HomeMy WebLinkAboutORD 20-MAN ORDINANCE ENTITLED AN ORDINANCE ORDERING AN ELECTION TO BE HELD IN THE CITY OF BEAUM ONT ON THE DATE AND AT THE PLACES SET FORTH IN SAID ORDINANCE FOR THE PURPOSE OF DETERMINING WHETHER OR NOT AN AMENDIMENT TO THE MISTING CITY CHARTER SHALL BE ADOPTED; NAMING THE PLACES AT WHICH SAID ELECTION SHALL BE HELD; APPOINTING OFFICERS THEREOF; PROVIDING FOR THE MANNER OF HOLDING SAID ELECTION AND GIVING NOTICE THEREOF AND DECLARING AN h'YIiERGENCY. BE IT ORDAINED BY THE CI`iY COMAISSION OF THE CITY OF BEAUMONT: Section 1. That in accordance with Section 70, Sub- section 53 of the Charter of the City of Beaumont and other provisions of said Charter, and the laws of the State of Texas relating thereto, there shall be held in the City of Beaumont on the 19th day of September' 1939, an,election for the purpose of submitting an amendment to the existing Charter of the City of Beaumont as set out in Section 4 hereof to a vote of the people for adoption. Section 2. That said election shall be held in the City of Beaumont at the following places, to -wit: In the First Ward at Junker School Building, Averill School Building and Central Fire Station. In the Second Ward at the Beaumont High School Building and City Hall. In the Third Ward at the Sabine Pass Fire Station and David Crockett Junior High School Building and South Park Elementary School Building. That all voters residing in County voting precincts numbers 1 and 2 in the City shall vote at Junker School Building; that all voters residing in County voting precinct number 4, and that part of number 47 which is within the present City limits, shall vote at Averill. School Building; that all voters residing in the County voting precincts numbers 3, 6 and 7 in the City shall vote at Central Fire Station; that all voters residing in County voting precinct ni3mber 5 in the City shall vote at Beaumont High School Build- ing; that all voters residing in County voting precincts numbers 8 and 9 in the City shall vote at the City Hall; that all voters residing in County voting precincts numbers 10, 13 and 14 in the City shall. vote at Sabine Pass Fire Station; that all voters residing in County voting precincts numbers 11 and 12 in the City shall vote at David Crockett Junior High School Building; and that all voters residing in County voting precincts numbers 15, 16 and 17 in the City shall vote at the South Park Elementary School Building, Section 3. The following named persons are appointed presiding judges for their respective voting boxes in said wards, with the authority to select and appoint their own clerks: At the Junker School Building C. A. Culmore At the Averill School Building A. F. Briggs At the Beaumont High School Ni Building W. M. Dawson At the Central Fire Station W. S. Siler At the City Hall T. S. yawn At the Sabine Pass Fire Station Mrs. Ben Pipkin At the David Crockett Junior High School Building E. J. Loew At the South Park Elementary School Building W. T. Wherry - 3 - Section 4. The question as to whether or not the existing Charter of the City of Beaumont shall be amended in the following particular shall be submitted in one proposi- tion and there shall be printed on the ballot used in said election the full text of said amendment and after said amendment there shall be printed the words "Yessr and "No" in the following form.- Shall orm; Shall Section 16, Sub -section 15 of the existing Charter of the City of Beaumont with reference to payment of taxes be amended to read as follows: Section 16 (15) (a) All taxes shall be due on the 1st day of October of each year, and shall be delinquent on the lst day of February thereafter, subject however, to the optional installment payment plan as provided for herein. All taxes from and after the day they become delinquent shall bear interest at the rate of six per centum (6%) per annum. (b) The taxes herein authorized to be levied may be paid at the option of the tax- payer in four (4) equal installments as follows. The first installment of twenty-five per centum (25%) on or before the 15th day of September of the year for which the assessment is made; the second installment of twenty-five per centum (25%) on or before December 15th next succeeding said September; the third installment of twenty-five per centum (25%) on or before March 15th next succeeding said September; and the fourth installment of twenty-five per centum (25%) on or before June 15th next succeeding said September, Each installment of taxes -if paid on or before the last day of each installment period successively and in order, shall be free from any charge for interest, I If the first or second installment I of taxes is not paid by the last day of the respective periods as they occur, the whole tax or remaining unpaid balance of the tax shall be due and payable on or before January 31st next succeeding said installment period. If the third installment is not paid by the last day of its respective installment period, then the remaining unpaid balance of the tax shall bear interest at the rate of six per centum (6f) per annum from February 1st preceding. No. And all voters desiring to vote for the above proposition to amend the existing Charter of the City of Beaumont shall run a line through or across the word "No" after the proposition, and all voters desiring to vote against the said proposition shall run a line through or across the word "Yes" after said proposition. Section 5. That said election shall be held under, and the qualifications of those voting thereat, shall be controlled by the provisions of the general laws of the State of Texas governing elections. Section 6. A copy of this ordinance, containing the text of said proposed amendment, signed by the Mayor of the City of Beaumont, and attested by the City Clerk thereof, shall serve as proper and sufficient notice of said election, and the Mayor is hereby directed to cause one each of said notices to be posted at each of the places designated for holding said election at least thirty (30) days prior to the date of holding said election, and the person posting said notices shall make a return on a copy thereof showing the time and place of said posting, which return shall be filed in the office of the City Clerk and shall be conclusive evidence of the posting of said notice, and a copy of this ordinance shall be published once each week for a period of thirty (30) days before the day of holding said - 5 - election in a newspaper of general circulation, which has been continuously and regularly published in the City of Beaumont for a period of one year prior to this date, and the City Clerk is hereby directed to mail a copy of the proposed amendment to each qualified voter in the City of Beaumont, as appears from the Tax Collector's rolls for the year ending January 31st, 1939. Section 7. Vflaereas the proposed amendment to the Charter of the City of Beaumont, which is submitted to a vote of the people by the election called for herein, if adopted, will require the Tax Collector of the City of Beaumont to change his system of preparing the tax roll, giving notice, making assessments, etc., and the time within which to do so is limited, therefore, the public interest requires that said election be called with the least possible delay, all of which creates an emergency and an imperative public necessity requiring that the rule that ordinances shall be read on three several days before their passage be suspended and said rule is here- by suspended and this ordinance shall be in force and effect from and after its passage.
