MONROE CHAPMAN SHALL BE REMOVED FROM THE OFFICE OF TRUSTEE OF BEAUMONT INDEPENDENT SCHOOL DISTRICT BY RECALL, AND TO DETERMINE WHETHER OR NOT OTIS E. FULLEN SHALL BE REMOVED FROM . THE OFFICE OF A. MEMBER OF THE BOARD OF TRUSTEES OF THE CITY OF BEAUMONT INDEPENDENT SCHOOL DISTRICT BY RECALL,.AND TO DETERMINE WHETHER OR NOT THE PUBLIC SCHOOLS IN THE CITY OF BEAUMONT SHALL BE DIVORCED FROM MUNICIPAL CONTROL, NAMING THE TIME AND PLACE FOR HOLDING SAID ELECTION; PROVIDING THE OFFICERS TO HOLD SAID ELECTION; PROVIDING THE MANNER OF HOLDING SAID ELECTION AND -THE FORM OF THE BALLOT TO BE USED THEREAT; GIVING NOTICE THEREOF AND DECLARING AN EMERGENCY.' WHEREAS, on the 29th day of June,.A. D. 1937, there was presented to and filed with the City Commission of the City of Beaumont, a petition signed'by more than twenty-five (25%) per cent of the qualified voters voting in the last - regular election for City Officials; requesting that the pro- position . as to whether or not the public -schools in the -city- of ity- of Beaumont, Texas should be -divorced from municipal control,: b.e submitted to the -qualified voters of the City of Beaumont; and WHEREAS, on the 29th day of June, A. D. 1937, there was presented to and filed with the .City Commission of thea City of Beaumonto-Tegas, a petition -signed by more than twenty-five (25%) per cent of:the qualified voters voting in the last - regular ,election_ for City Officials, requesting that the pro- position as to whether or not Otis E. Fullen should be removed from the office of -a member of the Board of Trustees of the City of Beaumont Independent School District by.recall, be submitted to the qualified voters of the City of Beaumont; and WHEREAS, on the 29th day of Jude, A. D. 1937, there was presented to and filed with the City Commission'of the -City of Beaumont, Texas, a petition signed by more than twenty-five (25%) per cent of the qualified votbrs..,voting in the last regular election for City Officials, requesting that the pro- position as to whether or not Mrs:. Monroe Chapman shall be removed --L from the office of Trustee of Beaumont Independent School District by recall, be submitted to the qualified voters of the City of Beaumont; and WHEREAS, it is the opinion of the City Commission of the City of Beaumont that all three of said petitions are regular in fora and comply with the Charter provisions of the City of Beaumont and the Statutes of the State of Texas, and that said requests presented in said petitions should be granted and said elections ordered; and WHEREAS, it is provided in the Charter of the City of Beaumont than the form of ballot shall conform to the following requirements: (a) With respect to each person whose removal is sought the question shall be submitted vshall (name of person) be removed from the office of (name of office) by recall". (b) Immediately following each such question there shall be printed on the ballots the two propositions in the order set forth: For the recall cf (name of person); .Against the recall of (name of person); and WHEREAS, it is further provided in the Charter of the City of -Beaumont that a recall election shall be held not less than thirty (30) nor more than fifty (50) days after the petition has been presented to the City Commission at the same time as a general election held within such period; but if no such general election shall be held vithin said period, the City Commission shall call a special recall election to be held within the time aforesaid; and WHEREAS, the Charter of the City of Beaumont further provides that should a majority of the votes cast at a recall election be against the recall of the officer named on the ballot, such officer shall continue in office., but if a majority of the votes cast at such recall election shall be for the recall of the officer named on the ballot, he shall be deemed to be removed from office' NOVT, THEREFORE; BE IT ORDAINED BY THE CITY COMIISSION OF THE CITY OF BEAUMONT: Section 1 That:an election sh,411 be held in the City of Beaumont, Texas, on the 17th day of August.. A.D. 1937, :at which election there shall be submitted to the qualified voters of the City of Beaumont the following questions: T'Whether or not the public schools in the City of Beaumont, Texas shall be divorced from municipal controlV; `Whether or not Otis E. Fullen shall be removed from the office of is member of the Board of Trustees of the City of Beaumont Independent School District by recall"; 'Whether or not Mrs,'l Monroe Chapman shall be removed from the office of Trustee of the Beaumont Independent School District by recall's:, Section 2 That said election shall be held in the City of Beaumont at the following places.. to wit: In the First Ward at the Central Fire Station.' In the Second WArd -at the City Hall: In the Third Ward at Sabine Pass Fire 5tation:i That ,all voters residing in County voting precincts numbers 1, 21 3, 41 6 and 7 in the City shall vote at Central Fire Station; that all v6ters residing in County voting precincts numbers 5, 8 :and 9 in the City shall vote .at the city mall; that all voters residing in County.voting precincts numbers 10, 11, 1^., 13, 14., 15, 16 and 17 in the City shall vote at Sabine Pass Fire Station. -,i Section The following named persons -:are appointed presiding judges for their respective voting boxes in said wards, with the authority to select and appoint their own clerks: F c i If .71 At the Central Fire Station W. Ben Pipkin SectionA That :at said election each of said issues shall be submitted separately :as follows: (a) Shall the public schools of the City of Beaumont be divorced from municipal control; (b) Shall Otis E: Fullen be removed -from the office of a member of the Board of Trustees of the City of Beaumont Independent School District by recall; (c) Shall Mrs Monroe Chapman be removed from the office of Trustee of the Beaumont Independent School District by recallm° And there shall be printed on the ballots to be used in said election the following: FIRST PROPOSITION For divorcing the Public Schools of the City of Beaumont from municipal control: -Against divorcing the Public Schools of the City of Beaumont from municipal control; SECO>PROPO SI TION For the recall of Otis E, Fullen from the office of member of the Board of Trustees of the City of Beaumont Independent School District.'; Against the recall of Otis E! Beaumont Independent School District shall run .a line through and -:across the paragraph on said ballot beginning with the words "For the recall of Otis E Fu 11 en!" .And all voters debiring to vote for the recall of Mrs:! Schools in the -City of Beaumont from municipal control9 then the city officials of the City of Beaumont shall no longer have control or jurisdiction over the -appointment of trustees of the Beaumont Independent School Districts f• - . Should at said election a majority of the qualified. voters voting at said election vote in favor of the recall of Otis E.! Fullen, then the said Otis E:i Fullen shall be deemed to be removed from office: Should at said election a majority of the qualified voters voting at said election vote in favor of the recall of Mrs.! Monroe Chapman, then the said Mrs. Monroe Chapman shall be deemed to be removed from offioel Section 7 That a copy of this Ordinance signed by the Mayor of the City.of Beaumont and ,attested by the City Clerk of the City of Beaumont shall serve as proper and sufficient notice of said election, and the Mayor is hereby directed to cause a copy of this ordinance, signed by himself and attested by the City Clerk, to be posted at each of the places herein designated for holding said electionat least thttty (30) days prior to the date of holding said election., in the manner required by law:' Section 8 The fact that said election must be held on the 17th day of August, A. ' D.� 1937, in compli=ance with the Charter of the City of Beaumont, =and that the time will not permit delay and the ordinance must be posted and published not later than Tuly 17th, creates an imperative public emergency necessitating the suspension of the rule requiring ordinances to be read on three separate days before their passage, wherefore, said rule is hereby suspended .and this ordinance shall take effect from and after its pxxxx lawful passaged!
