AN ORDINANCE
ENTITLED AN ORDINANCE GRANTING GULF, COLORADO AND SANTA
FE RAILWAY COMPANY AND GULF, BEAUMONT AND KANSAS CITY RAILWAY COM-
PANY,) ITS AND THEIR SUCCESSORS AND ASSIGNS, THE RIGHT AND PRIVILEGE
TO CONSTRUCT, LAY, MAINTAIN AND OPERATE A STANDARD GAUGE RAILROAD
TRACK IN THE CITY OF BEAUMONT, JEFFERSON COUNTY; TEXAS, .ALONG AND
ACROSS NECHES STREET, AND SO MUCH OF THE ALLEY RUNNING EAST AND WEST
THROUGH BLOCK NUMBER SEVENTEEN (17) OF THE VAN WORMER ADDITION AS MAY
BE NECESSARY FOR THE CONSTRUCTION, OPERATION AND MAINTENANCE OF SAID
TRACK, THE CENTER LINE OF WHICH WILL BE EIGHTEEN (18) INCHES FROM THE
SOUTH LINE OF SAID ALLEY THROUGH SAID BLOCK NO. 17; SAID TRACK LEAV-
ING BLOCK NUMBER EIGHTEEN (18) OF THE VAN WORMER ADDITION ONE HUNDRED
SEVENTY-ONE AND EIGHT TENTHS (171.8) FEET SOUTH OF THE SOUTH LINE OF
CROCKETT STREET AND ENTERING BLOCK NO. 17 OF THE VAN WORMER ADDITION
ONE HUNDRED SIXTY-ONE AND FIVE TENTHS (161.5) FEET SOUTH OF THE SOUTH
LINE OF CROCKETT STREET, AND DESCRIBED UNDER THE TERMS AND CONDITIONS
OF SAID FRANCHISE.
BE IT. ORDAINED BY THE CITY COMMISSION OF THE

Section 1.
Gulf, Colorado and Santa Fe Railway Company and Gulf,
Beaumont and Kansas City Railway.Gomp any, its and their successors
and assigns, are hereby granted the right, privilege and franchise
to construct, lay, maintain and operate at their own expense a
standard gauge railroad track over and across Neches Street, enter-
ing the west line of Neches Street at a point one hundred seventy-
one and eight tenths (171.8) feet south of the south line of Crock-
ett Street, crossing Neches Street on a fifteen degree reverse curve,
leaving Neches Street at a point on the east line of Neches Street
one hundred sixty-one and five tenths (161.5) feet south of the
south line of Crockett Street and on reaching tangency running
parallel to and with its center line one and five tenths (1.5) feet
south of the north line of the south half. of Block No. 17, Van Worm-
er Addition to the west line of Park Street, substantially as indicated
by the red lines shown on the blue print hereto attached, marked"Exhi-
bit A" and hereby referred to and made a part hereof.
Section 2.
The track to be laid, built, constructed, maintained and
operated under the terms and conditions of this ordinance shall be
used only as an industrial track, that is, for the purpose of afford-
ing loading, unloading and switching facilities to commercial and
industrial enterprises now located or hereafter to be located in
the vicinity of said track, and will be so constructed, operated
and maintained as to interfere as little as possible with the use
by the public of said street and alley.
Section 3.
The foregoing rights and privileges are granted upon
the expressed condition that the said grantees shall, within thirty
(30) days after the passage and approval of this ordinance; file
with the City Clerk of the City of Beaumont their written accept-
ance of this ordinance.
Section 4'.
Unless, Gulf, Colorado and Santa Fe Railway Company and
Gulf, Beaumont and Kansas City Railway Company, its and their
successors and assigns, shall construct, build, lay and complete
for the purpose of operating the track herein contemplated within
twelve months after the final passage, acceptance and publication
of this ordinance, then to the extent of the track not so completed,
this ordinance shall become null and void and of no force and effect.
Section 5.
This ordinance and the rights and privileges therein
granted are subject to all of the terms and provisions of the Charter
of the City of Beaumont, and said privileges and franchise hereby
granted shall continue in force for a period of ten (10) years from
and after the date of said Grantees' acceptance of the terms hereof.
Section 6.
As reasonable compensation for the rights and privileges
granted by this ordinance, Grantees agree and obligate themselves
and their successors and assigns, to pay to the City of Beaumont on
or before the first day of July of each year after the taking effect
of this ordinance the sum of Twenty-five and No/100 Dollars (25.00).
Passed by the affirmative vote of all members of the City
Commission, this the 14th day of June, A. D. 1932.
