HomeMy WebLinkAboutORD 87-A-1-_----v_-ORDINANCE K6.790 ----------- AN ORDINANCE creating the office of CITY SANITARY COMMISSIOXE R defining his duties, providing for the removal of slops and trash from the houses of the inhabitants of the City of Beaumont and imposing penalties for any violation of the provisions of this ordinance:-- 1 rdinance:-- Beaumont. BE IT ORDAINED by the- Cita Council of the' City of Section No. 1. The office of CITY SANITARY COMAISSIONER is hereby created. The Mayor shall appoint a su^t(Lble person to act as City sanitary Commissioner; said appointment to be confirmed by the City Council The said City Sanitary Commissioner shall hold his office for a period of time to be determined at the will.of the City Council. He shall be subject to suspention by the hfayor and can be finally discharged by the City Council at any. time. Section No.2. The City Sanitary Commissioner shall be under the general control and directions of the .Mayor of the City. He shall, before entering upon his duties, give bond in the sum of Five hundred dollars, payable to the corporation of the City of Beaumont, conditioned that he will faithfully discharge the duties of his office. Section No. 3. It shall be the duty of the City Sanitary Commissioner, whenever requested by any person after the tender of such.fees, which may be provided by the City Council, to remove and carry out of the city all slops and trash frok the premises of any of the inhab- itants of the City of Beaumont when the same is prepaired for -removal as hereinafter provided. Section No. 4. The word "Slops" as used in this ordinance, shall be taken to mean all refuse matter and articles wheather vegetable or animal, thrown out of or rejected from the kitchen or houses of the inhabitants of the City of Beaumont. The word "Trash", as used in this ordinance, shall be taken to mean all sweepings, waste paper, ------2----- hay, straw, tin cans, boots shoes, tin or sheet iron pieces,,�,­��'` xI3bM2xdd3q2 a old clothing, sacks and rubbish of any kind. Section No. 5. That all slops shall be removed from hotels, regular bparding houses and restaurants, at least once in every forty-eight hours and from all other premises as often as may be necessary to insure the cleanliness and proper sanitary conditions of the premises. All trash shall be removed from business houses in the business portion of the City of Beaumont at least once in every twenty-four hours and from all other premises as often as may be necessary to insure the cleanliness and the sanitary conditions not of the premises, provided that it shall be a violation of this ;6. article if slops or trash are not removed through the neglect of the City Sanitary Commissioner after he -has been requested to remove the same in the manner here -in -after provided. Section No. 6. That all slops and trash shall be deposited in sutible vessels of iron or wood and kept in a convenient place easy of access upon the premises, but slop and trash shall be kept in a separate recepticle, provided that nothing here -in -shall be deamed to repeal or in any manner change article No. 462 of the revised ordinances pf the City of Beaumont, provided for and the keeping and maintaining of galvanized iron or tin trash cans in certain portions of the City of Beaumont; that the said article shall be and remain in full force and effect. Section No. 7. The City Sanitary Commissioner shall have and keep an office in the same building where -in the Mayor's office may be situated and any persona or persons desiring the services of said Commis- sioner may obtain the same by leaving a written request at the said Commissioner's office and giving the name, street and number and depositing the fee of said Commissioner or by entering into a contract with said Commissioner as hereinafter porvided. Section No. 8. Any person or persons may enter into a contract with the City Sanitary Commissioner for the removal of slops nd trash or or either from the premises owned or occupied by them at stated times and on such terms as the parties may agree upon, provided that said contract shallnot provide for fees greater thak shall be allowed by the City Council and if the said Commissioner shall, during the term of said contract, fail to visit said premises at the time stated in the contract for the removal of slops and trash, or either, he shall be deemed guilty of a misdemeanor and punished as here -in -after provided. Section No. V As compensation, the City Sanitary Commistioner shall receive such sums as the Council may by resolution, determine. Said compensation, shall in all cases, be paid by the person or persons employing the said Commissioner and anyone employing the said Commissioner and failing to pay him for work done shall be deemed guilty -of a misdemeanor and liable to a fine as here- in -after provided. Section No. 10. If the City Sanitary Commissioner shall fail to remove and carry off any slop and trash within twenty-four hours after having been notified and requested to remove the same as here -in provided he shall be deemed guilty of a misdemeanor and liable to a fine as here -in -after provided. Section No. 11 It shall be the duty of the City Sanitary Commissioner to carefully inspect the premises in the City of Beaumont and call the attention of all occupants and tenants of such premises to the condition of the same. When in his judgement the said premises need cleaning and fur this purpose the said Commissioner is hereby given free access to all premises within the corporate limits of the City of Beaumont while in the discharge of his duty during the day time and should any occupants,or tenants of premises within the corporate limits refuse to permit the said Commissioner to enter upon the said premises for the purpose of inspecting the same, he shall be deemed guilty of a misdemeanor and fined as here -in -after provided, and it is hereby made the duty of the said Commissioner to report to the Mayor the names of the occupants and tenants r -----4----- of any premises in an unsanitary condition, said report to be made in writing and delivered at the office of the Mayor, and shall contain the names of the occupants and tenants, and street and number and adress. Section No. 12. , No one bytt said Commissioner, or the owners of slops and trash shall remove same from the premises. Section No. 13. The said Commissioner shall pr6vide carts for hauling of slops, which said carts shall be fitted up with a good and substantial tight box, the sides of which shall bless than twenty-four inches highNad the tail -board, eighteen inches high, so that no portion of the said slops shall be scattered upon or thrown into the streets, said boxes shall be closely covered with sufficient covering, or so closely covered as to prevent the escape, or flying out of any of the x3aq= contents or effluvia thereof, and for the hauling of trash shall be provided, carts or wagons so arranged as that the trash so hauled will not be scattered in or thrown upon the streets. Section No. 14. If the Sanitary Commissioner or any other person shall violate any of the foregoing provisions of this ordinance, he shall be deemed guilty of a misdemeanor and fined in any sum not less than one or more than twenty five dollars. The foregoing ordinance was upon motion referred to the Ordinance Committee with instructions to report upon it atonce where -upon the Ordinance Committee recommended its passage. Upon motion the rule requiring ordinances to be read upon three sep- arate meetings before passage, came upon its third and final call and was duly passed, all the Aldermen voting in the affirmative. V The following resolution was offered by the Garbage Committee and adopted by the Council: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT; That until changed by resolution of the City Council, the City Sanitary Commissioner shall be allowed to charge -the following rates and no more for the removal of slops and trash to -wit: For each private residence, the sum of fifteen cents per trip, provided that wherex two or more families reside and do cooking in the same residence, the charge shall be twenty- five cents per trip. For each regular boarding house the sum of fifteen cents per trip. Busimess houses in business part of town where one trip per day is to be made, ten cents per trip. Hotels and restaurants twenty-five cents per trip. The above passed at a regular meeting of the City Council of The City of Beaumont held in the City of Beaumont on Sept. 2nd. A.D. 1902.
