Be it ordained by the City Council of the City of Beaumont: Section I. That the Neches Lumber Company, its successors or assigns, is hereby authorized and empowered to construct, maintain and operate a railroad switch over, upon and across the following named streets and alleys in the City of Beaumont, Jefferson County, Texas,- to-wit: exasto-wit: On Pine street from the point where Pine street is intersected by Miller Street; thence on Pine street to Jinn Roland's place on said street; thence through the alleyway leading to the mill of the Peches Lumber Company. Section II. That said Neches Lumber Company, its successors or assigns, takes the rights and franchises herein granted subject to the provisions of the charter of the City of Beaumont, and any anendment s which may hereafter be made thereto, and subject' to the ordinances of the said city now in force or which may here- after be passed. Section III The right herein granted to the Neches Lumber Company, its successors and assigns, is granted for a period of twenty-five '(25) from the date hereof. Be it ordained by the City Council of the City of Beaumont: Section I. That the Neches Lumber Company, its successors or assigns, is hereby authorized and empowered to construct, maintain and operate a railroad switch.over, upon and across the following named streets and alleys in the City of Beaumont, Jefferson Counts, Texas, to -wit: An Pine Street from the point where Pine Street is intersected by Miller Street; thence on Pine Street to Jim. Roland's place on said Street; thence through the alleyway leading to the mill of the Neches Lumber Co. Section II. That said Neches Ltunber Company, its successors or assigns, takes the rights and franchises herein granted subject to the provisions of the Charter of the City of Beaumon,, and any amend- ments which may hereafter be made thereto, and subject to the ordinances of the said city now in force or which may hereafter be passed. Section Ill. The right herein granted to the Neches Lumber Company, its successors and assigns, is granted for a Period of twenty-five years (25) from the date. hereof. ,Section IIT. The grantee herein -agreed and binds itself to do and perform the following in addition to what has been herein provided., to -wit: (a) To restore Pine Street to such.condition as may be directed by the Street and Bridge Committee and City Engineer; (b) To construct, build and maintain such drains across Section I. That the Neches Lumber Company, its successor8 or assignsq is hereby authorized and empowered to construct, maintain and operate a railroad switch over, upon and across the following named streets and alleys in the City of Beaumont, Jefferson Count--, Texas, to -wit: On Pine Street From the point where Pine Street is intersected by Miller Street; thence on Pine Street to Jim. The grantee h:erein,.agrees and binds i.tself to do and perform the following in -addition to What has been herein provided, to -wit: (a) To restore Pine Street to such.condition as may be directed by the Street and Bridge Committee and City Engineer; (b) To construct,, build and maintain such drains across said Pine Street and under said railroad tracks from time to time as may be required by the flity Zngineer; (c) Upon• being notified by the Mayor of the City of Beaumont, to conform -the tracks.to the street level, to repair the track or to repair that part of the street upon which the said track is laid to immediately comply with said notice, G And failing to begin work bona fide within ten days after the re- ceipt of such notice by the Mayor, as aforesaid, the privilege is herein granted shall be forfeited and the City of Beaumont shall have the right to remove or cause to be removed, the said track uithout any action with- out any court and wothout liability for such action on the part of the city.
