. Art. 3 The electrical inspector or his duly authorized assistant shall have the right to enter any building during reason- able hours in the discharge of his official duties and shall have the authority to cause the disconnection of any wiring or equipment, where such wiring or equipment, in his judgment, is dangerous to life or property, or may interfere with the work of the Fire Depart- ment. Art. 4 The electrical inspector shall keep complete re- cords of all permits issued and inspections made; and a complete statistical record of fees, and of accidents from electrical causes. Art. 5 The electrical inspector shall maintain a file of listed inspected electrical appliance cards issued by or for Underwriters Laboratories, Inc., which file shall be accessible for public reference during regular office hours. -3- and the inspection of electrical installations, and may deputize them to act as his authority. SECTION VI Permits. Art. 1. It shall be unlawful for any individual, firm or corporation to enter upon the erection, construction, alteration or change of an electrical installation, machinery, work or wiring, either inside or outside of any building in the City of Beaumont, without first making application in writing therefor to and re- ceiving a permit from the Electrical Inspector for such construction, installation, repair, alteration, change or wiring; provided that all applications shall be accompanied with the fees herein provided for and a description of the premises affected, by street number or lot or block number, and when required by the Electrical Inspector, plans and specifications for the proposed work; provided, however, the Electrical Inspector may issue a general permit to such individual, firm or corporation owning or controlling any building, for a term not exceeding three months from the date thereof, authorizing minor alterations or changes, but such permit shall be revocable by the Inspector; provided further no permits will be required for the installation of wire's to operate electric bells, gas lighting apparatus, house enunciators, burglar alarms, tele- phones, telegraph, district messengers, watch clock fire alarms, or other similar instruments, if the current operating the same is of less than 48 volts potential, or is not used to produce light, heat or power. Art. 2. Upon making the application provided for in section 1 hereof, which application shall be made upon forms, fur- nished by the City, and the payment of the fees provided for, and compliance with all other requirements in connection with such application herein provided for, the Electrical Inspector shall issue permit for the construction, inst allat ion, repair or alter- -•4- provisions of this ordinance and all rules and regulations which may be promulgated hereunder in aid of its full and true intent and application, and upon payment by the applicant of all addi- tional inspection fees which may accrue, shall issue a certificate approving the same. Art. 3. The permit when issued shall be for such installa- tion as is described in the application'on specified premises and no deviation shall be made from the installation so described with- out the written approval of the electrical inspector. Art. 4. No permit shall be required for the installation of electric wiring, devices or equipment to be installed as an integral part of public utility electric system for the use of such a corporation in the generation, transmission or sale of electric energy, or for the use of such corporation in the trans- mission of intelligence. Art. 5. No permit for the installation or alteration of any electrical wiring, devices or equipment shall be issued to any person, firm or corporation unless such person, firm or corporation is the holder of a license entitling such person, firm or corporation to secure permits for and to execute the work de- scribed in the application for the permit. Art. 6. Any permit issued to any applicant shall be void, if unused after ninety days. Art. 7. In hotels, office buildings, mills and factories, where maintenance men are regularly employed, no license or bond will be required, but permits must be secured, work inspected, and fees paid. SECTION VII Fees for permits and Inspection Art. 1 Before any permit is granted for. the installation or alteration of electric wiring, devices or equipment, the person, firm or corporation making application for such permit shall pay to -5- A. ror service and up to ten outlets ...... §1.00 B. For each additional outlet ............. .10 C. The word "outlet" means all ceiling lights, brackets, base receptacles, and switches. D. For the installation of lighting fixtures and drop cords, each socket ............. .05 E. For each mogul socket .10 F. A stage border light, footlight or strip light or a metal trough, raceway or conduit with sockets or receptacles attached used for lighting a show window or show case or for similar purposes shall be considered a lighting fixture. Each socket or receptacle ............... .03 G. For the installation of sockets or re- ceptacles in or on signs and concealed wiring in signs, each socket or receptacle .03 H. For motors, generators, transformers, rectifiers, welding apparatus, furnaces, heating appliances or equipment, motion picture machines and/or any other electri- cal apparatus, appliances and equipment up to 5 kilowatt per horsepower, each ... .50 All over 5 kilowatt per horsepower,each.. .10 L. The rate of each unit shall be considered separately in figuring these fees. (a) Each pole or anchor .50 (b) For underground conduits and cable ducts, each 100 lineal feet ........ .50 M. For the inspection of any electrical equipment, appliance or apparatus for which no fee is herein prescribed,there shall be charged for each hour a fee of.. 1.50 N. For transmitting or broadcasting stations (including also the receiving equipment in such stations) the fee shall be deter- mined on the basis of the electrical equip- ment installed but in no case shall such fee be less than 5.00 -6- electric wiring, devices and equipment which has been authorized by issuance of a permit, it shall be the duty of the person, firm or corporation installing the same to so notify the electrical inspector, who shall inspect the installation promptly after such notice is given; and, if it is found to be fully in compliance with the provisions of this ordinance, he shall issue to such person, firm or corporation a final certificate of approval authorizing connection to the electric service, the turning on of the current and the use of the electrical system, and he shall send written notice of such authorization to such public utility, person, firm or corporation as may be furnishing the electrical service. When a certificate is issued authorizing the connection and use of tem- porary work, such a certificate shall be issued to expire at a stated time and shall be revocable by the electrical inspector at his discretion. A preliminary certificate may be issued author- izing the connection and use of certain specified portions of an uncompleted installation; such preliminary certificate shall be revocable at the discretion of the electrical inspector. Art. 2. If upon inspection the electrical system is not found to be fully in compliance with this ordinance, the electrical inspector shall at once forward to the person, firm or corporation installing the wiring,a written notice stating the defects which have been found to exist. Art. 3. When any part of an electrical wiring is to be hidden from view by the permanent placement of parts of the building, the person, firm or corporation installing the wiring shall so notify the electrical inspector and such parts of the wiring installation shall not be concealed until they have been inspected or approved or until 24 hours.(exclusive of Sundays and legal holidays) shall have elapsed from the time of such notifi- cation, provided that on large installations, where the conceal- ment of parts of the electrical wiring proceeds continuously, the -7- Reinspection The electrical inspector shall make periodically a thorough reinspection of the installation of all electrical wiring, electrical devices and electric equipment now installed or that may hereafter be installed within the City of Beaumont, Texas, and with- in the scope of this ordinance, except where permit is not re- quired, and when the installation of any such electrical wiring, devices and/or equipment is found to be in a dangerous or unsafe condition, the persons, firm or corporation owning, using or operating the same shall be so notified in writing by the in- spector and shall make the necessary repairs or changes required to place such wiring, devices and equipment in safe condition and'have such work completed within 15 days or any longer period specified by the electrical inspector in said notice. The electri- cal inspector is hereby empowered to disconnect or order the dis- continuance of electric service to such wiring, devices and/or equipment so found to be defectively or improperly installed until the installation of such wiring, devices and equipment has been made safe as directed by him. SECTION X Review of Decisions When the electrical inspector condemns all or part of any electrical system, the owner may, within five days after re- ceiving written notice to that effect from the electrical inspector, file a petition in writing for review of said action of the electrical inspector with the Board of Appeal, upon receipt of which said Board of Appeal shall at once proceed to determine whether said electrical system complies with this or dinance:and within three days it shall make a decision in accordance with its findings. No action shall be taken by the electrical inspector until the Board has rendered its decision, -8- electric light, power, radio and heating installations are in strict conformity with the provisions of this ordinance, and the statutes of the State of Texas. SECTION XII Types of Wiring Approved APPROVED WIRING METHODS Method A -Standard Rigid Steel Conduit Method B -Metal Underfloor Raceway Method C-Underplaster Extensions Method D -Flexible Steel Conduit Method E -Approved Cable Method F -Armored Cable Lead Sheathed Method G -Surface Metal Raceways Method H -Ba -re -Bus -Bars and Risers Method I afflireways and Busways Method J -Auxiliary -Gutters Method K -Knob and Tube Art. 1. Flexible metallic conduit may be used only where it is impractical to use rigid steel conduit. Art. 2. The conductors of all wiring methods except bare bus -bars shall be insulated. Provided, however, conductors for services may conform to permissible exceptions to Table 1 - Page 51, National Code. Art. 3. Knob and tube construction may be used only where the total number of hot outlets does not exceed twenty-four. Art. 4. In garage and garage apartments, where floor area is sufficient to permit the storage of more than two vehicles, either conduit work, surface metal raceways, armored cable or electrical metallic tubing, or wireways and busways as specified in Sections 503, 504, 5059 508 and 511 respectively of Article 5 of the National Electrical Code, shall be employed as the wiring method. Where the floor space will accomodate not more than two vehicles, any wiring method approved by the National Electrical Code may be employed. Art. 5. The term "Fire Limits" referred to in provisions of this ordinance shall include the District contained within the inner fire limits as they exist at the time of the installation or performance of such electrical work. -9- 1. On exterior of building or structures, e�te�—ivre or E may be used. Where Method A. -is used, Conduits and fittings must be galvanized, threaded and water tight. 2. In all other wiring exposed to weather Conduits and fittings must be galvanized, threaded and water tight. SECTION XIV When inside of building 1. Underground; If in moist location, the methods allowed are A and F. 2. In hazardous locations because of more than ordinary risk of fire or explosion; Method A. as required in National Electrical Code, Article 32. 3. Any wiring subject to continuous moisture; Method A. Conduit and fittings must be galvanized, threaded and water tight. 4. In hoistways: Between riser and limit switch, inter- locks, push buttons and similar devices: Method A. All other uses, except for light and control cables to care Method A. 5. Underplaster extensions: Methods A-D-E-F. 6. Temporary work, experimental or emergency work, work for fairs, exhibitions and similar purposes: Methods: A-B-D-E-F G-K. 7. Conduit connections to rotating or movable electrical apparatus: Method D if length is 10 feet or less. 8. Wiring in buildings located in the Fire limits, Method A. 9. Wiring for decorative lighting and display windows: Method A. 10. All wiring in apartment houses of four or more apartments Method A. 11. All electric wiring in grain elevators, or places used for storing grain, express houses, storage and warehouses, all classes of mills, factories, livery stables, garages, hotels, -10- ing g inflammable materials: Method A. ly 12. All service wiring continuous from entrance to main line switch and from main line switch to distributing cabinet: Method A. or E. 13. Wiring in all buildings used for commercial pur- poses: Methods A -B -G. 14. In alterations to existing wiring of a method not approved for new work, the wiring may be of same method as exist- ing, provided the total number of additional outlets shall not exceed 10 percent of the total number of existing outlets; and that such wiring is not obsolete or unsafe and conforms to methods of wiring recommended by the old ordinance. 15. Not more than 4 live outlets shall be permitted on any one circuit in commercial buildings. 16. Not more than 6 outlets shall be permitted on any one circuit for show windows lighting and the connected load shall not exceed 1320 watts. 17. Not more than 16 live outlets shall be permitted on any one circuit for decorative or awning lights and the connected load shall not exceed 1320 watts. 18. Not more than 6 live outlets shall be permitted on any one circuit in residential wiring. 19. Where mogul sockets are to be installed, not more than one (1) socket per circuit. 20. All outlets boxes for ceiling and bracket lights must be flush with ceiling or wall surface or never extend more than one-eighth inch inward from the finished surface. 21. Drop cords must not be installed in clothes closets, or in places where wearing apparel is likely to be hung; however, ceiling fixtures will be permissible. 22. All wires for meter loops must be No. 8B & S. gauge wire or larger. In all two -wire installations, four wires must -11- feeders must not be smaller than No.. 8 B. & S. gauge wire. Cross over tubes will not be required_ on inside of cabinets or cabinet gutters. 23. On all three -wire installation the load must be balanced as near as possible with respect to each side of the three -wire installation. In all residences, where the connected load is 5,000 watts or more, the system. of wiring must be three - wire. 24. All service wiring shall be No. 8 B. & S. gauge or larger. 25. All A. C. meters of 2 H. P. or over must be equipped with approved starting compensator or be of such electrical design that the starting current will be limited to the same value that the approved compensator will limit the current to, on any type of motor. SECTION XV Wiring for electric ranges and electric water heaters 1. Service entrance cable of the bare neutral type may be used for service entrance, and range circuits only. Where lights are fed from range services, approved cable with all conductors. insulated must be used from the circuit breaker or flipon to the lighting panel. Where water heater installations are made, ap- proved cable with all conductors insulated must be used from the circuit breaker or flipon to the heater outlet. 2. Where cable is permitted to be used in this ordinance such cable shall bear the National Board of Fire Underwriters' label of approval and shall be of a type approved for such use by the City Electrical Inspector. 3. Underground: Method A. with lead -covered conductors. Conduit and fittings must be galvanized, threaded and water -tight. 4. Note: Insulation for any underground wiring must be -12- as required by Underwriters' Laboratories' Standards for voltage to be used. All such wiring must be at least 12 inches below finished grade. SECTION XVI Re -inspection in fire limits and cormercial building. Whenever the service wires of a so-called knob and tube system is once disconnected in any commercial building or any building in the inner fire limits, the service shall not again be connected until same has been wired so as to conform to this ordinance. All switches or fuse cabinets mounted on the exterior of a building must be of an approved weather-proof type. SECTION XVII Light and Telephone Poles and Wires. 1. It shall be unladful for any person, firm or corpora- tion to hereafter erect or construct any pole, pier, abutment or anchors in the City of Beaumont, without first obtaining the written consent of the electrical inspector. 2. All poles shall be erected and maintained in a per- pendicular position and shall be straight and free from bark and placed immediately within the curbing where the sidewalks are eight feet or upwards in width, and shall be placed in the curb- ing on a line with its outer surface where the sidewalks are less than eight feet in width. When the curbing is not laid, the outer line of same shall be taken and poles set 8 inches within such outer lines. 3. Each line of poles shall be run on one side of the street, alley or avenue only except when absolutely necessary to change to the other side, but this may be done only by permission of the City Engineer. Cross -arms shall be of uniform length, strengthened by braces, and no wires shall be less than eighteen feet from the curb in height, except trolley or service wires. posters or other light material on any of their poles witnin the City limits, and any person, firm or corporation allowing same to be done shall be guilty of an offense punishable under this ordi- nance. 5. Whenever it shall become necessary for any electric light or power company to carry its wires across the line of any fire alarm, telegraph, telephone, or other electric light or power company, such wires shall be at a distance from the other wires not less than three feet. No wires shall be allowed over the fire alarm and police telegraph wires, unless special permission is given by the electrical inspector. 6. No wires of telegraph, telephone, electric railways, electric light or power companies shall be allowed under sheds, galleries or awnings of commercial -buildings without first being inspected and found safe and approved in writing by the Electrical Inspector. SECTION XVIII Adopting the National.Code. That the rules and regulations of the National Board of Fire Underwriters, embodied in its "National Electrical Coders, published in 1935, and such subsequent codes, amendments and sup- plements that said National Board of Fire Underwriters may here- after adopt, are hereby adopted as the rules and regulations to govern and to be observed and followed in all electrical wiring and in all construction, installation, repair, alterations, opera- tion and maintenance of electrical wiring, work, apparatus, and fixtures except as otherwise specially provided in this ordinance and the same are hereby made a part of this ordinance as fully and to the same extent as if copied herein in full. That any printed book entitled, "National Electrical Code", containing the regula- tions of the National Board of Fire Underwriters for electrical wiring and apparatus as recommended by the National Fire Protective Association for the year 1935, or for any subsequent year and all books containing supplements or amendments to such code which pur- port on their face to be the rules and requirements of the National interpretation of such code by the Electrical Inspector shall be final and conclusive. SECTION XIX Penalty Art. 1. Any person, firm or corporation who fails to comply with any of the provisions of this ordinance., shall upon convic- tion thereof, be punished for each offense by a fine of not less than 610.00 nor more than $100.00, or have the license provided for in this ordinance revoked, or both. Art. 2. Each day's continuance of a violation of any pro- vision of this ordinance shall be deemed a separate offense. SECTION XX Examination and Certification 1. It shall be unlawful for any Master Electrician to per- ` form any electrical work within the City of Beaumont without first obtaining a license to do the same as set forth hereafter. 2. That there shall be and is hereby created a board for the examination of all Master electricians doing business in the City of Beaumont. This board shall be known as the examining and supervising board of Master Electricians . This board shall determine the qualifications of any one desiring to enter the business of a Master Electrician. 3. The City Manager shall appoint the board of examiners, subject to approval by the City Commission, which shall consist of the City Electrical Inspector, and the City Building Inspector, two Master Electricians, one Journeyman Electrician. The City Electrical Inspector shall be the chairman of the board. 4. Before receiving a license each applicant for a Master Electrician license shall give a bond to the City of Beaumont,Texas, in the sum of 1,000.00 with such sureties as the City Manager shall approve, conditioned that such person will comply with the ordinances and laws relating to electrical wiring, and that he will -15- occasioned by his or their failure to comply with said laws and ordinances. 5. Each applicant before receiving a license must pay to the City of Beaumont, $50.00 for the first year, and $5.00 for each succeeding year. 6. All money derived from the license fees shall be deposit,,- ed eposit ed in the general fund for the maintenance of same, such as stationery,printing, etc. 7. Any license may be suspended or revoked by the electric- al inspector on the recommendation of the board of examiners should the licensee violate any ordinance or law relating to electrical wiring. Any person whose license shall have been re- voked shall not again be licensed within a period of one year from date of such action. No license shall be revoked unless the licensee has been notified in writing of the charges against him at least 10 days before such meeting. The licensee shall have the right to appear before the board of examiners to answer the charges and present testimony in his favor. S. Examinations for licenses for Master Electricians shall be given periodically by the board of examiners. Any person de- siring any such license shall make application therefor to said board of examiners not less than 5 days prior to the date on which. an examination is to be held. The board of examiners shall then examine such applicants at such place as it shall designate as to his qualifications and competency either to conduct a business or to work as an electrician. 9. Any applicant who is refused a license or whose license may have been revoked may appeal to the Board of Appeals for a review of his case. 10. If applicant be dissatisfied with the decision of the Board of Appeals he shall have the right of final appeal to the City Commission, whose judgment as to all matters involved shall be final. -16- appointed by the City Manager, subject to the approval of the City Commission, who, by experience and training, shall be qualified to pass upon the safety of installations and apparatus regulated by this ordinance. Members of the Board shall be appointed for each case as it arises. No member of the Board of Appeal shall sit in a case in which he is directly or indirectly interested, and in case of disqualification for such cause, or in case of his necessary absence, the City Manager shall make temporary appoint- ment of a substitute. Art. 2. The Board of Appeal shall meet at the call of the City Manager. Art. 3. Any applicant for an electrical permit, whose application has been rejected by the inspector, or a person who has been ordered by the Inspector to incur an expense in the alteration, repair or construction of the electrical installation of any building, may, within fifteen days thereafter, appeal there- from by giving to the inspector notice in writing of such an appeal; such notice or a certified copy thereof shall at once be transmitted by the Inspector to the Board of Appeal. After notice to such parties as the Board may direct, a hearing shall be had, and the Board may by a majority vote affirm, annul, or modify such action of the Inspector. If the action of the Inspector is af- firmed, such action shall have full force and effect. If the action of the Inspector is modified or annulled, a permit shall be issued accordingly. Art. 4. Any requirement deemed by the Inspector necessary for safeguarding the hazards from fire and to life in connection with any electrical installation not specially covered by the ordinance, shall be determined by the Inspector, subject to the Board of Appeal in the manner prescribed by Paragraph 3. Art. 5. It shall be the duty of the Electrical Inspector to submit to the City Commission on or before the first of January of each year, a report giving a summary of all the decisions of the Board of Appeal, a list of equivalents consented to and a record 11 r VV U to electrical installations in or about buildings as may to them seem advisable. Art. 6. Any person appealing from the decision of the In- spector shall attach to the written appeal a certified check for $5.00, made out in favor of the City Tax Collector, and in case the appeal is lost, the check shall be turned over to the City Tax Collector as a cost, but if the appeal is granted, the check shall be returned to the applicant. SECTION XXII Validity of Ordinance If any section, sub -section, sentence, clause or phrase of this ordinance is, for any reason, held to be invalid, such de- cision shall not affect the validity of the remaining portions of this ordinance. The City Commission of the City of Beaumont, Texas, hereby declares that it would have passed this ordinance and each section, sub -section, sentence, clause or phrase there- of, irrespective of the fact that any one or more sections, sub- sections, sentences, clauses or phrases be declared invalid. SECTION XXIII Repealing of Conflicting Ordinances All ordinances or parts of ordinances conflicting with the provisions of this ordinance are hereby repealed.
