THAT CERTAIN PROPERTY ;'1TMITN AS "CITY PARS" AND SITUATED BE-
TrVAEEN WILLOW STREET AND ORLEANS STREET, AT THE INTERSECTION
THEREOF, SUBJECT TO CERTAIN LIMITATIONS ON SUCH GRANT AND USE,
FOR A CONSIDERATION OF $5.00 PER ANNUM, AND DECLARING AN
MERGENCY.
WHEREAS) the Humble Oil & Refining Company, a
corporation with its principal office and place of business.
in Houston, Harris County, Texas, has offered The City of
Beaumont FIFTEEN HUNDRED (w1.500..00) Dollars in cash for two
(2) certain small triangular tracts or parcels of land
situated on the City Block in Beaumont, Texas opposite .the
United States Post Office and bounded by Willow Street,
Orleans Street and Liberty Avenue, and also described as out
of the south end of Lot 11, Acreage Plat "E", Ass.essorts
Abstract. Brooks, City of Beaumont; and
VTHEREAS, in connection with said offer to purchase
such land at such price, the Humble Oil & Refining Company
has offered to undertake the maintenance, as city park
property, under the supervision of the Park Superintendent,
the Division of Betterment, and the Department of Public
Welfare of The City of Beaumont, of. the balance or north end
of said Lot 11, Acreage Plat "Ell, Assessor's Abstract Books,
City of Beaumont, such tract being also known and designated
as "City Park"' and lying between Orleans Street and Willow
Street, at the intersection thereof, excepting, however, the
two (2) small triangular tracts, if and when conveyed to the
Humble Oil & Refining Company for use in connection with its
service station on adjacent premises, and

71HEREAS , such use and maintenance by said Humble

supervision of the aforesaid city authority, will be in no-
wise inconsistent with,.nor would it unreasonably impair, the

but on the,other hand such use and maintenance will be to the
advantage of The City of Beaumont in materially reducing the
City's cost of maintaining city park property and will enhance
the revenues of The City of Beaumont to the extent of FIVE
($5.00) Dollars per year, payable in advance, TWO ($2.00)
Dollars upon the enactment of this ordinance and FIVE ($5.00)
Dollars on the first day of July, 1939 and the first day of
July of each and every year thereafter, therefore
BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF BEAUPIIONT®
SECTION 1:
That for and in consideration of TWO (02.00)
Dollars to be -paid to The City of Beaumont upon the final
enactment hereof, and the additional payment of FIVE ($5.00)
Dollars in advance on July 12 1939 and FIVE ($5.00) Dollars
per year in advance on the first day of July of each and
every year thereafter, the Humble Oil & Refining Company be,
and it is hereby, granted the right to use and maintain, as
city park property, subject to the supervision of the Park
Superintendent, the Division of Betterment and the Department
of Public Welfare, for a period of thirty-five (35) years from
date, the following described property owned by The City of
Beaumont:;
.That part of Lot Eleven (11), Acreage Plat
"E", Assessor's Abstract Books, City of Beaumont,
known as "City Park" and situated between Willow
Street and Orleans Street, at the intersection
thereof, and being also described as the Northern-
most end of that block in the City of Beaumont
opposite the United States Post Office, said block
being bounded by Willow Street, Orleans Street and
Liberty Avenue, excepting, however, adjacent
property conveyed to and owned by the said Humble
Oil & Refining Company,
it being understood and agreed that the above grant is subject
to the terms and provisions of The Charter of The City of
Beaumont and that such use and maintenance of said property by
the Humble Oil & Refining Company shall not be inconsistent
with, nor shall it unreasonably impair, the public use to which
said property may have. been dedicated. It is also understood
and agreed that the aforesaid grant of right shall be conditioned
upon the use of the property adjacent to, and on the south end
of, the property above described as service station property by
the Humble Oil &. Refining Company, and that the right above
granted shall terminate immediately upon the failure of the
Humble Oil & Refining Company to use .said adjacent property for
service station purposesfor any continuous period of ninety
(90) days.
SECTION 2:
The fact that the Humble Refining Company
has offered The City of Beaumont FIFTEENA($1500.00) Dollars
cash for those certain two (2) small triangular tracts of land.
first above described, and.that the use thereof by the Humble
Oil & Refining Company, in connection with its service station
on adjacent property) will increase the public safety on the
public, streets adjacent to said service station, the fact that
the duration of said offer is unknown, and the further fact
that in connection.therewith and as a part thereof the said
Humble Oil & Refining Company has requested the right to use
and maintain the tractof land described in Section 1 next
above: as city park property, under the supervision of" the. proper
city authoritie-p, and to pay for such right the sum of TWO
(.12.00) Dollars with the final enactment of this ordinance and
the further sum of FIVE: ($5.00) Dollars per year in advance on
the first day of July of each and every year thereafter, until
the termination of the grant, and the further fact that said
use and maintenance will reduce the expenditures of The City of
Beaumont and that such payment will increase its revenues,
creates an emergency and imperative public necessity requiring
the suspension of the rule that ordinances shall be read at
three meetings of The City Commission. Said rule,is, therefore,

hereby suspended, and this ordinance is put upon its final
reading and passed by a vote of 3 Ayes and `h o Nays.

SITUATED BETWEEN WILLOW STREET AND ORLEANS
STREET, AT THE INTERSECTION THEREOF, SUBJECT
TO CERTAIN LIMITATIONS ON SUCH GRANT AND USE,
FOR A CONSIDERATION OF $5.00 PER ANITM, AND
DECLARING AN EMERGENCY,
