HomeMy WebLinkAboutORD 17-JAN 0 RDINAN CE CREATING A CHARITY PERMIT BOARD FOR THE CITY OF BEAUMONT, PRESCRIBING THE NUMBER AND TERM OF OFFICE OF THE MEMBERS THEREOF, AND THE DUTIES OF SAID BOARD, PROHIBITI1IG THE SOLICITATION OR COLLEC- TION OF ALMS, FOOD, CLOTHING, MONEY, CONTRIBUTIONS, OR OTHER NECESSI- TIES OF LIFE WITHIN THE CITY OF BEAUMONT WITHOUT FIRST HAVING OBTAIN- ED A PERMIT THEREFOR, PROVIDING FOR THE ISSUANCE OF AND REVOCATION OF SUCH PERMIT, PROVIDING THAT THE INVALIDITY OF ANY SECTION, PART OF SECTION OR PORTION OF SAID ORDINANCE SHALL NOT AFFECT THE VALID POR- TION, PRESCRIBING A PENALTY FOR THE VIOLATION THEREOF, AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BEAUMONT: Section 1. There is hereby created a board to be known as the Charity Permit Board of the City of Beaumont to be composed of four (4) citizens of the City of Beaumont, and the City Manager of the City of Beaumont, who shall be the Chairman of said Board, with the right to vote on all matters coming before such board. The members of said board, other than the City Manager, shall be appointed by the City Con:knission, and shall hold office from the time of their appointment until the next election for the Mayor of the City of Beaumont, and 1-Ul til their successors are ap ointe-d-and qualified. Said Board shall be appointed for the next two 2) year period after each regular election and qualification of the Mayor of the City of Beaumont. It shall be the duty of said board to pass upon all applications for permits to solicit or collect donations of alms, food, clothing, money, contribu- tions or other necessities of life either directly or by means of the sale of tickets, coupons or tokens redeemable in alms, food, clothing, lodging or other necessities of life, and to grant or refuse the same or revoke the same after granting as hereinafter provided. Section 2. That from and after the passage of this ordinance, it shall be unlawful for any person, persons, firm, corporation or association to solicit or collect donations of alms, food, clothing, mono y,contri- butions or other necessities of life either directly or by means of the sale of tickets, coupons or tokens redeemable in alms, food, clothing, lodging or other necessities of life within the City of Beaumont, with- out first making application: for, and securing a permit so to do from the Charity Permit Board herein created; provided, however, that the provisions of this section shall not apply to properly accredited solicitors of established churches of said City, soliciting for purely religious purposes, but it shall apply to the various institutional works carried on by said churches in like manner as other persons, firms, corporations and associations. Section 3. The application for such p✓rmit shall be in writing address- ed to the Charity Permit Board and shall state the name and address of the applicant; the name of the organization for which the solicitations are made, and whether such organization is a corporation or an associa- tion, giving the names of the officials or managing directors thereof; the length of time the said applicant has resided or been domiciled in the City of Beaumont; the location of the.premises from which said solicitations and collections shall be conducted; the location of the premises from which the moneys or things so solicited are to be distri- buted or administered; set forth what is to be_s_oli.cite.cLor an1]_e.nied whether money, food, clothing or otherwise; what compensation is to be received or paid any individual for services in connection with such solicitation or administration or distribution thereof; state in .detail the manner and method of the solicitations or collections proposed and the administration and distribution of the money or pro- perty so solicited or collected. Upon the filing of such application, the Charity Permit Board. shall fully investigate all facts bearing thereon and if, after such investigation, it is found that such solicitations will be fairly and honestly made and the proceeds thereof honestly and economically distributed and that there will be no probable imposi- tion upon or defrauding of the public, then such application shall be granted; otherwise the same shall be refused. Section 4. The Charity Permit Board shall revoke such permit if it shall be found, at any time after a hearing after due notice to the holder of such permit, that such solicitations or collections and distributions are not being made in accordance with such application and/or that such solicitations are not being fairly and honestly made and the proceeds thereof economically distributed. Section 5. Any person, or persons, firm, corporation or association violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof, shall be fined in any sum not less than one dollar nor more than one hundred dollars, and each day's violation hereof, or of any part hereof, shall be deem- ed a separate offense. Section 6. In the event any section or part of section or provision of this ordinance shall be held invalid., same shall not affect the valid portions hereof, which shall be enforceable regardless of such holding. Section 7. The fact that alms, food, money, clothing and contributi- ons are being indiscriminately solicited by individuals, and the dan- ger of imposition upon, and defrauding of the public, thus endangering the public peace -.and safety, thereby creates an emergency and an im- perative public necessity, requiring the suspension of the rule requir- ing all ordinances to be read on three (3) several days before passage; wherefore, such rule is hereby suspended and this ordinance shall be effective from and after its passage and lawful publication. Passed by the affirmative vote of all members of the City Conmission, this theL-) I-/ day of October, A. D. 1931.
