AN ORDINANCE
ENTITLED AN ORDINANCE GRANTING TO THE BEAUMONT WHARF
AND TERMINAL COMPANY, A CORPORATION, ITS SUCCESSORS AND ASSIGNS,"
THE RIGHT AND PRIVILEGE TO LAY, BUILD, CONSTRUCT."(MAINTAIN AND
OPERATE A STANDARD GAUGE RAILROAD TRACK IN THE CITY OF-BEAUMONT,
JEFFERSON COUNTY, TEXAS,'' FROlVI A POINT IN AUSTIN STREET SOUTH OF
BLOCK 695, OF THE OLD TOWN OF BEAUMONT, CONNECTING WITH AND PARA-
LLEL TO THE MAIN TRACK OF THE BEAUMONT WHARF AND TERMINAL COMPANY,
NOW CONSTRUCTED IN SAID STREET AND RUNNING DOWN SAID AUSTIN STREET
TO A POINT JUST BEYOND LOT No. 357 IN SAID BLOCK, AS SHOWN BY THE
BLUE PRINT ATTACHED TO SAID ORDINANCE; PROVIDING THAT SAID TRACK
SHALL BE USED -ONLY AS AN INDUSTRY TRACK AND FOR NO OTHER PURPOSE;
PROVIDING FURTHER THAT THE RIGHTS AND PRIVILEGES THEREIN GRANTED
SHALL BE ACCEPTED IN WRITING BY SAID CORPORATION WITHIN THIRTY DAYS
AFTER THE PASSAGE THEREOF AND THE SIGNATURE OF THE MAYOR; PROVIDING
FURTHER THAT SAID INDUSTRY TRACK SHALL BE COMPLETED WITHIN TWELVE
MONTHS AFTER THE FINAL PASSAGE AND PUBLICATION OF SAID ORDINANCE
AND THAT SAID BEAUMONT WHARF AND TERMINAL COMPANY, OR ITS SUCCESSORS
AND ASSIGNS, SHALL PAY TO THE CITY OF BEAUMONT ANNUALLY ON THE FIRST
DAY OF JUNE OF EACH YEAR THE SUM OF($25.00) TWENTY FIVE DOLLARS, AS
REASONABLE COMPENSATION FOR THE PRIVILEGE AND FRANCHISE THEREBY
GRANTED: AND PROVIDING FURTHER THAT SAID FRANCHISE SHALL BE SUBJECT
TO THE TERMS AND CONDITIONS OF THE CITY CHARTER OF THE CITY OF BEAU--
MONT AND SHALL EXIST FOR A PERIOD OF TEN YEARS.
BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF BEAUMONT:
Section 1,
Beaumont Wharf and Terminal Company, its successors and
assigns, is hereby granted the right and franchiselto lay, build,
construct, maintain and operate, at its own expense, a standard
gauge railroad track along, over and upon Austin Street, from a
point in the main_ line.track of the Beaumont Wharf and Terminal Com-
pany in'Austin Street at Track Chaining Station 25+56.41 to a point
just beyond Lot. No. 357, in Block No. 69, a distance of approximate-
ly 343 feet, as more accurately shown by the blue print hereto
attached marked "Exhibit A" and made a part of this ordinance. The
line of said proposed railway being indicated by the red lines drawn
on said blue print.
Section 2.
The track to be laid, built, constructed, maintained and
operated under the terms and conditions of this ordinance shall be

used only as an industrial track, that is for the purpose of afford-
ing loading, unloading and switching facilities to commercial and
industrial enterprises now located or hereafter to be located in the
vicinity of said track.
Section 3.
The foregoing rights and privileges are granted upon the
expressed condition that the said grantee shall, within thirty days
after the passage and approval of this ordinance, file "with the City
Clerk of Beaumont its written acceptance of this ordinance.
Section 4.
Unless the Beaumont Wharf and Terminal Company, its success-
ors or assigns, shall construct, build, lay and complete for the pur-
pose of operating the track herein contemplated within twelve months
after the final passage, acceptance and publication of this ordinance,
then to the extent of the track not socompleted, this ordinance shall
become null and void and of no force and effect.
Section 5.
This ordinance and the rights and privileges therein grant-
ed are subject to all of the terms and provisions of the Charter of
the City of Beaumont, and said privilege and franchise hereby granted
shall continue in force for a period of ten years from and after the
date of said grantee's acceptance of the terms hereof.
Section 6.
As reasonable compensation for the rights and privileges
granted by this ordinance, grantee agrees and obligates itself and its
successors and assigns, to pay to the City of Beaumont on or before
the first. day of June of each year after the taking effect of this
ordinance, the sum of TWENTY-FIVE AND N01100 DOLLARS ($25.00).

of tho'City of Beaumont, and said privilege and franchise hereby
granted shall continue in forc-e for a period of ten year :-- from. and
after the date of said grantees acceptance of the terms "hereof. *
Section 6.
As reasonable co?nipensation for the rights and pr'ivilegbs
granted by this ordinance, granteez a-grees and obligates itself and its
successors and assign,s., to pay to the City of Beaumont on or before
